The new "Measures" expand the definition of outdoor advertising settings from the perspective of behavioral consequences. The new "Measures" clarify that outdoor advertising refers to the use of buildings and other carriers to set up words, images, electronic light and shadow display devices, physical modeling and other ways to publish advertisements to outdoor space.

In the new "Measures", there are new regulations on the situation of prohibiting outdoor advertising. Among them, it is forbidden to set up outdoor advertisements outside the top and top contour lines of buildings, and it is forbidden to set up outdoor advertisements in residential buildings or residential parts of comprehensive buildings.

In addition, the new "Measures" explicitly prohibit the installation of outdoor advertisements, including: using traffic safety facilities and traffic signs; Affecting the use of municipal public facilities, traffic safety facilities, traffic signs, fire control facilities and fire safety signs; In kindergartens, schools, state organs, cultural relics protection units and scenic spots, as well as the use of footbridges, railway overpasses, highway overpasses and other bridges.

Optimization of large-scale outdoor advertising licensing process

The current "Measures" stipulate that if non-public carriers are used to set up large-scale outdoor advertisements to promote their own goods and services, the applicant shall apply to the municipal urban management department before setting up, and it is necessary to provide a number of materials such as carrier use right certificate and safety certificate.

With the continuous promotion of decentralization, strengthening supervision and improving service reform, the new "Measures" have optimized the handling process of large-scale outdoor advertising licenses. In the new "Measures", these materials have been "slimmed down". Applicants only need to provide three materials: an application for outdoor advertising, a certificate for the use of non-public carriers, and a design plan for outdoor advertising facilities.

At the same time, the new "Measures" also proposed that "the municipal urban management department should make a decision on approval or disapproval within 20 working days from the date of acceptance; If it needs to be handled in conjunction with natural resources and planning, urban and rural construction, public security, market supervision and other relevant departments, it shall not exceed 45 working days. "

The time limit for setting outdoor advertisements on electronic display screen shall not exceed 5 years.

It stipulates that "if an application for setting up a large-scale outdoor advertisement is examined and approved or the right to use a large-scale outdoor advertising carrier is obtained by auction, the municipal urban management department shall issue a license for setting up outdoor advertisements".

"Outdoor Advertising License" shall specify the location, form, specifications, time limit, facilities expiration treatment and other matters. If outdoor advertisements are set up in violation of regulations, the urban management department shall order them to correct or dismantle them within a time limit, and impose a fine in accordance with the following provisions: if outdoor advertisements are set up without authorization, and the city appearance is affected, a fine of more than 2,500 yuan from 500 yuan shall be imposed; If the outdoor advertisements and signboards are not in conformity with the provisions, a fine of more than 200 yuan 1000 yuan shall be imposed.

The new "Measures" also adds a penalty: for outdoor advertising and signboard facilities that do not meet the urban appearance standards and environmental sanitation standards, the urban management department, together with the natural resources and planning departments, shall order the relevant units and individuals to renovate or dismantle them within a time limit; If it is not rebuilt or demolished within the time limit, it will be demolished in accordance with the relevant regulations, and a fine of 1000 yuan to 5000 yuan may be imposed.
