According to the Regulation on Prevention and Control of Pollution in Livestock and Poultry Farming, which came into effect on 20 14 10, the State Council Decree No.643rd:

Article 13 Livestock and poultry farms and breeding communities shall, according to the scale of breeding and the needs of pollution prevention and control, build corresponding facilities for comprehensive utilization and harmless treatment of livestock and poultry manure, sewage and rainwater separation, livestock and poultry manure and sewage storage, manure anaerobic digestion and composting, organic fertilizer processing, biogas production, biogas residue and biogas slurry separation and transportation, sewage treatment and livestock and poultry carcass treatment. Those who have entrusted others to carry out comprehensive utilization and harmless treatment of livestock and poultry breeding wastes shall not build their own facilities for comprehensive utilization and harmless treatment.

Livestock and poultry farms and breeding communities shall not be put into production or use if supporting facilities for pollution prevention and control are not built, self-built supporting facilities are unqualified or others are not entrusted to comprehensively utilize and treat livestock and poultry breeding wastes harmlessly.

Livestock and poultry farms and farming communities that build their own supporting pollution prevention and control facilities shall ensure their normal operation.

Article 20 The discharge of treated livestock and poultry wastes into the environment shall conform to the national and local pollutant discharge standards and total amount control indicators. Without treatment, livestock and poultry breeding waste shall not be directly discharged into the environment.

3. Responsibilities to be undertaken:

Thirty-seventh in violation of the provisions of this Ordinance, the construction of livestock and poultry farms, breeding areas, the competent department of environmental protection of local people's governments at or above the county level shall be ordered to stop the illegal behavior; Those who refuse to stop the illegal act shall be fined between 30,000 yuan and 654.38+10,000 yuan, and shall be reported to the people's government at or above the county level to be ordered to dismantle or close down. Construction of livestock and poultry farms and breeding communities in drinking water source protection areas shall be ordered by the competent environmental protection department of the local people's government at or above the county level to stop the illegal act, and a fine of 654.38+10,000 yuan but less than 500,000 yuan shall be imposed, and the people's government with the approval authority shall order it to be dismantled or closed.

Article 39 If, in violation of the provisions of these Regulations, supporting facilities for pollution prevention and control are not built, or the supporting facilities built by themselves are unqualified, or others are entrusted to comprehensively utilize and treat livestock and poultry breeding wastes harmlessly, livestock and poultry farms and breeding communities are put into production and use, or supporting facilities for pollution prevention and control are not operating normally, the competent environmental protection department of the people's government at or above the county level shall order them to stop production or use, and may concurrently impose a fine of 6,543,800 yuan.

Article 40 Anyone who violates the provisions of these Regulations and commits any of the following acts shall be ordered by the competent environmental protection department of the local people's government at or above the county level to stop the illegal act, take control measures, eliminate pollution within a time limit, and be punished in accordance with the relevant provisions of the Law on the Prevention and Control of Water Pollution in People's Republic of China (PRC) and the Law on the Prevention and Control of Environmental Pollution by Solid Waste in People's Republic of China (PRC):

(a) using livestock manure as fertilizer, which exceeds the land absorption capacity and causes environmental pollution;

(two) engaged in livestock and poultry breeding activities or livestock and poultry breeding waste treatment activities, without taking effective measures, resulting in the leakage of livestock and poultry breeding waste.

Article 41 Where the discharged livestock and poultry waste does not meet the national or local pollutant discharge standards or total amount control indicators, or directly discharges livestock and poultry waste into the environment without harmless treatment, the competent environmental protection department of the local people's government at or above the county level shall order it to be treated within a time limit and may impose a fine of less than 50,000 yuan. The competent department of environmental protection of the local people's government at or above the county level shall, after making a decision on treatment within a time limit, timely verify the implementation of the rectification measures in conjunction with the relevant departments of agriculture and animal husbandry of the people's government at the same level, and announce the verification results to the public.

4. Way out: continuously increase the scale of breeding and investment in environmental protection to meet the ever-increasing environmental protection requirements, otherwise it will be difficult to meet the environmental protection requirements.
