Public security, water conservancy, transportation, environmental protection, health, industry and commerce administration, land management and other relevant departments shall, in accordance with their respective responsibilities, cooperate with the fishery administrative departments, supervise and inspect the implementation of fishery laws and regulations, and do a good job in fishery work. Article 5 People's governments at all levels shall reward units and individuals that have made remarkable achievements in the proliferation and protection of fishery resources, the development of fishery production, and the scientific research of fishery. Chapter II Aquaculture and Fishing Article 6 People's governments at all levels shall make unified plans for aquaculture and fishing on aquaculture water surfaces and maintain ecological balance; Encourage and support units owned by the whole people, collectively owned units and individuals, make full use of existing water surfaces, mining subsidence areas, geothermal resources and waste heat from factories, develop aquaculture and promote fishery industrialization. Seventh contract, lease and other forms of business use of aquaculture water owned by the whole people, should be issued by the people's government at or above the county level aquaculture use certificate, confirm the right to use. Across administrative regions, the people's government at the next higher level shall issue a certificate for the use of surface aquaculture to confirm the right to use it.
If the water surface owned by the whole people is used for aquaculture production and the water surface is deserted for more than one year without justifiable reasons, the issuing authority shall order it to develop and utilize it within a time limit. If it is not developed and utilized within the time limit, the water surface barren development fee shall be levied, and the aquaculture use certificate may be revoked.
The water surface barren development fee is levied at 10% of the average mu output value of water surface development in local similar waters. Article 8 On the basis of voluntariness and mutual benefit, aquaculture water surface can be contracted by collectives or individuals, or operated in the form of leasing or joint-stock system, allowing and supporting the introduction of foreign capital, investment, development and utilization by units and individuals inside and outside the province.
A contract shall be signed for contracting aquaculture water surface. The development of wasteland, barren water and depression can be contracted for more than 20 years. The employer and the contractor shall strictly perform the contract. Article 9 The ownership and use right of aquaculture water surface shall be protected by law, and no unit or individual may infringe upon it. Disputes over ownership shall be handled by the people's governments at or above the county level in accordance with the relevant provisions of the state, and no party shall destroy the aquaculture production before handling.
It is forbidden to steal or rob aquatic products cultivated by others. It is forbidden to destroy other people's aquaculture water bodies and facilities. Article 10 Fishery administrative departments at all levels shall encourage and support the popularization and application of new aquaculture technologies, and develop intensive pond culture, cage fish culture, purse seine fish culture, paddy fish culture, running water fish culture in mountainous areas and factory fish culture according to local conditions. Eleventh state-owned and collective fishing grounds should give full play to the advantages of technology and equipment, do a good job in seed breeding, cultivation and supply, and carry out technical services. Article 12 To develop aquaculture production, we should optimize the structure of aquaculture varieties, actively develop seedlings and aquaculture production of famous aquatic products such as shrimp, river crab and turtle, increase the output of famous aquatic products and improve economic benefits. Thirteenth fish pond construction, should be combined with farmland water conservancy capital construction planning and agricultural structure adjustment plan, mainly using wasteland, waste water, depression, strictly control the occupation of cultivated land.
Requisition of intensive fish ponds for construction needs shall be handled in accordance with the relevant provisions of the state, and the fund for the construction and transformation of fish ponds shall be levied for the construction of new fish ponds. Specific collection measures shall be formulated by the provincial fishery administrative department and submitted to the provincial people's government for approval and implementation. Article 14 People's governments at all levels and fishery administrative departments shall encourage and support the cultivation of aquatic plants with economic value, make rational use of water bodies suitable for cultivation, and plant aquatic economic plants such as reed, cattail, Euryale euryales, water chestnuts and lotus roots in barren beaches, barren waters and depressions to develop deep processing. In schistosomiasis endemic areas, it is forbidden to plant reeds. Fifteenth all units and individuals engaged in the fishing industry must apply to the fishery administrative department of the people's government at or above the county level or its subordinate fishery supervision and administration institutions for obtaining fishing licenses. In the first quarter of each year, the issuing authority conducts annual examination of the fishing license.
Unless otherwise stipulated by the state, the fishing license shall be uniformly supervised by the provincial fishery administrative department. Article 16 Anyone who fishes outside the workplace specified in the fishing license must apply for a temporary or special fishing license to the fishery superintendency agencies in the workplace with the original fishing license and the certificate from the local fishery superintendency agencies.
Fishing in the waters of our province from other provinces must be approved by the fishery superintendency agencies of other provinces and the original fishing license. Article 17 Fishing gear and planting aquatic plants shall not affect shipping and flood discharge. Eighteenth in the fishing area, fishing period shall not be recreational fishing. Fishing in aquaculture or proliferation waters must obtain the consent of the breeder or proliferator, and no fishing areas can be designated if conditions permit.
