Construction project quality assurance (warranty) gold (hereinafter referred to as the deposit)

1, meaning of deposit

Construction project quality assurance (warranty) fund refers to the funds agreed by the employer and the contractor in the construction project contract and reserved from the payable project funds to ensure the contractor to repair the defects of the construction project during the defect liability period (i.e. quality warranty period). Defects refer to the fact that the quality of construction projects does not meet the mandatory standards, design documents and contract stipulations.

2. Defects liability period and its calculation

The employer and the contractor shall sign the quality warranty before the completion of the project (generally at the same time as signing the contract) as an annex to the contract. The warranty shall clearly specify the duration of the defect liability period.

The defect liability period shall be calculated from the date when the project passes the completion (handover) acceptance. If the project cannot be completed and accepted within the specified time limit due to the contractor's reasons, the term responsibility period shall be calculated from the date when the project actually passes the completion (handover) acceptance. If the project cannot be completed (delivered) and accepted within the specified time limit due to the reason of the Employer, the project will automatically enter the defect liability period 90 days after the contractor submits the completion (delivered) acceptance report.
