The term "tobacco control" as mentioned in the preceding paragraph refers to taking effective measures to ban smoking in places where smoking is prohibited as stipulated in these regulations. Article 3 The principle of "limited places, classified management, unit responsibility, public participation and comprehensive management" shall be implemented in the tobacco control work in this Municipality. Article 4 Under the leadership of the people's government at the same level, the municipal and district health promotion committees shall be responsible for organizing and coordinating the tobacco control work within their respective administrative areas, guiding and supervising the tobacco control work of various departments and industries, and organizing publicity and education activities on tobacco control work. The daily office of the Health Promotion Committee is located in the administrative department of health and family planning at the same level.
The administrative department of health and family planning is the competent department of tobacco control in public places in this Municipality.
The administrative departments of education, culture, film and television, sports, tourism, food and drug supervision, transportation, commerce, public security, housing and urban construction, and comprehensive law enforcement of culture shall, in accordance with these regulations and other relevant provisions, do a good job in tobacco control supervision and management. Article 5 The Municipal Health Promotion Committee shall organize and carry out various forms of tobacco control publicity and education to make the public understand the harm of tobacco smoke and enhance the awareness of the whole society to create a smoke-free environment.
Relevant administrative departments, people's organizations, schools, hospitals and other units shall regularly carry out publicity and education activities on tobacco smoke hazards and tobacco control.
Radio, film and television, newspapers, newsletters, websites and other media should carry out public welfare publicity activities that smoking and passive smoking are harmful to health. Article 6 Smoking is prohibited in indoor public places, indoor workplaces and public transport. Article 7 Smoking is prohibited in outdoor areas of the following public places:
(a) nurseries, kindergartens, primary and secondary schools, children's palaces, youth activity centers, educational and training institutions and children's welfare homes and other public places with minors as the main activity groups;
(2) Maternal and Child Health Hospital and Children's Hospital;
(3) Audience seats in stadiums, performance venues, competitions and performance areas;
(four) cultural relics protection units open to the public;
(5) Public transport waiting areas where crowds gather;
(six) other public places as prescribed by laws, regulations and rules.
The municipal and district people's governments may, according to the needs of large-scale activities, set the outdoor areas of other public places as temporary no-smoking areas. Article 8 Where conditions permit, smoking spots may be set up in outdoor areas of other public places and workplaces other than those stipulated in Articles 6 and 7 of these Regulations.
The setting of smoking spots shall meet the following requirements:
(a) away from the crowd gathering area and the main passage that pedestrians must pass;
(2) Set up smoking point signs and guiding signs, and set up warning signs that smoking is harmful to health at smoking points;
(3) placing instruments for collecting cigarette ash and cigarette butts;
(4) meeting the requirements of fire control safety. Article 9 Units that prohibit smoking shall perform the following obligations:
(a) the implementation of measures to discourage smoking or organize volunteers to discourage smoking;
(two) do a good job in the publicity and education of smoking prohibition;
(three) set up a unified no smoking sign and supervision telephone number in a conspicuous position;
(4) Do not install any smoking-related appliances;
(5) discouraging smokers;
(six) report to the regulatory authorities for smokers who do not listen to dissuasion and are unwilling to leave the no-smoking places. Article 10 Any individual may require smokers to stop smoking in places where smoking is prohibited; Require the unit where the smoking place is located to fulfill the obligation to ban smoking, and report to the regulatory authorities the unit that fails to fulfill the obligation to ban smoking. Eleventh state organs, institutions and their staff should abide by the relevant provisions of tobacco control, take the lead in fulfilling the obligation of tobacco control. City and district health promotion committees shall regularly carry out tobacco control inspections and report on tobacco control.
Health and family planning, education, culture, film and television, sports, tourism, food and drug supervision, transportation, commerce and other relevant administrative departments and related industry associations should incorporate tobacco control into the daily management of this system and this industry. Article 12 The municipal and district health promotion committees shall organize relevant departments to strengthen the monitoring and evaluation of tobacco control.
The Municipal Health Promotion Committee shall announce the tobacco control work in this Municipality to the public every year. Thirteenth health and family planning administrative departments should organize intervention in smoking behavior, set up a hotline, and carry out tobacco control consulting services.
Medical institutions should provide guidance and help for smokers to quit smoking. Article 14 The whole society should participate in tobacco control.
Encourage tobacco control volunteer organizations, other social organizations and individuals to carry out tobacco control publicity and education activities, organize social supervision, provide smokers with help to quit smoking, and put forward opinions and suggestions on tobacco control.
Encourage units and individuals to report violations of these regulations through the "12345" public service hotline or related industry supervision hotline.
