Procedures for Handling Illegal Acts of Road Traffic Safety Illegal acts discovered by traffic police in law enforcement on duty shall be under the jurisdiction of the traffic management department of the public security organ where the illegal acts occurred. Traffic police should show their law enforcement certificates when investigating and dealing with illegal acts. The traffic police shall strictly implement the safety protection regulations and pay attention to their own safety, and there shall be no less than two law enforcement officers in expressway. The traffic police should comprehensively, timely and legally collect evidence that can prove the existence of illegal acts and the seriousness of illegal circumstances. When the traffic police investigate and deal with illegal acts, they should check the motor vehicle driver's license, driving license, motor vehicle number plate, inspection mark, insurance mark and other number plates, as well as the illegal information of motor vehicles and drivers. Other relevant documents and materials shall also be examined when investigating the illegal acts of vehicle drivers carrying explosives, inflammable and explosive chemicals, highly toxic and radioactive dangerous goods. When examining the motor vehicle driver's license, the traffic police shall ask the driver's name, address and date of birth, and check with the contents recorded in the driver's license; Check the appearance of the holder with the photo on the driver's license. When necessary, drivers may be required to show their resident identity cards for verification. If compulsory administrative measures need to be taken in the investigation, they shall be implemented in accordance with laws, regulations, these Provisions and other relevant provisions of the state. The traffic police should stick a notice of illegal parking on the side door glass of the motor vehicle or the motorcycle seat when the driver of the motor vehicle is not on the scene, and fix the relevant evidence by taking photos or videos. If the violator is found to have other illegal acts in the investigation, the decision on handling illegal acts of road traffic safety shall be made in accordance with the relevant provisions and transferred to the unit with jurisdiction for handling. If it is suspected of constituting a crime, it shall be turned into a criminal case or transferred to the competent authority or department with the right to handle it. The traffic administrative department of the public security organ shall accept complaints and reports on illegal acts and cases transferred by other administrative departments, and deal with them according to regulations. The traffic administrative department of the public security organ and its traffic police may take administrative compulsory measures according to law in the process of law enforcement. If the traffic police think that the illegal acts found at the scene are minor and have no impact on road traffic and safety, they will verbally inform the basic facts and basis of the illegal acts, give verbal warnings to the offenders, and release them after correcting the illegal acts. The traffic administrative departments of public security organs of all provinces, autonomous regions and municipalities directly under the Central Government may determine the specific scope and implementation measures for applying verbal warnings according to actual conditions. (1) Traffic offenders can handle traffic violations across provinces and different places. In the past, motor vehicle drivers could only deal with off-site traffic violations at the place where traffic violations occurred or where motor vehicles were registered. From May 1, in Hunan, Guangxi, Sichuan, Guizhou and Yunnan, and nationwide at the end of June, if motor vehicle drivers have no objection to the facts of traffic violations, they can choose to deal with them in any local public security traffic control department outside the place where the violations occurred, and impose administrative penalties according to the punishment standards of the places where the violations occurred. (II) Further clarifying the requirements for informing traffic violations In order to improve the rate and timeliness of informing traffic violations, from May 1 day, the public security traffic control department will complete the information review and input within five days after the traffic technical monitoring equipment records the illegal acts, and provide inquiries to the society the day after the input. The public security traffic control department will also inform the owner or manager of the motor vehicle through SMS and mobile Internet applications. When the traffic police are on duty to enforce the law, they will also inform the parties on the spot if they find that the motor vehicle has traffic violations that have not been handled within the time limit. (III) Increase the procedures for electronic service and announcement service. On the basis of the original direct service, the public security traffic control department will serve legal documents by mail, electronic service and announcement service to ensure that legal documents are delivered in accordance with the law, in a timely, standardized and effective manner. Among them, electronic delivery includes mobile Internet applications, e-mail, mobile communication and so on. (4) The procedures for handling traffic violations have been further improved. For off-site traffic violations, after being notified by the public security traffic control department, if the parties fail to take the initiative to accept the treatment, the public security traffic control department will strictly perform the notification procedure according to law and inform the parties of the punishment content and their rights. If the parties fail to raise objections or deal with them in time, the public security traffic control department can directly make a decision on administrative punishment according to law according to the situation. (5) If the traffic violation information recorded by the traffic technology monitoring equipment can determine the actual driver through the implementation of the information transmission system, the traffic control department of the public security may change the traffic violation record from the name of the motor vehicle to the name of the actual driver. This will further promote the effectiveness of the reform measures to facilitate the handling of taxi traffic violations, benefit the majority of taxi drivers, and is expected to save hundreds of millions of yuan in operating costs for rental companies every year. (VI) Standardizing the Reporting System for Traffic Violations Starting from May 1, the traffic control department of the public security can establish a reporting system for traffic violations according to local conditions, so as to further enhance the social governance capacity of road traffic and the level of public participation. If the photos or videos of illegal acts provided by units or individuals are verified to be true, the public security traffic control department can serve as evidence for punishment. In order to maintain good social customs, the public security traffic control department will strictly regulate the scope and procedures of reporting by the masses, severely crack down on malicious reporting according to law, and ensure that the masses report traffic violations with good social effects. Third, road traffic safety violations are aggravated. In order to avoid punishment, some people will try to alter the license plate with a deck of cards, false certificates, or something on the license plate. There is no clear punishment for the former in the old regulations, and only 3 points will be deducted for altering the number plate. In the new regulations, the former directly deducted 12 points, while the latter deducted 6 points.
