1. Determine the compensation base according to the degree of loss of working ability of the dependents and the household registration category of the dependents, that is, the living expenses of the dependents are calculated according to the per capita consumption expenditure standard of urban residents, the dependents are registered in rural areas, and the living expenses of the dependents are calculated according to the per capita annual consumption expenditure standard of rural residents.

2. If the dependant is a minor, it shall be calculated at the age of eighteen.

3. If the dependent has no ability to work and no other source of income, it shall be counted as 20 years.

4.60 years of age or older, the age will be reduced by one year for each additional year.

5.75 years of age or older, calculated by 5 years.

Legal basis: Article 1 179 of the Civil Law of People's Republic of China (PRC) infringes on others and causes personal injury, it shall compensate the reasonable expenses of treatment and rehabilitation such as medical expenses, nursing expenses, transportation expenses, nutrition expenses, hospital food subsidies, and the reduced income due to absenteeism. If it causes disability, it shall also compensate for the cost of assistive devices and disability compensation; If death is caused, funeral expenses and death compensation shall also be paid.
