In addition to statutory holidays, what are the legal vacation systems for workers in China?

Vacation, and paid rest for workers, is the legal rest time for workers to avoid going to work and have wage protection. China's "Labor Law" and related laws and regulations stipulate the following holidays.

(1) legal holidays. Which is stipulated in Article 40 of the Labor Law.

(2) Annual leave. This leave will be explained in article 45 below.

(3) home leave. Family visit leave refers to the statutory leave given to employees whose families are separated from each other to reunite with their parents or spouses within a certain period of time. The provisions on home leave in China's current laws and regulations mainly include the following contents.

First, enjoy the conditions of home leave. Permanent employees who have worked in state organs, people's organizations, enterprises and institutions owned by the whole people for one year, do not live with their spouses, and cannot be reunited on public holidays and holidays can enjoy the treatment of visiting their spouses in these Provisions; If you don't live with your parents and can't get together on public holidays, you can enjoy the treatment of visiting your parents in these Provisions. However, employees who can reunite with their parents or mothers on public holidays cannot enjoy the treatment of visiting their parents in these Provisions.

Second, family leave. There are mainly the following situations:

(a) Employees who visit their spouses should have a family visit leave once a year, with a leave of 30 days.

(two) unmarried workers to visit their parents, once a year in principle, the holiday is 20 days. If due to work needs, the unit can't give holidays in that year, or if employees voluntarily visit relatives once every two years, they can give holidays once every two years, and the holidays are 45 days.

(3) Married employees visit their parents once every four years, with a holiday of 20 days. Visiting relatives holiday refers to the time for employees to reunite with their spouses and parents. In addition, they are given travel leave according to actual needs. The above holidays include public holidays and statutory holidays.

(4) Other holidays. In addition to the above holidays, there are maternity leave for female employees, wedding and funeral leave for employees, etc. With regard to maternity leave for female employees, Article 7 of the Special Provisions on Labor Protection for Female Employees stipulates that female employees enjoy 98 days of maternity leave. With regard to the leave for marriage and funeral, the Provisions on the Leave for Marriage and Funeral for Employees of State-owned Enterprises states that employees who get married or their immediate family members (parents, spouses and children) die may be granted 1 to 3 days' leave as appropriate with the approval of the administrative leader of the unit. Of course, the application of this holiday is limited by specific scope, which is limited to employees of state-owned enterprises.
