Regulations on the Protection and Development of Ethnic Medicine in Qiannan Buyi and Miao Autonomous Prefecture
Chapter I General Provisions Article 1 In order to inherit and carry forward ethnic medicine, protect and give full play to its characteristics and resource advantages, and promote its development, these Regulations are formulated in accordance with the provisions of the People's Republic of China (PRC) Law on Traditional Chinese Medicine, the People's Republic of China (PRC) Drug Administration Law and the Regulations on the Administration of Rural Doctors' Practice. And "Regulations on the Development of Traditional Chinese Medicine in Guizhou Province", combined with the actual situation of the autonomous prefecture. Second units and individuals engaged in ethnic medicine activities within the administrative area of Autonomous Prefecture shall abide by these regulations. Article 3 The national medicine mentioned in these Regulations refers to the traditional medicine of Buyi, Miao, Shui and other ethnic minorities living in the autonomous prefecture. Including:

(1) knowledge of ethnic medicine;

(two) medical skills, technology, equipment and appliances of ethnic medicine;

(3) Prescriptions of ethnic medicine, such as prescription, prescription and secret recipe;

(four) the processing technology of raw materials, medicinal materials, decoction pieces and medicinal materials used in ethnic medicine and the production technology of pharmaceutical preparations;

(five) planting and breeding techniques of medicinal materials for ethnic medicine;

(six) other ethnic medicines recognized by the competent department of traditional Chinese medicine.

The ethnic medical institutions mentioned in these Regulations refer to hospitals, outpatient departments and clinics (rooms) that have obtained the Practice License of Medical Institutions in accordance with the relevant provisions of the Law of People's Republic of China (PRC) on Traditional Chinese Medicine and the Regulations on the Administration of Medical Institutions. Article 4 The protection and development of ethnic medicine should adhere to the principles of combining government guidance with social participation, combining protection with development, and combining inheritance with innovation, follow the laws and characteristics of ethnic medicine itself, give full play to its characteristics and advantages, and promote the development of the theory and practice of ethnic medicine. Article 5 The people's governments at the state and county levels shall incorporate the protection and development of ethnic medicine into the national economic and social development plan at the corresponding level, establish and improve the management system of ethnic medicine, and increase the policy inclination and capital investment for the protection and development of ethnic medicine.

State and county departments in charge of traditional Chinese medicine are responsible for the protection, development, utilization, supervision and management of ethnic medicine within their respective jurisdictions.

Other relevant departments shall, in accordance with their respective responsibilities, do a good job in the protection and development of ethnic medicine. Article 6 The people's governments at or above the county level shall set up research institutions for ethnic medicine, use modern scientific methods and technologies to explore, sort out and explain the theories and technologies of ethnic medicine, and improve the clinical application and scientific level of ethnic medicine. Seventh people's governments at or above the county level shall incorporate the common sense of ethnic medicine into health education and popular science education. Article 8 The people's governments at or above the county level shall set up special funds for the protection and development of ethnic medicine to support the scientific research, technological development, transformation and application of scientific research achievements of ethnic medicine, as well as the protection of precious documents and characteristic medical technologies. Units and individuals that have made outstanding contributions to the work of ethnic medicine shall be commended and rewarded in accordance with relevant regulations. Chapter II Protection and Development Article 9 Autonomous Prefecture People's governments shall support the construction of ethnic hospitals, set up ethnic medicine departments in county-level traditional Chinese medicine hospitals, set up ethnic medicine clinics in township hospitals and community health service centers, and encourage village clinics and community health service stations to provide appropriate technical services for ethnic medicine. Tenth people's governments at or above the county level shall support the development of ethnic pharmaceutical enterprises in project declaration, land use and financing; Encourage social forces to set up ethnic medical institutions, invest in ethnic medicine and provide ethnic medical services. Eleventh in accordance with the relevant provisions of the national and provincial medical insurance, and gradually will be obtained in accordance with the law of ethnic medicine diagnosis and treatment services and ethnic medicine and its preparations into the scope of medical insurance reimbursement. Twelfth people's governments at or above the county level shall strengthen the protection of ethnic medicine resources within their respective jurisdictions, and conduct a general survey and registration of ethnic medicine resources and personnel engaged in ethnic medicine. Formulate the protection and development plan of ethnic medicine varieties, strengthen the protection of ethnic medicine provenance, origin, planting, breeding and brand, and collect, sort out, identify and preserve ethnic medicine specimens. Thirteenth ethnic medical institutions and personnel who have obtained the practicing certificate of rural doctors can plant, collect, purchase and process ethnic medicines in accordance with relevant state regulations and use them in corresponding medical activities. Article 14 The collection, storage and processing of ethnic medicinal materials shall conform to the relevant national technical specifications, standards and management regulations.

Protect the traditional processing technology and technology of ethnic medicine pieces, and encourage the use of modern science and technology to carry out research on the processing technology of ethnic medicine pieces. Fifteenth people's governments at or above the county level shall strengthen the quality supervision and management of the whole process of the circulation of ethnic medicinal materials to ensure the quality and safety of ethnic medicinal materials. Support the development of modern circulation system of ethnic medicinal materials, and establish and improve the traceability system and system of ethnic medicinal materials circulation. Article 16 The competent department of traditional Chinese medicine in Autonomous Prefecture shall formulate and improve the quality system of ethnic medicines and the commodity specifications and grades of protected varieties, so as to improve the quality of ethnic medicines. Support the construction of production bases of ethnic medicinal materials and strengthen the rational development and utilization of ethnic medicinal materials resources.

The use of highly toxic and toxic pesticides is prohibited in the process of planting ethnic medicinal materials. Seventeenth people's governments at or above the county level shall strengthen the management and protection of intellectual property rights of ethnic medicine, and guide and support the application for patent of ethnic medicine, geographical indications and the declaration of intangible cultural heritage. Protect the trade secrets, traditional knowledge, unique technology, secret recipe, prescription and unpublished scientific research results of ethnic medicine according to law.
