Measures of Baotou Municipality on the Administration of Social Medical Services
Chapter I General Provisions Article 1 In order to strengthen the supervision and management of social medical services in this Municipality, maintain the normal order of the medical market, and safeguard people's health, these Measures are formulated in accordance with the Regulations on the Administration of Medical Institutions and other relevant provisions, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to private hospitals, private clinics, village clinics, school health centers (rooms) of enterprises and institutions open to the public, hospitals at all levels and medical beauty salons (institutes) within the administrative area of this Municipality. Article 3 Social medical institutions shall implement the policy of putting prevention first and undertake the tasks of primary health care and the tasks stipulated by the administrative department of health. Must abide by the relevant laws, regulations and rules of the state, abide by the operating rules of medical technology, abide by medical ethics, and adhere to civilized medical practice. Article 4 The municipal health administrative department shall be responsible for the supervision and management of social medical services in this Municipality, and the county and district health administrative departments shall be responsible for the supervision and management of social medical services within their respective jurisdictions. Chapter II Conditions for Establishment Article 5 A person who meets one of the following conditions may apply for the establishment of an individual clinic in a town:

(1) Having obtained the graduation certificate of medical specialty in medical colleges and universities, and having been engaged in the professional work in medical institutions for more than five years;

(two) in accordance with the provisions of the relevant laws, regulations and rules of the state, to obtain the certificate of professional title or above certified by the state, and to engage in the professional work in medical institutions for more than five years;

(three) self-study with Chinese medicine, acupuncture, massage, dental implants, bonesetting and other skills, and passed the examination by the municipal public health administrative department. Article 6 To set up village clinics in rural areas, the health administrative department of the autonomous region must organize the examination to obtain the qualification certificate of rural doctors. Article 7 To apply for the establishment of a private hospital, in addition to complying with the provisions of Article 5, there should be no less than 20 regular beds, and each bed should be equipped with at least 0.7 health technicians, at least 3 doctors,/kloc-0 attending doctors, 5 nurses and corresponding medical technicians in pharmacy, inspection and radiation. Medical technology departments should be equipped with pharmacies, laboratories, X-ray rooms and disinfection supply rooms; Other conditions are equipped according to the first-class (or sub-first-class) hospital standards stipulated by the state and the autonomous region. Eighth hospitals and enterprises and institutions off-campus health centers (rooms) open to the public, must meet the following conditions:

(a) the legal representative or person in charge must be the legal representative or person in charge of the original unit;

(two) the unit has formal medical, pharmaceutical, nursing and technical personnel suitable for the scope of practice, and a certain proportion of full-time medical technical backbone above the attending physician;

(3) Having a scientific management system and operating rules, and having the necessary infrastructure that meets the hygiene requirements;

(four) meet other conditions stipulated by the state and the autonomous region. Article 9 To set up a medical beauty salon (institute), employees must not only meet the requirements of Article 5, but also attend medical beauty classes organized at or above the prefecture level for more than half a year, obtain a certificate of completion, and pass the examination organized by the municipal public health administrative department. Tenth kinds of social medical housing, medical equipment, disinfection facilities, department settings, liquidity and other conditions, according to the relevant provisions of the state and the autonomous region. Eleventh any of the following circumstances, shall not apply for social medical care:

(a) personnel with poor medical style and bad moral character who are not suitable for medical and health work;

(2) Medical personnel who are on the job, resign due to illness, leave without pay or are expelled from public office in state or collective medical institutions;

(3) The elderly, the weak, the sick and the disabled who suffer from mental illness, infectious diseases or are unable to work normally;

(4) It has no official residence in this city;

(five) other circumstances stipulated by laws, regulations and rules. Chapter III Examination and Approval of Establishment Article 12 To apply for various social medical services, the following documents and materials must be submitted:

(1) An application for establishment;

(two) a copy of the graduation certificate or professional title certificate of the employees;

(3) employee physical examination form;

(four) a copy of the employee's household registration book and ID card;

(five) the plan of the medical room, the certificate of property rights or the lease agreement;

(6) List of medical equipment;

(7) capital verification certificate;

(eight) other documents and materials stipulated by the relevant laws, regulations and rules of the state.

Retirees must also submit retirement certificates. Thirteenth health administrative departments at all levels must examine and approve social medical service institutions in strict accordance with the local "Planning for the Establishment of Medical Institutions", and the health administrative department at a higher level has the right to correct or revoke the establishment examination and approval made by the health administrative department at a lower level in accordance with relevant regulations. Article 14 Where an urban area or town applies for setting up a private hospital or clinic, the applicant shall submit an application to the local county health administrative department on the strength of the local urban hukou, and after the county health administrative department has approved it, it shall report it to the municipal health administrative department for examination and approval, and issue the Practice License for Medical Institutions. The establishment of village clinics in rural areas shall be examined and approved by the county and district health administrative departments, and the Practice License of Medical Institutions shall be issued and reported to the municipal health administrative department for the record. In principle, each administrative village has a village clinic, and one can be added for every 2,000 people or more.

Applicants who cross the household registration shall obtain the consent of the health administrative departments of the two places and report to the municipal health administrative department for examination and approval. Fifteenth hospitals and schools (rooms) of enterprises and institutions to be opened to the outside world that apply for additional medical points outside the hospital must submit written applications to the municipal and district health administrative departments. The medical points outside the hospital shall be audited by the health administrative department of Qixian District and reported to the municipal health administrative department for examination and approval. Health centers (rooms) open to the public must be audited by the county and district health administrative departments, and go through the relevant examination and approval procedures at the municipal health administrative department.
