Illegal. According to the Regulations on the Administration of Public Security, only state security organs and other state security departments can conduct body searches and searches with approval. In view of the phenomenon that security guards take advantage of their work to commit crimes from time to time, Article 24 of the Regulations on the Administration of Security Services (Draft) promulgated by the Legislative Affairs Office of the State Council stipulates that security guards shall not commit seven acts, such as restricting others' personal freedom and illegally searching others' bodies.

The draft clearly stipulates that security guards shall not commit the following seven acts:

(1) restricting the personal freedom of others and illegally searching others' bodies;

(2) Insulting, beating or instigating others to beat;

(three) seizure, confiscation of other people's documents and property;

(4) Obstructing the execution of official duties according to law;

(5) recourse for debts and settlement of disputes by means of violence or threat of violence;

(6) Infringement of citizens' privacy or disclosure of confidential information;

(seven) other acts in violation of laws and administrative regulations.

Article 33 of the Regulations on the Administration of Security Services (Draft) also stipulates that a security guard who commits one of the following acts shall be reprimanded by the public security organ; Those who violate the administration of public security shall be given administrative penalties for public security according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) restricting the personal freedom of others or searching their bodies;

(2) Insulting, beating or instigating others to beat;

(three) illegal seizure of other people's documents and property;

(4) Obstructing the execution of official duties according to law;

(five) the use of violence or the threat of violence for customers or the unit to recover debts and resolve disputes;

(6) Other illegal and criminal acts.
