Fifth local people's fishery administrative departments at or above the county level shall be responsible for the issuance and management of aquaculture licenses in waters and beaches within their jurisdiction, and the fishery administrative departments at higher levels shall strengthen coordination.
Cross-border aquaculture waters. The issuance of mudflat aquaculture certificates shall be settled through consultation by the local people's fishery administrative departments at or above the county level, and the fishery administrative departments at the next higher level shall strengthen coordination.
Sixth units and individuals engaged in aquaculture activities by using waters and beaches shall apply to the fishery administrative department of the local people's government at or above the county level and submit the following materials:

To apply for the use of collectively owned waters and beaches for aquaculture production, in addition to the above materials, an effective contract for the management of waters and beaches shall be provided.
Article 7 The fishery administrative department of the local people's government at or above the county level shall, according to the application materials submitted by the applicant, conduct on-site reconnaissance with the personnel of the relevant units, confirm the demarcation and verify the relevant information.
Article 8 The local people's fishery administrative departments at or above the county level shall complete the examination and approval within 30 days from the date of receiving the application for the use of water beach aquaculture, and fill in the examination and approval form for those who meet the local aquaculture planning and the relevant provisions of these Measures, submit it to the person with the right to examine and approve, and issue the aquaculture certificate.
If the fishery administrative department considers that the application does not conform to the relevant provisions of the local water beach culture planning and these measures or fails to approve it according to law, it shall inform the applicant in writing within the time limit specified in the preceding paragraph and explain the reasons.
Ninth local people's governments at or above the county level shall follow the principles of fairness, impartiality and openness in issuing breeding certificates, and follow the following priorities:
Fishery producers who need to switch to aquaculture because of the adjustment of local fishery industry structure;
(two) local fishery producers who need to arrange other aquaculture sites because of the adjustment of local aquaculture planning;
Traditional aquaculture fishermen whose aquaculture waters and beaches are adjacent to townships (towns);
Agricultural collective economic organizations adjacent to aquaculture waters and beaches;
5 units and individuals that apply high technology or have specialized technical expertise in aquaculture;
Units and individuals operating on a large scale.
After reasonable arrangements are made for local aquaculture producers, users of waters and beaches with development potential and users who are difficult to determine the applicant's aquaculture waters and beaches in accordance with the provisions of the preceding paragraph may be determined through bidding. The bidding scheme shall be formulated by the fishery administrative department and implemented after being approved by the people's government at the same level.
