Rule number one. Managing or controlling the prostitution of others by means of recruitment, employment, assembly, etc. If the number of prostitutes is more than three, it shall be deemed as "organizing others to engage in prostitution" as stipulated in Article 358 of the Criminal Law.

Whether prostitutes have set up a fixed prostitution place or not, the number and scale of prostitutes do not affect the determination of organizing prostitution.

Article 2 Organizing others to engage in prostitution in any of the following circumstances shall be deemed as "serious circumstances" as stipulated in the first paragraph of Article 358 of the Criminal Law:

(a) The total number of prostitutes exceeds 10;

(two) more than five prostitutes, including minors, pregnant women, mentally retarded people and people suffering from serious sexually transmitted diseases;

(3) Organizing overseas personnel to engage in prostitution in China or organizing domestic personnel to engage in prostitution abroad;

(four) illegal profits of more than one million yuan;

(5) Organizing prostitution and causing self-mutilation, suicide or other serious consequences;

(six) other serious circumstances.

Article 3 Whoever lures, shelters or introduces prostitutes to organize prostitution criminal activities shall be convicted and punished in accordance with the provisions of heavier punishment. However, whoever lures, shelters or introduces others to prostitution instead of organizing others to engage in prostitution shall be convicted separately and punished for several crimes.

Article 4 Whoever knowingly recruits or transports people or acts as bodyguards, thugs or bookkeepers for others commits the crime of organizing prostitution shall be convicted and punished for assisting in organizing prostitution in accordance with the provisions of the fourth paragraph of Article 358 of the Criminal Law, and shall not be punished as an accessory to organizing prostitution.

People who work as cleaners, cashiers, security guards, etc. Those who engage in general service and labor work in clubs, bath centers and other business places with business licenses, only receive normal wages, and do not assist in organizing prostitution activities listed in the preceding paragraph, are not considered as assisting in organizing prostitution.

Article 5 Whoever assists in organizing others to engage in prostitution under any of the following circumstances shall be deemed as "serious" as stipulated in the fourth paragraph of Article 358 of the Criminal Law:

(1) soliciting prostitutes or transporting prostitutes for more than ten people;

(2) Recruiting or transporting more than five minors, pregnant women, mentally retarded persons and persons suffering from serious sexually transmitted diseases;

(3) assisting in organizing overseas personnel to engage in prostitution in China or assisting in organizing domestic personnel to engage in prostitution abroad;

(four) illegal profits of more than five hundred thousand yuan;

(5) Causing self-mutilation, suicide or other serious consequences to the person recruited, transported or organized for prostitution;

(six) other serious circumstances.

Article 6 Forcing others to engage in prostitution under any of the following circumstances shall be deemed as "serious circumstances" as stipulated in the first paragraph of Article 358 of the Criminal Law:

(a) the total number of prostitutes is more than five;

(two) there are more than three prostitutes, including minors, pregnant women, mentally retarded people and people suffering from serious sexually transmitted diseases;

(3) forcing a young girl under the age of fourteen to engage in prostitution;

(4) Causing self-mutilation, suicide or other serious consequences of the forced prostitution;

(five) other serious circumstances.

The perpetrator has both organized prostitution and forced prostitution. In any of the following circumstances, the crime of organized and forced prostitution shall be punished as "serious":

(1) Organizing prostitution or forcing prostitution is one of the "serious circumstances" as stipulated in Article 2 of this Interpretation and the preceding paragraph of this Article;

(2) Prostitutes meet the standard of "serious circumstances" for organizing prostitution as stipulated in Items 1 and 2 of Article 2 of this Interpretation;

(3) The amount of illegal profits reaches the standard of "serious circumstances" for organizing prostitution as stipulated in Item 4 of Article 2 of this Interpretation.
