Article 2 These Measures shall apply to the space under the expressway bridge within the administrative area of this province.
The space under the bridge refers to the space within the vertical projection range of the highway bridge and the land within the red line of the bridge planning.
Space management under the bridge includes space cleaning, site management, greening management, public maintenance and facilities management, public facilities management, pipelines and ancillary facilities management and all behaviors that endanger the safety of the bridge structure.
Article 3 The people's governments of cities and counties (cities, districts) shall be responsible for the management of the space under the bridge of expressways within their respective administrative areas, guide and urge the relevant administrative departments and township (street) governments to perform relevant duties, organize joint inspections and law enforcement work, and ensure that the rational utilization of the space under the bridge of expressways meets the management requirements of safety and fire protection.
Expressway business units should increase investment in the safety of the space under the highway bridge, uniformly plan and install monitoring facilities, safety protection facilities to prevent falling objects from high altitude, drainage facilities under the bridge and other safety guarantee facilities, strengthen daily inspections and monitoring management, and actively cooperate with local governments and relevant administrative departments to do a good job in the management of the space under the highway bridge.
City and county transportation departments and highway management agencies shall strengthen the supervision of the utilization of space under highway bridges, establish and improve the ledger data, and supervise the normal management of space under highway bridges according to law.
Article 4 Under the premise of ensuring the structural integrity and operational safety of the bridge, the space under the bridge shall be used protectively, and the principle of "safety first, overall planning, public welfare first, clear responsibility and territorial priority" shall be followed, and the space under the bridge shall be used reasonably.
The utilization of the space under the bridge should be first used for greening and greenway construction, but also for highway emergency repair, emergency maintenance and maintenance of materials, facilities and equipment parking; Mass sports and fitness places; Small car parking lots, public bicycle stations and other public welfare purposes. In principle, it shall not be used for commercial development.
Article 5 The following acts are prohibited under highway bridges:
(1) Setting up places and facilities for producing, storing and selling inflammable, explosive, toxic and radioactive dangerous goods, or parking (stacking) and loading and unloading dangerous goods.
(two) the establishment of car washing, auto repair, gas, commerce, catering, entertainment, bazaars and other business premises and facilities.
(3) Gas, electric stoves and naked flames used for production, living, residence and use.
(4) Dismantling or damaging bridge ancillary facilities and equipment such as traffic safety, communication, monitoring, charging, power supply, protective structure, water supply and drainage, management houses and drainage ditches without authorization, and other acts of damaging bridge ancillary facilities and equipment.
(five) damage, occupation of all kinds of underground pipelines and related facilities and accessories.
(six) other acts prohibited by laws, regulations, rules and normative documents, such as littering, building, setting up stalls, digging and digging.
Article 6 The protective utilization of the space under the bridge shall not affect the structural integrity and operational safety of the bridge. The construction and management of space facilities under highway bridges shall meet the following requirements:
(a) the use of space facilities under highway bridges shall not affect the safety, inspection, maintenance and use functions of bridges, as well as the requirements of emergency repair and fire fighting.
(2) The utilization design of the space under the highway bridge should be matched with monitoring, lighting, greening, fire protection, traffic safety, signs, markings and safety facilities, and meet the drainage requirements.
(three) used in the parking lot, should be smooth, non-slip, and meet the requirements of drainage intensity. Traffic signs and markings, such as passages, vehicle routes, parking spaces, etc. Are displayed in the venue. (4) When the space under the bridge is used for construction, construction machinery and equipment and temporary deposits (piles of soil) shall not affect the safety of the bridge body and pier (platform).
Article 7 According to the "one county, one plan", the county (city, district) government makes a unified plan for the space under the expressway within its jurisdiction, and organizes relevant departments and experts such as transportation, urban and rural planning, public security and fire control, safety production supervision, land and resources, expressway business units and so on to prepare the rational utilization plan for the space under the expressway, and report it to the functional departments such as municipal transportation, urban and rural planning, public security and fire control, safety production supervision, land and resources.
Without approval, no unit or individual may use the space under the bridge without authorization.
Article 8 Units and individuals who use the space under the bridge shall, according to the utilization plan of the space under the bridge in the county (city, district), sign a tripartite agreement on safety protection with the expressway business unit and the local township government (street) to clarify their rights, responsibilities and obligations. The tripartite agreement shall be reported to the local highway management organization, safety supervision and management and fire public security department for the record.
In the tripartite agreement, it should be clear that the units and individuals using the space under the bridge should set up a publicity board for the use of the space under the bridge to publicize the area, scope, purpose, telephone number of the responsible unit and the supervision department.
Ninth daily management in accordance with the principle of "whoever uses it is responsible", the units and individuals who use the space under the bridge are responsible for the maintenance and maintenance, and perform order management. The use of the space under the bridge shall not be changed without authorization or transferred to a third party in any form.
Article 10 Where it is necessary to use the space under the bridge due to the new construction, reconstruction, expansion, large and medium-sized repair and maintenance of the highway, the expressway business unit shall take back the right to use the space under the bridge, and the units and individuals using the space under the bridge shall vacate unconditionally.
Eleventh of the unused space under the bridge, highway business units should set up guardrails, planting green, or closed isolation, strengthen inspection. Highway management agencies shall strictly supervise and urge highway business units to do a good job in highway bridge protection.
Article 12 The use and management of space under provincial roads and bridges in ordinary countries shall be implemented with reference to these measures.
