The Opinions of the Central Committee of the State Council on Promoting the Development of Disabled Persons (Zhongfa [2008] No.7) clearly requires that the social security system for disabled persons should be improved, the construction of service system for disabled persons should be strengthened, the gap between the living conditions of disabled persons and the average social level should be narrowed, and the cause of disabled persons and economic and social development should be coordinated. In order to further implement the requirements of the CPC Central Committee and the State Council and accelerate the construction of social security system and service system for the disabled (hereinafter referred to as "two systems"), we hereby put forward the following guiding opinions.
I. Significance, Guiding Principles and Objectives and Tasks
(1) meaning. There are more than 83 million disabled people in China, which directly affects 260 million family members. Since the reform and opening up, the situation of social security and services for the disabled has improved significantly, but there are still problems such as incomplete system, narrow coverage, great difference between urban and rural areas, insufficient investment, lack of service facilities and professionals, and it is difficult to effectively solve the most concerned, direct and realistic special difficulties and basic needs of the disabled. Disabled people are a large number of social groups with outstanding characteristics and special difficulties, and they are the key groups of social security and public services. Promoting the construction of "two systems" for the disabled is the core content of Zhong Fa [2008] No.7 document, an inevitable requirement for studying and practicing Scientific Outlook on Development, safeguarding social fairness and justice, safeguarding and improving people's livelihood, and promoting coordinated economic and social development, and a fundamental measure to help the disabled improve their basic living conditions, promote all-round development, and realize sharing the fruits of reform and development. At present, the state is accelerating the construction of a social security system covering urban and rural residents and the equalization of basic public services. All regions and relevant departments should fully understand the significance of the construction of the "two systems" for the disabled, earnestly enhance their sense of responsibility and urgency, regard the construction of the "two systems" for the disabled as an important and urgent task of building a well-off society in an all-round way and building a harmonious socialist society, bring it into the overall situation of economic and social development, increase investment, speed up construction, and strive for practical results.
(2) guiding principles. Adhere to the people-oriented principle and promote the all-round development of the disabled; Adhere to the construction of the "two systems" for the disabled to adapt to the level of economic and social development, and ensure basic, wide coverage, multi-level and sustainable; Adhere to the "two systems" for the disabled into the overall national social security and public service system, and give priority to development; Adhere to the combination of government leadership and social participation, the combination of key protection and special assistance, and the combination of general institutional arrangements and special institutional arrangements; Adhere to overall consideration and combine solving current outstanding problems with improving the system; Adhere to resource sharing and fully rely on the existing public service system and security system to serve the disabled; Adhere to classified guidance and promote the balanced development of urban and rural areas; Strengthen theoretical research on social security and service policies for the disabled, establish and improve laws, regulations and basic systems, and build a long-term mechanism for the construction of the "two systems" for the disabled.
(3) mission objectives. By 20 15, the basic framework of "two systems" for the disabled will be established, so that the basic needs of the disabled such as basic living, medical care, rehabilitation, education and employment will be systematically guaranteed and their living conditions will be further improved. By 2020, the "two systems" for disabled people will be more complete, the level of protection and service capacity will be greatly improved, disabled people will be able to get basic public services, everyone will enjoy basic living security, everyone will enjoy basic medical security and rehabilitation services, disabled children and adolescents will be fully educated, their cultural and educational level will be significantly improved, their employment will be more adequate, and their participation in society will be more extensive, reaching a well-off level as a whole.
Two, improve the social security system for the disabled, improve the level of social security for the disabled.
We will improve the social security system for the disabled, include them in the social security system covering urban and rural residents, give key protection and special help, study and formulate social security policies and measures aimed at the special difficulties and needs of the disabled, expand the coverage of social security for the disabled, and improve the social security benefits for the disabled.
(1) Strengthen social assistance for the disabled. As far as possible, the disabled people who meet the urban and rural minimum living conditions will be guaranteed, and severely disabled adults who rely on their parents or brothers and sisters to establish separate accounts will be included in the minimum living standard according to regulations; For families with disabilities who still have special difficulties after enjoying the minimum living guarantee, other measures should be taken to ensure their basic livelihood; Give temporary assistance to families with special difficulties such as multiple disabilities, integration of the elderly and the disabled, and families with low-income disabled people; Give timely assistance and proper placement to the disabled without vagrants and beggars in urban and rural areas; Incorporate eligible urban and rural poor disabled people into the scope of medical assistance and gradually improve the standard of assistance; Carry out rehabilitation assistance for poor disabled people.
Incorporate low-income families with housing difficulties into urban housing security and urban and rural housing assistance systems. Give priority to eligible families with disabilities, such as affordable housing in cities and towns and renovation plans for dilapidated houses in rural areas. Families of persons with disabilities who meet the requirements of urban low-rent housing security should be guaranteed as much as possible, and priority should be given to low-rent housing in kind. Priority will be given to the inclusion of poor disabled families in rural areas in the scope of housing subsidies, and resources will be integrated to accelerate the implementation of the renovation project of dilapidated houses for poor disabled families in rural areas.
Full implementation of free compulsory education for disabled students, full-time disabled students in ordinary colleges and universities, children from disabled families and students with financial difficulties in families, and disabled students in the first and second grades of secondary vocational schools should all enjoy state grants; Disabled students attending vocational high schools in special education schools should also enjoy state grants; Gradually implement free secondary vocational education for the disabled.
(two) the implementation of social insurance subsidies and various treatments for the disabled. Government subsidies will be given to eligible poor disabled people who participate in social insurance according to regulations. Encourage urban disabled workers to participate in basic pension, medical care, work injury, unemployment and maternity insurance according to regulations. In accordance with the provisions, we will implement the policy of subsidies for social insurance for the disabled and subsidies for self-employed urban poor disabled people to pay basic old-age insurance premiums, and implement government subsidies for poor disabled people to participate in urban residents' basic medical insurance, new rural cooperative medical care and rural severely disabled people to participate in new rural social old-age insurance. For all kinds of enterprises to recruit qualified disabled people with employment difficulties, subsidies for basic old-age insurance, basic medical insurance and unemployment insurance are given according to regulations; Support qualified enterprises to handle supplementary old-age insurance and supplementary medical insurance for disabled employees. Gradually bring eligible rehabilitation medical projects for the disabled into the scope of basic medical insurance payment, and steadily improve the level of treatment; Gradually increase the occupational rehabilitation items of industrial injury insurance.
(3) Strive to improve the social welfare level of the disabled. Gradually improve the level of life assistance for low-income disabled people; Where conditions permit, government subsidies will be given to severely disabled people to adapt basic assistive devices, barrier-free construction and transformation of disabled people's home environment, day care, nursing and home services. All eligible disabled people will be included in the scope of support, and the support conditions and level will be improved. Implement a comprehensive welfare policy for orphans and disabled children, and support parenting, rehabilitation, education, employment and housing; Support the free rescue rehabilitation of disabled children aged 0-6. Improve the infrastructure conditions of mental patient welfare institutions. Implement the personal income tax reduction and exemption policy for the disabled. For disabled persons with no or limited capacity for civil conduct, property trust and other protective measures shall be implemented. Do a good job in the special care and resettlement of disabled soldiers.
Three, strengthen the construction of service system for the disabled, improve the ability and level of service for the disabled.
Strengthen the planning and system construction of the service system for the disabled, effectively integrate resources from all parties, and make overall plans for the development of special services for the disabled such as rehabilitation, education, employment, poverty alleviation, foster care, accessibility, culture and sports, and rights protection, and continuously expand the coverage of services for the disabled. Formulate and improve the standards for the construction, service, technology and performance evaluation of service institutions for the disabled, improve the industry management system and evaluation mechanism, promote the standardization and specialization of the service system for the disabled, and comprehensively improve the ability and level of service for the disabled.
(a) improve the social rehabilitation service network, and gradually realize the rehabilitation services for all disabled people. With professional rehabilitation institutions as the backbone, communities as the foundation and families as the support, medical institutions, urban community health service centers, village clinics, special education institutions, centralized employment units for the disabled and welfare institutions for the disabled will be brought into play to form a socialized rehabilitation service system for the disabled, and comprehensive rehabilitation services such as rehabilitation medical treatment, functional training, assistive devices adaptation, psychological consultation, rehabilitation referral, disability prevention, knowledge popularization and consultation will be carried out.
Strengthen the construction of professional rehabilitation institutions at the provincial, city and county levels. Provincial and municipal professional rehabilitation institutions will be built into demonstration windows, technical resource centers and talent training bases for local disabled people's rehabilitation work, and county-level rehabilitation institutions will carry out rehabilitation services and community rehabilitation guidance needed by disabled people. County comprehensive service institutions for the disabled who have not established professional rehabilitation institutions should enrich the functions of rehabilitation services, improve their service capabilities, and play a leading role in urban and rural community rehabilitation. Vigorously carry out community rehabilitation, urban community health service centers and township hospitals should set up rehabilitation rooms according to the needs of rehabilitation services, and carry out rehabilitation training, family beds, referral follow-up, relatives training and health education. Conditional general hospitals above the second level should set up rehabilitation medicine departments to carry out rehabilitation treatment and training, personnel training, technical guidance and clinical research. Formulate and improve professional rehabilitation institutions and rehabilitation technical standards in language training for deaf children, rehabilitation training for children with cerebral palsy, mental retardation and autism, and adaptation of assistive devices, promote the standardization of rehabilitation institutions, and improve the pertinence and effectiveness of rehabilitation services.
(two) improve the education service system for the disabled, and constantly improve the education level of the disabled. Implement the Regulations on Education for the Disabled and improve the compulsory education system for disabled children and adolescents with special education schools as the backbone, regular classes and special education classes as the main body; Incorporate the work of studying in regular classes into the performance salary assessment of teachers, and establish and improve the support and guarantee system for children and adolescents with disabilities. Implement compulsory education for children and adolescents with severe physical disability, severe intellectual disability, autism, cerebral palsy and multiple disabilities in various forms such as community education and sending teachers to their homes; Where conditions permit, rehabilitation education schools can be established to recruit severely disabled children and adolescents. Relying on all kinds of rehabilitation institutions, welfare institutions and preschool education institutions for disabled children, we will carry out early preschool intervention, early education and rehabilitation for disabled children, and do a good job in the transfer service for disabled children to receive compulsory education. Relying on all kinds of education and training, cultural services and centralized employment institutions for the disabled, we will vigorously eliminate illiteracy among disabled teenagers.
Accelerate the development of high school education with vocational education as the main body. Conditional cities with districts and special education schools hold senior high school education for the disabled. Strengthen the construction of secondary vocational schools for the disabled and higher special education colleges (majors), broaden the specialty settings, expand the enrollment scale, and improve the quality of running schools. Promote the joint running of special education schools and vocational schools, and promote the sharing of resources such as vocational education and training and training bases. Encourage all kinds of special education schools (hospitals), vocational schools and other education and training institutions to carry out multi-level vocational education and training for the disabled, and establish a mechanism linking vocational training subsidies for the disabled with training quality and one-time employment rate.
Rationally allocate special education resources, strengthen special education research, strengthen special education teacher training, speed up the informatization construction of special education, promote the reform and innovation of special education courses, and continuously improve the quality and level of special education. Strengthen the planning and construction of special education schools and improve the conditions for running schools. Give full play to the role of special education schools in regular classes for disabled children and adolescents, community education, parent training, and selection of itinerant teachers.
(three) to establish and improve the employment service network for the disabled, and promote the stable employment of the disabled. We will implement the Regulations on the Employment of Disabled Persons, implement policies to promote and guarantee the employment of disabled persons, such as proportional employment of disabled persons, tax incentives for units that resettle disabled persons, individual employment support for disabled persons, and the government's priority in purchasing products or services from employers that use disabled persons intensively, and improve policies such as the collection, use and management of employment security funds for disabled persons. Public welfare posts developed by the government shall be placed for qualified disabled persons in accordance with regulations; The employing unit shall sign a labor contract or service agreement with disabled employees according to law, provide working conditions and labor protection suitable for their physical conditions, and shall not discriminate against disabled people in terms of promotion, promotion, job title evaluation, labor remuneration, social insurance and welfare benefits. Properly resolve the labor disputes of the disabled, safeguard the employment rights of the disabled in accordance with the law, and effectively ensure that the disabled enjoy equal employment opportunities.
Employment service institutions for the disabled are an important part of public employment service institutions. Strengthen the construction of employment service institutions for the disabled at the provincial, city and county levels, incorporate them into the overall management of the public employment service system, comprehensively manage the employment of the disabled under the guidance and entrustment of the human resources and social security departments, provide supporting services such as employment information release for employers, and provide employment services such as vocational guidance, employment introduction, occupational adaptability assessment, employment and unemployment registration for the disabled; Carry out management guidance and services for blind massage; Guidance and support for mental, intellectual and severely disabled persons to assist in employment. Strengthen the identification of vocational skills of disabled people. Carry out the standardization construction of employment service institutions for the disabled with unified service objects, unified business processes, unified organization identification, unified personnel standards and unified service standards. Public employment service agencies set up service windows and service points for the disabled to provide employment services and employment assistance for the disabled free of charge. The human resources market information network includes employment information of the disabled, realizing resource sharing.
(4) Strengthening poverty alleviation services for the disabled in rural areas and promoting poverty alleviation for the disabled. Relevant government departments should give support to the poor disabled people in rural areas as the key targets of poverty alleviation and development, rural financial institutions should provide convenient and accessible financial services for the disabled, and farmers' professional cooperatives and various agricultural and rural social service organizations should strengthen their assistance to the disabled. Give full play to the role of county and township service institutions for the disabled, rely on relevant government departments, rural financial institutions, farmers' professional cooperatives and various agricultural and rural social service organizations, support rural disabled people to engage in various forms of productive labor such as planting, breeding, handicrafts, family sideline, provide pre-natal, mid-natal and post-natal supporting services, help rural disabled people obtain discount loans for poverty alleviation, ensure that rural disabled people fully enjoy various policies for benefiting farmers and social security, and promote the effective connection between poverty alleviation and development policies for disabled people and various social security policies.
(5) Improve the care service system for the disabled and vigorously develop home services for the disabled. Establish and improve the care service system for the disabled, take the care service institutions in provincial or provincial capitals as the model, take the care service institutions in cities with districts and counties with conditions as the backbone, take the day care services in towns (streets) and communities as the main body, and provide services such as life care, vocational rehabilitation, auxiliary employment and industrial treatment, agricultural treatment, culture and sports, psychological consultation and entertainment for the mentally and intellectually disabled and other severely disabled people based on home care services. Provincial foster care service institutions are responsible for the service demonstration, business guidance and training of foster care in the province; City and county foster care service institutions with districts provide basic and urgently needed foster care services for the disabled, and guide day care and home care services. Towns (streets) and communities rely on community service facilities and welfare institutions to provide day care and other services to support the disabled in various forms. Implement the "Sunshine Home" plan.
(6) Accelerate barrier-free construction to facilitate the life of the disabled. Strengthen the construction and management of barrier-free facilities and improve the quality of barrier-free facilities. The housing and urban-rural construction department revised and improved relevant standards and norms for accessibility, and accelerated the construction and transformation of barrier-free facilities in urban roads, public buildings, residential buildings, residential areas and parks. Education, civil affairs, railways, transportation, disabled persons' federations and other departments shall formulate and improve the barrier-free standards for special education schools, welfare institutions, comprehensive service facilities for the disabled, railway passenger stations, docks, urban transportation facilities, passenger terminal areas of civil airports and other industries and supervise their implementation. Public transportation will gradually improve barrier-free equipment.
Promote the barrier-free construction of information exchange and raise the barrier-free awareness of the whole society. Relevant departments should incorporate the accessibility of information exchange into the information construction plan, formulate technical standards for information accessibility, and promote the research and development of practical technologies and products for information accessibility such as the Internet, mobile phones and computers. Government information disclosure should take information barrier-free measures, and public service institutions should provide barrier-free services such as voice, text prompt, Braille and sign language. The digital construction of books and audio-visual resources should realize information accessibility.
(seven) the development of cultural and sports services for the disabled, enrich the spiritual and cultural life of the disabled. Encourage disabled people to participate extensively in grassroots cultural and sports activities. Special education schools, special associations for the disabled and community organizations for the disabled should actively carry out mass cultural and sports activities for the disabled. Government key cultural and sports projects such as * * * cultural information resources sharing, mobile stage car, national fitness and so on should have services for the disabled. Strengthen the construction of cultural and artistic organizations and groups for disabled people at all levels, and encourage disabled people to participate in cultural and artistic creation.
Public cultural and sports facilities such as libraries, museums, stadiums, mass art museums, cultural centers, township comprehensive cultural stations and community cultural stations (street cultural stations) are open to the disabled free of charge, providing convenience for disabled people to participate in cultural and sports activities; Conditional public libraries should set up braille reading rooms and audio reading rooms for the blind. Strengthen the publication of Braille and the construction of cultural informatization, and increase support for the publication of Braille, audio books for the blind, books on the theme of the disabled and audio-visual products. Local radio and television stations actively create conditions to provide special programs and sign language programs for the disabled, and film and television works and programs should be accompanied by subtitles.
(eight) improve the legal service system for the disabled and safeguard the legitimate rights and interests of the disabled. Establish a legal aid system for the disabled, which is mainly based on legal services and legal aid provided by judicial administrative departments and legal aid institutions at all levels, supplemented by legal aid provided by relevant departments, disabled persons' federations and social forces. Establish a coordination mechanism for legal aid for disabled people at all levels, give full play to the role of legal aid workstations of disabled people's federations at or above the county level, and encourage and support non-governmental organizations and institutions of higher learning to provide legal aid services for disabled people through various forms. Further improve the working mechanism of letters and visits for the disabled, unblock the channels of letters and visits, and improve the supervision and supervision of letters and visits and the emergency mechanism for sudden mass incidents. Incorporate the Law of the People's Republic of China on the Protection of Disabled Persons and other laws and regulations into the national law popularization plan, and constantly enhance the awareness of the whole society to safeguard the rights and interests of disabled people.
We will build a basic information management system for the disabled population and an information management platform for social security and services for the disabled, and realize data exchange and resource sharing with the information management platform for social security and public services. Strengthen the statistics of social security and services for the disabled, and dynamically monitor and investigate the basic situation of the disabled. Build, expand and rebuild a number of backbone service facilities, so that the layout of service facilities for the disabled is reasonable, the conditions are improved and the service capacity is enhanced.
Four, establish and improve the social security system and service system for the disabled.
(1) Strengthen organizational leadership. Local governments at all levels should incorporate the construction of "two systems" for the disabled into the overall plan of local national economic and social development, relevant special plans and annual plans, all relevant departments and units should incorporate the construction of "two systems" for the disabled into the scope of their duties and target management, and government disabled persons' federations at all levels should strengthen overall coordination, supervision and inspection. Grass-roots organizations in urban and rural areas should play a basic role in the construction of the "two systems" for the disabled, incorporate social security and services for the disabled into community construction plans, do a good job in the implementation of various policies and measures, ensure that key points are highlighted in the western region, and give priority to solving the urgent needs of the disabled such as basic living, schooling and medical treatment; The central region should speed up development and narrow the gap between social security and services for the disabled and the average level of society; The eastern region should be built in an all-round way, strive to adapt the ability and level of security and services to the needs of the disabled, and take the lead in realizing the institutionalization, specialization and standardization of social security and services for the disabled. In accordance with the requirements of urban-rural integration, improve the rural disabled security system and service facilities, and accelerate the integration of social security and equalization of services for urban and rural disabled people.
(2) Improve policies and regulations. Establish a stable fund guarantee mechanism, and raise funds for social security and public services for the disabled through various channels such as financial budget arrangements at all levels, social donations and personal and unit burdens, in which financial input will gradually increase with the development of the national economy and the growth of fiscal revenue; Increase the lottery public welfare fund's support for the construction of the "two systems" for the disabled. Incorporate the construction of professional service facilities such as rehabilitation, education, employment, foster care, culture and sports, and comprehensive services for the disabled into urban and rural public welfare construction projects, give priority to project establishment, planning, and land use for construction, increase investment, and give priority support to the central and western regions and rural areas. Encourage all kinds of non-governmental organizations, enterprises, individuals and social capital to participate in the development of the service industry for the disabled, and give support in terms of funds, venues and talents. Vigorously develop charity for the disabled.
Accelerate the training of professionals in rehabilitation, education, employment, foster care, culture, sports and social work. For the disabled, and will be included in the national education and personnel training plan, encourage colleges and universities to offer related courses. In accordance with the relevant provisions of the state, the implementation of preferential wage policies for disabled people. Support and encourage universities, research institutes, enterprises and institutions to research, develop, popularize and apply assistive technologies and products for the disabled through national science and technology support programs, natural science funds and philosophy and social science funds. Formulate policies to encourage and support the development of assistive devices and other related industries.
Study and formulate regulations on barrier-free construction, regulations on disability prevention and rehabilitation of disabled people, regulations on social welfare, special labor rights and employment protection of disabled people, formulate national classification standards and supporting measures for disabled people, and revise regulations on education for disabled people.
(3) Strengthen publicity and guidance. Mobilize all kinds of propaganda resources, use all kinds of propaganda methods, vigorously publicize the great importance attached by the CPC Central Committee and the State Council to promoting the cause of the disabled, publicize the great significance, policies and measures, advanced models, new experiences and new achievements of accelerating the construction of the "two systems" for the disabled, and create a good public opinion atmosphere. Vigorously carry forward the humanitarian thought and the traditional virtues of the Chinese nation, carry out various activities to help the disabled, establish a stable volunteer team, and cultivate good social customs.
(4) Give full play to the role of disabled people's organizations. Entrusted by the government, disabled persons' federations at all levels undertake and manage services such as rehabilitation, employment, vocational education and foster care for the disabled, do a good job in disability assessment, identification and issuance of the second-generation disabled card, grasp the basic situation and data of social security and services for the disabled, actively reflect the special difficulties and needs of the disabled to the government, and assist the government in formulating relevant policies, regulations, planning and industry management. Give full play to the representative, service and rights protection functions of special associations for the disabled. Township (street), community (village) organizations for the disabled and full-time members of associations for the disabled shall carry out in-depth investigations, establish files on the needs and security of the disabled, do a good job in the needs analysis and referral services for the disabled, and promote the implementation of various social security and service measures.
