Matters not specified in these Regulations shall be governed by relevant laws and regulations. Article 3 The protection and management of drinking water sources in Luhun Reservoir shall follow the principles of unified planning, prevention first, source control, comprehensive prevention and control, whoever damages shall be responsible and ensure safety. Article 4 The Municipal People's Government and the people's governments of Songxian County and Luanchuan County shall incorporate the protection of drinking water sources in Luhun Reservoir into the local national economic and social development plan, and establish a joint coordination mechanism for the protection and management of drinking water sources in reservoirs.
The township (town) people's government in the drinking water source protection area of Luhun Reservoir is responsible for the protection of drinking water sources in the reservoir within its jurisdiction according to its management authority.
The village (neighborhood) committees in the drinking water source protection area of Luhun Reservoir shall do a good job in protecting the drinking water source of the reservoir according to the requirements of the local people's government. Article 5 The relevant departments of the Municipal People's Government and the people's governments of Songxian County and Luanchuan County shall, in accordance with their duties, do the following work within the scope of protection of drinking water sources in Luhun Reservoir:
(a) the competent department of ecological environment shall implement unified supervision and management on the prevention and control of drinking water source pollution in Luhun Reservoir;
(two) the water conservancy department to supervise and manage the drinking water resources of Luhun Reservoir;
(3) The natural resources and planning department is responsible for the examination and approval of land and mineral resources exploitation for the construction project of Luhun Reservoir drinking water source protection area and the supervision and management of land use;
(four) the agricultural and rural departments are responsible for the guidance and services for the prevention and control of agricultural non-point source pollution and the comprehensive utilization of livestock and poultry manure in the drinking water source area of Luhun Reservoir;
(five) the forestry department is responsible for the planning, construction and management of water conservation forest and bank protection forest in the drinking water source area of Luhun Reservoir and the implementation of the policy of returning farmland to forests.
Development and reform, public security, health, housing and urban construction, transportation, culture and tourism, urban management and other relevant departments shall, according to their respective responsibilities, do a good job in the protection and management of drinking water sources in reservoirs. Sixth Luhun Reservoir Management Agency in Henan Province is responsible for the daily management of the reservoir and performs the following duties:
(a) to publicize and implement the laws and regulations on the protection of reservoir water quality;
(two) to participate in the audit of the construction project of the reservoir drinking water source protection area;
(three) to conduct daily inspections and management of reservoirs within its management scope;
(four) responsible for cleaning up the sediment at the bottom of the reservoir, salvaging and handling garbage, branches, weeds and other floating objects;
(five) to assist the municipal and county people's governments and relevant departments to protect drinking water sources according to law. Article 7 The Municipal People's Government shall establish an investment and compensation mechanism for the protection of drinking water sources in Luhun Reservoir, incorporate the funds for the protection of drinking water sources into the fiscal budget at the corresponding level, and set up special funds for water conservation forests, soil and water conservation forests and comprehensive environmental management. The specific input and compensation methods, scope, objects and standards shall be formulated by the Municipal People's Government in accordance with the relevant provisions.
The people's governments of Songxian County and Luanchuan County shall, with reference to the provisions of the Municipal People's Government, establish an investment and compensation mechanism for the protection of drinking water sources in Luhun Reservoir.
Luhun Reservoir Management Agency shall extract a certain proportion of special funds from operating income for the protection of drinking water sources in Luhun Reservoir. Article 8 The Municipal People's Government and the people's governments of Songxian County and Luanchuan County and their news media shall strengthen the publicity and education work on the protection of drinking water sources in Luhun Reservoir, popularize the laws, regulations and scientific knowledge on the protection of drinking water sources, and enhance the public's awareness of the rule of law and protection. Article 9 Any unit or individual has the right to report acts of pollution and destruction of drinking water sources in Luhun Reservoir, and the department that accepts the report shall investigate and deal with them according to law, and protect the lawful rights and interests of informants. Article 10 The competent department of ecological environment of the Municipal People's Government shall, jointly with other relevant departments and the people's governments of Songxian County and Luanchuan County, prepare the overall plan for the ecological environment protection of drinking water sources in Luhun Reservoir, and report it to the Municipal People's Government for approval and promulgation. Eleventh Luhun Reservoir drinking water source protection areas are divided into first-class protection areas and second-class protection areas.
First-class protected area: the water area around the drinking water intake 800 meters, south of the reservoir dam, west of the highway around the reservoir and east of the dam tail boundary wall at the intake 800 meters; West of the drainage channel of the power station, north of the dam foundation of the reservoir dam, and within 50 meters east and south of the stilling basin.
Secondary protected areas: waters outside the primary protected areas in the reservoir area; The tourist area of Luhun Reservoir in Northwest China is bounded by the submerged line of 365,438+07.4 m reservoir, the newly-built flood dike is bounded by the entrance of yi river and Gaoduchuan, and the rest is bounded by the roads around the reservoir.
The management of quasi-protected areas of drinking water sources in Luhun Reservoir shall be implemented in accordance with relevant laws and regulations. Twelfth Luhun Reservoir drinking water source protection area adjustment, proposed by the municipal competent department of ecological environment in conjunction with water conservancy, natural resources and planning, health and other relevant departments and Songxian People's government. After the approval of the Municipal People's government, it shall be submitted to the provincial people's government for approval and announced to the public.
The Municipal People's Government and the Songxian People's Government shall set up obvious geographical landmarks and obvious warning signs at the boundary of the drinking water source protection area of Luhun Reservoir. No unit or individual may damage, alter or move the geographical landmarks and warning signs of the protected areas without authorization.
