Announcement No.31of the Standing Committee of Changchun Municipal People's Congress on July 4, 2005 was promulgated and shall come into force on August 6, 2005. )
Article 1 These Provisions are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality in order to strengthen the management of dog breeding, safeguard the health and personal safety of citizens, and maintain the city appearance and environmental sanitation and social public order.
Article 2 This Municipality shall set up a kennel management area. The scope of the dog management area shall be determined by the Municipal People's Government and announced to the public.
Citizens, legal persons or other organizations within the dog management area shall abide by these provisions.
Article 3 This Municipality implements a strict management policy of combining law enforcement by government departments, participation of grass-roots organizations in management, public supervision and self-discipline of dog owners.
Article 4 Dog owners mentioned in these Provisions refer to citizens, legal persons or other organizations that raise dogs in the dog management area.
Article 5 The municipal public security organ is the administrative department in charge of dog management, and is responsible for organizing the implementation of these Provisions.
City industry and commerce, animal husbandry, health, finance, urban management administrative law enforcement and other departments, as well as street offices, Township People's governments shall, in accordance with their respective responsibilities, cooperate in dog management.
Sixth dog registration, inspection and quarantine, immunization system. It is forbidden to keep dogs that have not been registered, verified, quarantined and immunized.
Seventh dog management area allows each household to raise 1 small ornamental dogs. The standards for small ornamental dogs are determined by the Municipal People's Government and announced to the public. Breeding puppies, dog owners should deal with them within 60 days.
It is forbidden to keep strong dogs and large dogs.
Citizens, legal persons or other organizations may raise dogs for scientific research and experiments, dogs for performance and guide dogs with the approval of the municipal public security organs due to special needs.
Military dogs and police dogs are managed according to relevant regulations.
Article 8 An individual raising a dog shall meet the following conditions:
(1) Having a legal identity certificate;
(2) Having full capacity for civil conduct;
(3) Having a fixed residence and living in a single household.
Ninth dog license shall be handled in accordance with the following procedures:
(a) the relevant materials to the municipal public security organs for registration;
(2) Take the dog to the animal epidemic prevention institution designated by the animal husbandry department to carry out free disease inspection on the dog, inject the vaccine, and obtain the Dog Quarantine Immunity Certificate;
(three) with the "dog quarantine immunity certificate" to the municipal public security organs to receive the "dog certificate".
Do not meet the conditions, not to issue a "dog certificate", and explain the reasons in writing.
Tenth "dog certificate" to implement the annual inspection system. Dog owners shall submit valid dog-raising certificates and dog quarantine immunity certificates at the annual inspection.
Eleventh dog owners shall pay management service fees in accordance with the following provisions:
(a) each small ornamental dog in 500 yuan in the first year and 300 yuan every year thereafter;
(2) The first year 1 ,000 yuan for each performance dog, and 500 yuan every year thereafter.
Dogs for scientific research experiments and guide dogs are exempt from management service fees.
Twelfth dog management service fees and fines in violation of the provisions of the unified turned over to the municipal finance department, earmarking. The cost of dog management, quarantine and immunization shall be allocated by the municipal finance department.
Article 13 If a dog breeder transfers his dog, the transferee shall go through the formalities of change with the original Dog Breeding Certificate to the municipal public security organ within 15 days from the date of transfer, and the municipal public security organ shall complete the formalities within 3 days.
Article 14 If the dog-raising license is lost, the dog owner shall apply to the municipal public security organ for a replacement within 15 days from the date of loss, and the municipal public security organ shall go through the formalities within 3 days.
Fifteenth dogs are dead or missing, dog owners should go through the cancellation procedures at the municipal public security organ within 15 days from the date of death or disappearance of dogs.
Dog owners who give up their dogs for some reason shall send the dogs to the dog reception center set up by the municipal public security organ, and go through the cancellation procedures with the municipal public security organ.
Those who have not gone through the cancellation procedures shall not raise dogs again.
Sixteenth dog owners and dog owners shall abide by the following provisions:
(1) Dogs are not allowed to enter markets, shops, restaurants, parks, public green spaces, schools, hospitals, exhibition halls, theaters, stadiums, community public fitness places, playgrounds, waiting rooms (machines) and other public places;
(2) Dogs are not allowed to take public transport other than taxis. When taking a taxi with a dog, the driver's consent should be obtained, and the dog should be put on a muzzle, or put into a dog bag or cage;
(three) when taking the dog out of the house, it should be tied with a leash and led by an adult, and the dog owner should carry a dog license to avoid pedestrians;
(four) when taking the dog out of the house, it should immediately remove the feces excreted by the dog outdoors;
(five) dogs for scientific research and performance should be kept in captivity, and if they need to go out for quarantine, immunization and diagnosis and treatment, they should be put into dog cages or dog bags;
(6) Dog-keeping shall not interfere with the normal life of others, and dog owners shall take effective measures to stop it when barking affects the rest of others;
(seven) regularly inject rabies vaccine for dogs.
Seventeenth dogs suspected of rabies, dog owners should be promptly sent to the dog reception center set up by the municipal public security organs, and quarantine by the animal epidemic prevention agency; Animal epidemic prevention agencies shall take immediate measures to treat dogs with rabies without harm.
Citizens, legal persons or other organizations shall report to the local animal husbandry and health administrative department in a timely manner when they find rabies and other epidemics. The local people's government shall take emergency prevention and control measures according to the epidemic situation.
Article 18 The dog reception center set up by the municipal public security organ is responsible for receiving and handling confiscated dogs, ownerless dogs and abandoned dogs.
Nineteenth dog trading activities should be carried out in the dog trading market established according to law.
Article 20 Whoever holds a dog show or a dog competition shall go through the industrial and commercial registration and relevant formalities according to law and file with the public security organ.
Twenty-first in violation of the provisions of the dog behavior, anyone has the right to criticize, discourage, report to the public security organs, by the public security organs or public security organs to coordinate the relevant departments in a timely manner.
Twenty-second in violation of the provisions of Article 6, the public security organ shall temporarily detain the dog, and ordered the dog owner to go through the registration and verification procedures within 5 days. If it is not handled within the time limit, it shall be handled by the municipal public security organ.
Twenty-third in violation of the provisions of the second paragraph of Article 7 of these regulations, the public security organs shall confiscate their dogs and impose a fine of more than 500 yuan 1000 yuan.
Twenty-fourth in violation of the provisions of the first paragraph, third paragraph, thirteenth and fourteenth of article seventh of these measures, the public security organ shall order it to make corrections within a time limit. If no correction is made within the time limit, it shall be handled by the municipal public security organ.
Twenty-fifth in violation of the provisions of article sixteenth (1), (2), (3), (5) and (6) of these regulations, the public security organ shall give a warning and impose a fine of more than 50 yuan 100 yuan; If the circumstances are serious, the dog license shall be revoked and the dog shall be confiscated.
Twenty-sixth in violation of the provisions of article sixteenth (four), the city administrative law enforcement departments shall be ordered to clear, and impose a fine of 50 yuan.
Twenty-seventh in violation of the provisions of article nineteenth of these regulations, the relevant administrative departments shall confiscate their dogs and impose a fine of more than 50 yuan 100 yuan.
Article 28 When performing official duties, law enforcement officers shall produce their law enforcement certificates and impose administrative penalties in accordance with legal procedures. Dog owners have the right to refuse to show their certificates.
Twenty-ninth refusal or obstruction of law enforcement officers to perform official duties shall be punished by the public security organs according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Thirtieth law enforcement officers who commit one of the following acts shall be given administrative sanctions by their units or higher authorities, and shall be investigated for criminal responsibility according to law if the case constitutes a crime.
(a) do not perform their duties according to law;
(two) the consequences of illegal administration;
(3) Failing to register and verify as required;
(four) the consequences of the report of the masses are not handled in time;
(five) other dereliction of duty, abuse of power, corruption.
Thirty-first these Provisions shall come into force as of August 6, 2005. On June 1 995+February1day, the Regulations of Changchun Municipality on Restricting Dog Breeding was abolished at the same time.
