Management standard of cosmetic label identification

Article 1 In order to further strengthen the supervision and management of cosmetic labels, this Code is formulated in accordance with the Regulations on Cosmetic Hygiene Supervision and the Detailed Rules for the Implementation of the Regulations on Cosmetic Hygiene Supervision and other relevant laws and regulations.

Article 2 This Code is applicable to cosmetics produced and sold in People's Republic of China (PRC). This specification does not apply to cosmetics exclusively for export.

Cosmetic labels as mentioned in this specification refer to words, numbers, symbols, patterns, audio-visual and other materials pasted, connected or printed on cosmetics sales packages and placed in sales packages. Foreign language contents not covered in the label shall comply with the provisions of this specification.

Article 3 The contents of cosmetic labels must be true, scientific and complete. Cosmetic enterprises shall completely label the relevant contents in accordance with the requirements of General Label for Cosmetics in Consumer Product Instructions (GB5296.3), and be responsible for the authenticity, scientificity and completeness of the label contents.

Article 4 The use method, place, purpose and efficacy of cosmetic labels shall conform to the definition of cosmetics. Cosmetics shall not be effectively publicized as "xx cases are effective" or "xx% effective".

Article 5 Cosmetic labels shall clearly and completely identify the relevant license number and approval number. For imported cosmetics for special purposes, it shall be marked with "Wei Zhuang Jin (xxxx)No. xxxx" or "Wei Zhuang Te Jin (xxxx)No. xxxx"; Imported cosmetics for non-special purposes shall be marked with "Wei Zhuang Jin (xxxx)No. xxxx" or "Wei Zhuang Jin Bei Zi (xxxx)No. xxxx"; Domestic cosmetics for special purposes shall be marked with "Wei Zhuang Zi (xxxx)No. xxxx" and the hygiene license number of cosmetics production enterprises (such as "

Products that do not belong to the definition of cosmetics shall not be marked with the hygiene license number of the cosmetics manufacturing enterprise.

Article 6 The contents of cosmetic labels, such as product name, manufacturer's name, name and address of the responsible unit (importer or seller) in China, country of origin (actual country of production), actual domestic place of origin, color, color number, fragrance, sun protection coefficient, function and other information, shall be consistent with the relevant contents stated in the approval document of the product obtaining the corresponding hygiene license, filing certificate and hygiene license of the manufacturer, and with the approval document.

Article 7 Requirements for labeling cosmetic names

(1) The name of cosmetics shall meet the requirements of the Naming Specification for Health-related Products. In principle, names should include trademark names (or brand names), generic names and attribute names.

(2) The name label shall be clear, complete and easy to identify, and shall not be used to confuse, mislead consumers or have other adverse effects. There should be at least one complete name in the label, that is, except the trademark, the words or symbols in the name should use the same font and font size, and there should be no blanks.

(3) Trademarks with exaggerated functions or misleading consumers shall not be used in the names.

(4) Generic names shall be accurate and scientific, and may be words indicating raw materials, main functional components or product functions. When raw materials or functional ingredients are used as common names, they must be those contained in the product formula, except for words such as pearl color, fruit shape and rose shape that are only understood as product color, luster or smell. When a function is used as a common name, it must be the real function of the product.

(five) the name of the attribute should indicate the objective form of the product, and abstract names shall not be used. However, for products whose attributes are known to consumers, the attribute names can be omitted, such as lipstick, rouge, lip gloss, face color, cheek color, hair color, eye color, eye shadow, conditioner, essence, mask, hair mask, blush, nail polish and so on.

(6) Cosmetics of the same series, but different in fragrance and color. If you use the same brand name, common name and attribute name for naming, you must mark it after the product name to show the difference. The name of the hair dyeing product must indicate the dyed color or color number.

Article 8 Identification of sunscreen function of sunscreen cosmetics

(1) If cosmetics claim to have sunscreen function, SPF value must be marked on the label; It can identify UVA protection function, broad-spectrum sun protection function, PFA value or pa++ ~ pa++, waterproof and sweat-proof function or be suitable for outdoor activities such as swimming. All signs of sun protection function must provide effective inspection basis.

(2) The identification of SPF value of sunscreen cosmetics shall meet the following requirements:

1. When the SPF value of the tested product is less than 2, the sunscreen effect shall not be marked.

2. When the SPF value of the inspected product is between 2 and 30 (inclusive), the identification value shall not be higher than the measured value.

3. When the SPF value of the inspected product minus the standard deviation is greater than 30 and less than or equal to 30, only SPF30 can be identified at most.

4. When the SPF value of the inspected product is higher than 30 and still higher than 30 after deducting the standard deviation, it can only be identified as SPF30+ at most.

(3) Identification of PFA value of sunscreen cosmetics shall meet the following requirements:

1. When the integer part of the measured PFA value of the tested product is less than 2, the sunscreen effect of UVA shall not be marked.

2. When the integer part of the measured PFA value of the tested product is between 2 and 3 (inclusive), the integer part of PA+ or PFA measured value can be identified.

3. When the integer part of the measured PFA value of the tested product is between 4 and 7 (inclusive), the integer part of PA++ or PFA measured value can be identified.

4. When the integer part of the measured PFA value of the tested product is greater than or equal to 8, the integer part of PA++ or PFA measured value can be identified.

(four) sunscreen cosmetics that meet one of the following requirements can be labeled with broad-spectrum sunscreen agents:

1.SPF value ≥2, lC≥370nm was determined by cosmetics UVA detector.

2.SPF value ≥2 and PFA value ≥2.

(5) When identifying the waterproof performance, sunscreen cosmetics should identify the SPF value after bathing, and can also identify the SPF value before and after bathing. And in strict accordance with the waterproof test results to identify the waterproof degree:

1. If the SPF value after bathing is more than 50% lower than that before bathing, it shall not be claimed to be waterproof.

Those who pass the water resistance test for 2.40min can claim general water resistance (such as waterproof and sweat-proof function, suitable for outdoor activities such as swimming, etc.). ), and claims that the water resistance time does not exceed 40 minutes.

3. Those who have passed the water resistance test for 80min can claim to have super water resistance, and the claimed water resistance time does not exceed 80min.

Article 9 If the labels of cosmetics are marked with related terms such as "tested by dermatologists or ophthalmologists", "tested for sensitivity", "suitable for sensitive skin" and "free of acne", they must be based on the corresponding test data and/or clinical reports.

Article 10 Information identification of cosmetic products entrusted for processing (including sub-packaging).

(1) Where production and processing are entrusted, the name and address of the entrusting party, the name of the entrusted party and the hygiene license number must be indicated.

(two) does not belong to the commissioned production and processing, but the product owner is different from the actual production and processing enterprises, such as the product owner is the head office, and the actual production and processing enterprises are subordinate enterprises, with reference to the above provisions.

Article 11 about the signs of warning words

(1) Cosmetic labels shall be marked with necessary warning information, such as conditions of use, methods of use, precautions and possible adverse reactions. Cosmetic labels are encouraged to say "This product is allergic to a few people, please stop using it immediately if you feel uncomfortable".

(2) The scope of use and the method of use marked on the cosmetics label shall meet the safety requirements of the raw materials contained therein. For example, some raw materials can only be used in products that are washed off after use or can't touch mucous membranes during use, so the label content of cosmetics containing these raw materials should meet these use restrictions.

(3) If cosmetics contain limited substances, preservatives, ultraviolet absorbers, hair dyes, etc. The current Hygienic Standard for Cosmetics stipulates that the label should be marked with the corresponding use conditions and precautions according to the requirements of the Hygienic Standard for Cosmetics.

(4) The labels of hair care products, hair dyeing products, perming products, deodorizing products, hair removal products and nail hardener must indicate the conditions of use, methods of use and precautions. Hair dyeing cosmetics (except temporary hair dyeing products) must be marked with the following warning words on the label: for some individuals who may cause allergic reactions, skin tests should be carried out in advance according to the instructions; Don't use it to dye eyebrows and eyelashes. If it accidentally gets into eyes, it should be washed immediately. Professional use, should wear appropriate gloves and other related terms.

(5) Hair care, breast enhancement and bodybuilding products must be marked on the label: the efficacy of this product has not been verified by the inspection agency of the Ministry of Health.

(six) the following types of cosmetics should be labeled with corresponding warnings:

1. Pressurized aerosol product: the product shall not impact; Use away from fire sources; The storage environment of products should be dry and ventilated, and the temperature should be lower than 50℃. Avoid direct sunlight and stay away from fire and heat sources. Products should be kept out of the reach of children; Don't pierce the empty cans used up by products and throw them into the fire; Keep a distance from the skin when spraying, avoid the mouth, nose and eyes, and do not use when the skin is damaged, inflamed or itchy.

2. Foam bath products: use according to the instructions; Excessive use or long-term contact will cause irritation to skin and urethra; Stop using when rash, redness or itching occurs; Please keep it out of the reach of children.

Article 12 The functions of cosmetic publicity must be true and scientific, and conform to the functional categories specified in the definition of cosmetics, namely, cleaning, eliminating bad smell, caring skin, beautifying, modifying and special-purpose functions. It is not allowed to imply that the product does not actually have or is not allowed to promote the function by promoting the function of the raw materials used. Ordinary cosmetics may not publicize the functions of special-purpose cosmetics.

Article 13 According to the Regulations on Hygienic Supervision of Cosmetics and other relevant laws and standards, the contents of cosmetics labels shall be true, and there shall be no contents that falsely exaggerate, express or imply the therapeutic effect and effect on diseases, no medical terms shall be used, no consumers shall be misled, no products shall be advertised in the name of "approved by the Ministry of Health" or "specially approved by the Ministry of Health", and no cosmetics approval documents or inspection reports of cosmetics inspection agencies shall be included.

Article 14 Appendices 1 and 2 respectively list the recommended functional declaration clauses and prohibited labeling clauses of cosmetic labels, but are not limited to the listed contents, and the Ministry of Health will supplement them irregularly.

Fifteenth previously issued documents are inconsistent with this specification, this specification shall prevail. The Ministry of Health is responsible for the interpretation of this specification.

Appendix 1: Recommended terms for cosmetic label identification
