In order to accelerate the pilot reform of China (Guangxi) Pilot Free Trade Zone (hereinafter referred to as the Pilot Free Trade Zone), effectively reduce the institutional transaction costs of enterprises, optimize the business environment, and stimulate market vitality and social creativity, according to the Notice of the State Council on Launching the Pilot Reform of the Pilot Free Trade Zone (Guo Fa [2065438+09] No.25, hereinafter referred to as the pilot),
I. Work objectives
On the basis of in-depth summary of the experience of implementing the reform of "separation of licenses" for some business license items related to enterprises in recent years, starting from 20 19 12 1, 544 business-related administrative examination and approval items set at the central level and 1 business-related administrative examination and approval items set at the autonomous region level were directly cancelled in the Pilot Free Trade Zone. Change to filing, informing commitment, optimizing approval and perfecting simple and transparent industry access rules, further expand enterprise autonomy, strengthen supervision after the event, establish inter-departmental information sharing, collaborative supervision and joint reward and punishment mechanisms, form a whole-process supervision system, further create a market-oriented, rule-of-law and international business environment in our region, promote high-level openness and high-quality development in our region, and form replicable and scalable institutional innovations for realizing the full coverage of the national "separation of licenses" reform.
Second, the task
(a) the establishment of a list system, the implementation of reform classification. According to the List of Pilot Items for Full Coverage of License Separation Reform (set at the central level, version 20 19), the List of Pilot Items for Full Coverage of License Separation Reform in Guangxi (version 20 19) (hereinafter referred to as the "List") is formulated, which is expressed in a unified name, clear examination and approval departments and levels, and standardized business scope. There are ***545 items in the list, of which 14 items were cancelled directly, 8 items were put on record for approval, 60 items were informed, and 463 items were optimized for approval service. Outside the list, market entities may not be restricted from entering relevant industries or fields in violation of regulations, and enterprises may operate independently after obtaining business licenses. (two) to formulate management measures and standardize the implementation of examination and approval. The relevant departments of the autonomous region shall, in accordance with the requirements of the Notice and the implementation plan formulated by the relevant departments of the State Council, refine the reform pilot measures such as directly canceling the examination and approval, changing the examination and approval to filing, implementing the notification commitment, and optimizing the examination and approval service, and make them public to ensure the simultaneous implementation of the "separation of licenses" reform in the Pilot Free Trade Zone and the whole country. The Big Data Development Bureau of the autonomous region should set up a "license separation" area on the comprehensive platform of digital government affairs in Guangxi, and provide the "auxiliary inquiry function for enterprise business license handling" to facilitate enterprises to inquire about the enterprise business license corresponding to their business scope, as well as the specific departments, handling procedures, licensing materials, licensing conditions, fees, time limit and other information for handling matters. All relevant departments should, in accordance with the requirements of the pilot work of the full coverage of the reform of "separation of licenses", update the implementation list of reform items in the item management system of Guangxi digital government integration platform in a timely manner, and upload it to the "separation of licenses" area simultaneously, promote the standardization of examination and approval services, and promote the whole process of business license matters involving enterprises from application, acceptance to review and certification, "one-stop operation" and "at most one-time operation". The relevant departments of the autonomous region shall, in accordance with the requirements of "eight unifications" (namely, unified item name, unified item code, unified application basis, unified application materials, unified workflow, unified business handling process, unified handling time limit and unified form content), standardize the implementation list of reform items involved in this system. Each area of the Pilot Free Trade Zone shall establish a "good and bad review" system for examination and approval services, and enterprises shall judge service performance, forming a typical experience that can be replicated and popularized. (3) standardize business scope and strengthen information exchange. Market supervision departments at all levels should accurately identify the enterprises in the Pilot Free Trade Zone, clarify the corresponding relationship between the listed items and the business scope of the business license according to the business scope specification statement issued by the State Administration of Market Supervision, accurately inform the enterprises of the business license matters that need to be handled, and at the same time accurately push the enterprise registration information that needs to be handled by the Guangxi digital government integration platform to the relevant departments of the autonomous region within 1 working day. The Big Data Development Bureau of the autonomous region should upgrade and improve the data sharing and exchange platform, work out the collaborative workflow of the pilot information business with full coverage of the reform of "separation of licenses" in Guangxi, support accurate information push and information collection, strengthen the verification of data transmission, and urge relevant departments to complete data reception and feedback within the specified time. All relevant departments of the autonomous region shall, within five working days after receiving the push data, complete the downward sharing of their own systems, improve the catalogue of information resources collected by government departments related to enterprises, strengthen the information collection work, and ensure that the government information operated by enterprises is centrally shared in Guangxi digital government integration platform, national credit information sharing platform and national enterprise credit information publicity system. All relevant departments at all levels can enjoy the information obtained through information, and are not allowed to ask enterprises to provide it. Where vertical management of business information systems is involved, the relevant departments in each area of the Pilot Free Trade Zone may put forward information requirements, which shall be reported to the relevant state departments for approval by the relevant departments of the autonomous region. (4) Promote the reform of "separation of licenses" and "integration of multiple licenses". The reform-related matters in the list belong to the management of information collection, filing, publicity and future reference according to the mode of "approval changed to filing". In principle, it should be integrated into the business license through the reform of "multiple certificates in one", and the market supervision department will push the registration information to the relevant departments. If filing is really necessary, all relevant departments should simplify the elements of filing, strengthen the enjoyment of information, and facilitate enterprises to handle affairs. After the enterprise is put on record, the relevant departments should implement effective supervision according to law. For enterprises that have not filed or have false filing information, the relevant departments should clarify the regulatory rules, investigate and deal with them according to law and take measures to correct them. (five) comprehensively promote the "double random, open" supervision, to achieve cross-departmental joint spot checks. By the end of 2020, it is necessary to take the lead in realizing the full coverage and normalization of "double random and one open" supervision of relevant departments in the field of market supervision within the scope of the Pilot Free Trade Zone. Nanning City, Qinzhou City and Chongzuo City should strengthen their leadership in the supervision of "double randomness and one openness" within their respective jurisdictions, introduce specific implementation measures, and organize all departments within their respective jurisdictions to jointly carry out the supervision of "double randomness and one openness". It is necessary to integrate all kinds of inspections involving enterprises, rationally allocate and use law enforcement resources, guarantee funds, and reduce the burden of repeated inspections by enterprises. It is necessary to establish a credit record system and a false promise credit repair mechanism, and strive to strengthen the awareness of the first responsible person in the enterprise market order. It is necessary to strengthen credit supervision, investigate and deal with illegal business practices according to law, record the investigation results in the name of enterprises and publicize them to the public, and implement joint punishment for dishonesty. For enterprises and relevant responsible personnel who have seriously violated the law and lost their trust, measures to ban market entry shall be implemented according to law to enhance the deterrent power of supervision. It is necessary to strengthen social supervision, guide social forces to participate in the governance of market order, and gradually build and improve the pattern of diversified governance. Third, the job requirements
(1) Strengthen organizational leadership. Autonomous region to promote the transformation of government functions and "decentralization, strengthen supervision, improve service" reform coordination group is responsible for coordinating the pilot work of "separation of licenses" reform in the whole region. The Big Data Development Bureau of the Autonomous Region, the Market Supervision Bureau and the Justice Department took the lead in coordinating and promoting reform. Each area of the Pilot Free Trade Zone should establish a working mechanism in which the main leaders are responsible, clarify the lead units, strengthen the division of responsibilities, and solidly promote reform.
(2) Clear division of responsibilities. The market supervision bureau of the autonomous region is responsible for implementing the standardized registration of business scope, adjusting the scope of the reform of "multi-certification in one", deepening the supervision of "double randomness and one openness" and joint supervision across departments, and doing a good job in the interpretation, coordination and guidance, summary and evaluation of reform-related policies. The Big Data Development Bureau of the Autonomous Region is responsible for the information transformation of the digital government integration platform in Guangxi, ensuring the accurate push and collection of enterprise-related information, ensuring that the government information operated by enterprises is shared in the national credit information sharing platform and the national enterprise credit information publicity system, and doing a good job in supervising and implementing it. The judicial department of the autonomous region is responsible for the legal protection of local laws, regulations and normative documents involved in the reform. The relevant departments of the autonomous region should take the initiative to claim the task of reform, according to the implementation plan of the reform matters formulated by the relevant departments of the State Council, and formulate and introduce the pilot measures for the reform of this department and this system before February 30, 20 19, and cooperate with the Judicial Department of the autonomous region to promote the revision of the relevant normative documents of this department and this system.
(3) Pay close attention to guidance and implementation. All relevant departments at all levels should grasp the implementation of the pilot task of "separation of licenses" in the spirit of nailing. It is necessary to strengthen the work guidance for all districts in the Pilot Free Trade Zone, fully mobilize the enthusiasm and initiative of all districts to promote reform, and encourage and support creative work in all districts. Outstanding pilot work, give notice of praise; If the pilot work is not promoted effectively, it will be urged to rectify within a time limit. Each area of the Pilot Free Trade Zone shall submit the pilot work to the relevant lead units of the autonomous region before the first month of each quarter 10, and timely improve policies and measures to ensure the effectiveness of the reform work.
(4) Strengthen publicity and training. Relevant departments at all levels should use various propaganda methods to interpret reform policies in various media, improve social awareness, respond to social concerns in a timely manner, consolidate the social mass base of reform, and create a good atmosphere conducive to reform. All relevant departments should strengthen business training, improve the understanding and policy implementation level of the policy documents and related knowledge of the pilot reform of "separation of licenses", improve the efficiency of access services, and ensure the smooth progress of the reform.
