According to Article 40 of China's Consumer Protection Law, consumers or other victims may claim compensation from sellers or producers for personal or property damage caused by commodity defects. Based on the fact that the merchant is the main body that directly provides goods, it should bear direct legal responsibility for the goods that are sold in question.
Article 38 of the E-Commerce Law stipulates that the operators of e-commerce platforms know or should know that the goods sold or services provided by the operators in the platforms do not meet the requirements of protecting personal and property safety, or that there are other acts that infringe upon the legitimate rights and interests of consumers, and if necessary measures are not taken, they shall bear joint liability with the operators in the platforms according to law. Therefore, if the e-commerce platform fails to fulfill its audit obligations in advance and consumers fail to fulfill their regulatory obligations when defending their rights, consumers can also pursue the joint legal responsibility of the platform.
