If the restaurant next door operates without a license, oil smoke pollution will seriously affect normal life. According to Article 83 of the Civil Law, the neighboring parties of real estate should correctly handle the neighboring relations in terms of water interception, transportation, ventilation and lighting in accordance with the principles of being beneficial to production, life, solidarity and mutual assistance, and fairness and reasonableness. If damage or obstruction is caused to the adjacent parties, the infringement shall be stopped, the obstruction removed and the losses compensated. To sum up, the two sides are neighbors of the real estate, and the neighbors tamper with the smoke exhaust method privately and blow the kitchen fumes to their homes. We have the right to file a neighboring right lawsuit, asking our neighbors to stop the infringement, remove the obstruction and compensate for the losses within a reasonable range, that is, to dismantle the smoke exhaust method that affects us and use the original flue of the building without causing any adverse effects to others. We collect evidence of the other party's infringement of neighboring rights, entrust a lawyer to the local real estate management bureau to obtain a copy of the other party's real estate file, affix the official seal of the department file and a copy of our own real estate file, write a complaint and then file a civil lawsuit with the local people's court to safeguard the legitimate rights and interests.
