Provisions of Kunming Municipality on the Administration of Pig Slaughtering
Chapter I General Provisions Article 1 In order to strengthen the management of pig slaughtering, ensure the quality of pig products and protect people's health, these Provisions are formulated in accordance with the Regulations of the State Council Municipality on the Management of Pig Slaughtering and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 The system of slaughtering pigs at designated points, centralized quarantine, unified tax payment and decentralized management shall be implemented. Without a fixed point, no unit or individual may slaughter pigs (except for rural individuals who are autotrophic and self-feeding). Article 3 All units and individuals who slaughter, process, store, transport and sell pigs and pig products within the administrative area of this Municipality shall abide by these provisions. Article 4 The term "pig products" as mentioned in these Provisions refers to the unprocessed carcass, meat, fat, viscera, blood, bone, head, hoof, skin and hair of pigs after slaughter. Article 5 Any unit or individual has the right to report and accuse acts that violate these provisions. Chapter II Responsibilities of Administrative Departments Article 6 The commodity circulation administrative department of Kunming Municipal People's Government is in charge of the supervision and management of pig slaughtering within the administrative area of this Municipality, and its main responsibilities are:

(a) the implementation of national, provincial and municipal laws, regulations, rules and standards on the management of pig slaughtering, and the implementation of daily supervision and management;

(two) responsible for the development of the city's pig slaughtering management target responsibility system and organize the implementation;

(three) to guide the management of pig slaughter in counties (cities);

(four) according to the "Kunming city master plan", in conjunction with the municipal planning administrative department, put forward the planning of the pig slaughtering plant (field) in the main city of this city, and organize the implementation after the approval of the Municipal People's government;

(five) responsible for the qualification examination and the issuance, cancellation and annual inspection of the pig slaughtering plant (field) in the planning area of the main city of this Municipality;

(six) other work responsible for the management of pig slaughtering industry. Article 7 The administrative department of commodity circulation of the county (city) people's government shall be responsible for the management of pig slaughter within its administrative area (excluding the scope of the main urban area of Kunming city planning), and accept the supervision and guidance of the municipal administrative department of commodity circulation. Its duties are:

(a) the implementation of national and provincial and municipal laws, regulations and rules on the management of pig slaughtering, and daily supervision and management;

(II) According to the approved overall planning of counties (cities) and towns, in conjunction with the planning and management departments at the same level, put forward the planning for the establishment of pig slaughtering plants (fields) within their respective administrative areas, organize the implementation after the approval of the people's government at the same level, and report to the commodity circulation administrative department of the Municipal People's Government for the record;

(three) responsible for the administrative area of pig slaughtering plant (field) designated slaughter license issuance, cancellation and annual inspection;

(four) in accordance with the requirements of the Municipal People's government, do a good job in the implementation of the target responsibility system for pig slaughtering management;

(five) responsible for other work in the administrative area of pig slaughtering industry management. Eighth departments of agriculture and animal husbandry, industry and commerce, environmental protection, health, public security, planning and other departments shall, in accordance with the provisions of relevant laws and regulations and their respective responsibilities, do a good job in the supervision and management of pig slaughtering. Chapter III Establishment of Designated Slaughtering Plants (Fields) Article 9 The establishment of a designated slaughtering plant (field) for pigs must meet the following conditions:

(a) must conform to the city planning;

(2) The linear distance from hospitals, schools, kindergartens, residential areas and stations must be above 1000 meters;

(3) It meets the requirements stipulated by the state, and has necessary facilities and special vehicles such as waiting room, slaughter room, emergency slaughter room, isolation room, meat cooling room, meat processing workshop, quarantine inspection room, pig slaughter and pig product sorting and placing, etc. which are suitable for the slaughter scale;

(four) there are water sources that meet the standards prescribed by the state, sufficient light and good ventilation conditions;

(five) the waste water, waste gas, solid waste and noise discharged by slaughtering pigs must meet the environmental protection standards stipulated by the state and local governments;

(six) there are facilities for the harmless treatment of pigs and pig products;

(seven) the necessary inspection equipment, disinfection facilities, disinfection drugs and sewage treatment facilities;

(eight) slaughter technicians who have obtained health certificates and professional training certificates issued by medical institutions at or above the county level according to law;

(9) Having qualified full-time or part-time meat quality inspectors;

(10) Having other epidemic prevention and health conditions that meet the provisions of the Animal Epidemic Prevention Law and the Food Hygiene Law. Tenth drinking water source protection areas, airport clearance, military facilities, power facilities, communication facilities and other protected areas shall not establish pig slaughtering plants (fields). Eleventh new pig slaughtering plant (field) must meet the requirements of scale, factory and mechanization. Twelfth pig slaughtering plants (fields) that have been approved before the promulgation and implementation of these Provisions must be transformed into large-scale, industrialized and mechanized, and those that fail to meet the requirements shall be banned. Article 13 To set up a pig slaughtering plant (field), an application must be submitted to the administrative department of commodity circulation of the people's government of the city, county (city) and district respectively in accordance with the examination and approval authority stipulated in Article 6 and Article 7, and relevant materials shall be attached, which shall be reviewed by the administrative department of commodity circulation in conjunction with the planning and environmental protection departments. After approval, the construction shall be carried out according to the specified requirements. After the completion of the project, it will be checked and accepted by the administrative department in charge of commodity circulation, and a designated slaughter license will be issued. Only after the relevant licenses are handled by the administrative department for industry and commerce can it start business.
