Regulations of Fujian Province on Traditional Chinese Medicine
Chapter I General Provisions Article 1 In order to inherit and carry forward Chinese medicine, safeguard and promote the development of Chinese medicine, build a strong province of Chinese medicine, and safeguard people's health, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Traditional Chinese Medicine and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the development of traditional Chinese medicine and its related supervision and management activities within the administrative area of this province. Article 3 The development of traditional Chinese medicine should follow the law of development of traditional Chinese medicine, adhere to the combination of inheritance and innovation, and maintain and give play to the characteristics and advantages of traditional Chinese medicine.

Adhere to the principle of paying equal attention to Chinese and western medicine, encourage Chinese and western medicine to learn from each other's strengths, coordinate development, give play to their respective advantages, and promote the integration of Chinese and western medicine. Article 4 The local people's governments at or above the county level shall incorporate the cause of Chinese medicine into the national economic and social development plan, establish and improve the management system, service system and guarantee system of Chinese medicine, and make overall plans to promote the high-quality development of Chinese medicine.

The local people's governments at or above the county level shall establish a multi-input mechanism to adapt to the development of Chinese medicine, make overall arrangements for Chinese medicine funds in health investment, incorporate Chinese medicine funds into the fiscal budget, and increase support to ensure that the cause of Chinese medicine is compatible with economic and social development. Fifth local people's governments at or above the county level shall be responsible for the supervision and administration of traditional Chinese medicine within their respective administrative areas.

Other relevant departments of the local people's governments at or above the county level shall be responsible for the work related to the administration of traditional Chinese medicine within the scope of their respective duties. Article 6 The local people's governments at or above the county level shall strengthen the construction of famous hospitals, famous departments, famous doctors and medicines, promote the coordinated development of Chinese medicine and medical care, health care, pension, tourism, culture and other industries, and actively develop ecological agriculture of Chinese medicine. Article 7 The local people's governments at or above the county level shall strengthen the publicity of the cause of traditional Chinese medicine, promote the culture of traditional Chinese medicine through the press and publication, radio, film and television, the Internet and other media, popularize the knowledge of traditional Chinese medicine, and enhance the cultural influence of traditional Chinese medicine.

Chapter II Chinese Medicine Services Article 8 The local people's governments at or above the county level shall strengthen the construction of Chinese medicine service system, incorporate the construction of Chinese medicine medical institutions into the planning of medical institution establishment, rationally set up Chinese medicine medical institutions, support and promote the development of medical institutions with advantages of Chinese medicine, and promote grass-roots medical and health institutions to incorporate Chinese medicine into the contract service of family doctors, so as to provide Chinese medicine services covering the whole people and the whole life cycle.

The land, business premises and medical equipment of traditional Chinese medicine medical institutions shall meet the standards prescribed by the state.

There are no restrictions on the layout and number of Chinese medicine clinics and clinics run by social forces that only provide Chinese medicine services, and there are no restrictions on the planning of medical institutions and regional health development. Article 9 The people's governments at the city and county level divided into districts shall set up public Chinese medicine hospitals.

Non-Chinese medical institutions such as general hospitals, maternal and child health care institutions and qualified specialized hospitals organized by the government should set up Chinese medicine departments.

The local people's governments at or above the county level shall support the construction of regional TCM medical centers, characteristic key hospitals and famous medical halls, and support community health service centers and township hospitals to set up TCM departments or TCM halls and other TCM comprehensive service areas. Tenth Chinese medical institutions run by the government shall not be merged, revoked or changed without authorization.

The merger, cancellation or change of the medical nature of traditional Chinese medicine by the government-sponsored medical institutions of traditional Chinese medicine shall solicit the opinions of the health authorities of the people's government at the next higher level and be re-established in accordance with the planning requirements.

Where the medical institutions of traditional Chinese medicine organized by the people's government at the county level are merged, cancelled or changed, the opinions of the health authorities of the municipal people's government with districts shall be reported to the health authorities of the provincial people's government for the record. Eleventh support social forces to set up Chinese medicine medical institutions and provide multi-level and diversified Chinese medicine services. Chinese medical institutions run by social forces enjoy the same rights as Chinese medical institutions run by the government in terms of access, practice, rating, service purchase, public health, basic medical insurance, scientific research and teaching, professional title evaluation of medical personnel, and continuing education.

Encourage qualified Chinese medicine practitioners to provide Chinese medicine services by setting up Chinese medicine clinics and consulting rooms. Twelfth the establishment of Chinese medical institutions shall be approved according to law, and abide by the relevant provisions of the management of medical institutions.

Where a Chinese medicine clinic is held, the name, address, diagnosis and treatment scope and staffing of the clinic can be filed with the competent health department of the local people's government at the county level before practicing activities can be carried out. Chinese medicine clinics shall publicize the record information such as the scope of diagnosis and treatment, the name of Chinese medicine doctors and their practice scope in the obvious position of the clinic, and shall not carry out medical activities beyond the record scope. Thirteenth Chinese medicine health care institutions shall comply with the relevant provisions of the state.

The registered business scope of enterprises providing TCM health care services shall use the standardized expression of "TCM health care services (non-medical care)", and shall not carry out TCM medical activities, use names with TCM medical characteristics such as "TCM medical treatment" and "TCM treatment", and shall not carry out publicity with TCM medical nature. Fourteenth personnel engaged in medical activities of traditional Chinese medicine should obtain the qualification of traditional Chinese medicine doctor and register for practice according to law.
