Legal analysis: (1) The basic alimony for the elderly can be calculated by setting the per capita consumption expenditure of local residents and the local minimum living standard as the upper and lower limits, and combining with the proportion of the income of the dependents of about 20%. If the amount is higher or lower than the upper and lower limits, the upper or lower limit shall be determined as the maintenance standard.

Maintenance content should also be calculated according to the corresponding expenditure invoice. Of course, the content and calculation standard of alimony payment are relative, not absolute. When determining the content and calculation standard of alimony payment, we should not only consider the necessity of the obligee's demand, but also consider the possibility of the obligor's bearing, and comprehensively balance the interests of all parties on the premise of fully protecting the elderly.

Legal basis: Article 1085 of the Civil Code of People's Republic of China (PRC). After divorce, if the children are directly raised by one party, the other party shall bear part or all of the support. The amount and duration of the expenses shall be agreed upon by both parties; If the agreement fails, the people's court shall make a judgment.

The agreement or judgment stipulated in the preceding paragraph shall not prevent the children from making reasonable demands to either parent over the original agreement or judgment when necessary.
