Regulations of Anhui Province on Traditional Chinese Medicine
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Traditional Chinese Medicine and other relevant laws and administrative regulations, combined with the actual situation of this province, in order to inherit and carry forward traditional Chinese medicine, guarantee and promote the development of traditional Chinese medicine and safeguard people's health. Article 2 These Regulations shall apply to Chinese medicine, health care, scientific research, education, industry, culture and their supervision and management within the administrative area of this province. Article 3 Chinese medicine is an important part of medical health. The people's governments at or above the county level shall vigorously develop the cause of Chinese medicine, implement the principle of paying equal attention to both Chinese and western medicine, and establish a management system that conforms to the characteristics of Chinese medicine.

The development of traditional Chinese medicine should follow the development law of traditional Chinese medicine, adhere to the combination of inheritance and innovation, give full play to the characteristics and advantages of Huatuo medicine and Xin 'an medicine, and promote the high-quality development of traditional Chinese medicine.

Establish a coordinated development mechanism of Chinese and Western medicine, support mutual learning, complementary advantages and coordinated development of Chinese and Western medicine, give full play to their respective advantages, and promote the integration of Chinese and Western medicine. Article 4 The people's governments at or above the county level shall incorporate the cause of traditional Chinese medicine into the national economic and social development plan, establish and improve the management system, service system and security system of traditional Chinese medicine, promote the overall and all-round development of traditional Chinese medicine, give play to the unique role of traditional Chinese medicine in disease prevention and health care and rehabilitation services, and protect and promote people's health. Article 5 The departments in charge of traditional Chinese medicine of the people's governments at or above the county level shall be responsible for the management of traditional Chinese medicine within their respective administrative areas, and relevant departments such as development and reform, education, science and technology, economy and informatization, finance, human resources and social security, agriculture and rural areas, commerce, culture and tourism, market supervision and management, and medical security shall be responsible for the work related to the management of traditional Chinese medicine within their respective functions and duties. Article 6 People's governments at or above the county level shall support the integration of traditional Chinese medicine into the regional integration development of the Yangtze River Delta, and carry out cooperation in the construction of standard system of traditional Chinese medicine, quality management, personnel training, scientific research, health service, cultural communication and the construction of Chinese herbal medicine bases, so as to realize the sharing of traditional Chinese medicine service resources and information interconnection. Article 7 Support scientific research and technological development of traditional Chinese medicine, encourage scientific and technological innovation of traditional Chinese medicine, popularize and apply scientific and technological achievements of traditional Chinese medicine, and protect intellectual property rights of traditional Chinese medicine. Eighth to encourage and support social forces to invest, donate and fund the cause of Chinese medicine, attach importance to the role of Chinese medicine industry associations, and support the foreign exchange and cooperation of Chinese medicine. Ninth people's governments at all levels and relevant departments should strengthen the propaganda of Chinese medicine culture and promote the spread of Chinese medicine culture; Radio, television, newspapers, Internet and other media should strengthen and standardize the dissemination of Chinese medicine knowledge, promote Chinese medicine culture, and create a social atmosphere that cares about and supports the development of Chinese medicine.

The second week of September every year is the province's traditional Chinese medicine publicity week. Chapter II Services of Traditional Chinese Medicine Article 10 The people's governments at or above the county level shall incorporate the construction of medical institutions of traditional Chinese medicine into the regional health planning and the establishment planning of medical institutions, and set up medical institutions of traditional Chinese medicine with appropriate scale. If the Chinese medical institutions organized by the government merge, cancel or change the medical nature of Chinese medicine, the opinions of the competent department of Chinese medicine of the people's government at the next higher level shall be sought according to law.

Each city and county people's government shall set up at least one independent public hospital of traditional Chinese medicine. Eleventh government-run general hospitals, maternal and child health care institutions and community health service centers, township hospitals, and conditional specialized hospitals shall set up Chinese medicine departments. The proportion of Chinese medicine beds in the standard beds of public general hospitals at or above the county level shall not be less than 5%.

The people's governments at or above the county level shall strengthen the capacity building of Chinese medicine services at the grassroots level, and community health service centers and township health centers shall be equipped with Chinese medicine doctors; Community health service stations and conditional village clinics should be reasonably equipped with professional and technical personnel of Chinese medicine. Twelfth medical institutions of traditional Chinese medicine shall go through the relevant examination and approval procedures according to law and abide by the relevant provisions on the management of medical institutions.

Where a Chinese medicine clinic is held, the name, address, scope of treatment and staffing of the clinic shall be reported to the competent department of Chinese medicine of the local people's government at the county level for the record before practicing activities can be carried out. Chinese medicine clinics shall publicize the scope of diagnosis and treatment, the names of Chinese medicine practitioners and their scope of practice in the clinics, and shall not carry out medical activities beyond the scope of filing.

Non-medical institutions shall not use the words "TCM treatment" and "TCM treatment" in their organization names, business projects and related publicity activities. The registered business scope of an enterprise providing TCM health care services shall be expressed as "TCM health care services (non-medical care)". Thirteenth development of Chinese medicine clinics, outpatient departments and specialized hospitals, to encourage chain operation. There are no layout restrictions on Chinese medicine clinics and outpatient departments organized by social forces that only provide Chinese medicine services, and there are no layout restrictions on the planning of medical institutions and regional health development plans. Support qualified Chinese medicine professionals to set up Chinese medicine clinics and outpatient departments. Fourteenth support social forces to set up Chinese medicine medical institutions and other kinds of Chinese medicine health service institutions, and encourage public Chinese medicine medical institutions to cooperate with social forces to set up Chinese medicine health service institutions of various ownership. Fifteenth Chinese medicine medical institutions should provide Chinese medicine services, medical personnel should be based on Chinese medicine professional and technical personnel, giving priority to the development and key construction of characteristic Chinese medicine specialties.
