Article 5 The following places or institutions shall display the national flag daily:

(1) Tiananmen Square and xinhua gate;

Whoever insults the national flag shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights. Whoever intentionally insults National Flag of the People's Republic of China and the national emblem in public by burning, damaging, scribbling, defacing or trampling on them shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights. Whoever deliberately falsifies National Anthem of the People's Republic of China's lyrics and music scores in public places, plays the national anthem in a distorted or derogatory way, or insults the national anthem in other ways, if the circumstances are serious, shall be punished in accordance with the provisions of the preceding paragraph.
