Regulations of Fushun Municipality on the Administration of Sports Market
Chapter I General Provisions Article 1 In order to strengthen the management of sports market, standardize sports business activities, protect the legitimate rights and interests of operators and consumers, and prosper and develop sports undertakings, these Regulations are formulated in accordance with the Sports Law of the People's Republic of China and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the acts of engaging in sports business activities and their management by using sports events or sports business premises within their respective administrative areas. Article 3 Sports mentioned in these Regulations refer to sports approved and announced by the national and provincial sports administrative departments.

The sports business premises mentioned in these Regulations refer to the venues and facilities used to carry out sports business activities.

The sports business activities mentioned in these Regulations refer to the following business activities for the purpose of making profits:

(1) Sports competitions;

(two) sports performances, sports fitness and entertainment, sports rehabilitation;

(3) Sports and technical training;

(four) sports information consultation, sports advertising, sports broadcasting;

(five) the use of sports intangible assets such as sports organization names and sports special signs;

(6) Other sports business activities. Article 4 The sports administrative department of the people's governments of cities and counties (districts) is the competent department of the sports market, and is responsible for the supervision and management of the sports market within their respective administrative areas according to the principle of hierarchical management. Its duties are:

(a) to publicize and implement the laws and regulations on the management of sports market;

(two) establish and improve the sports market management system and norms;

(three) to issue professional and technical qualification certificates in accordance with the management authority stipulated by laws and regulations;

(four) training, assessment and qualification certification for operators and professional and technical personnel;

(five) supervision and inspection of sports business activities, investigate and deal with illegal acts;

(six) to manage other matters that should be managed by the sports administrative department.

Industry and commerce, public security, price, health, technical supervision and other relevant departments shall, in accordance with their respective responsibilities, do a good job in the management of the sports market. The funds needed for sports market management are included in the fiscal budget at the same level. Chapter II Management Article 8 Operators engaged in sports business activities shall, within 30 days from the date of obtaining the business license, go through the filing formalities with the sports administrative department at the same level of the business license issuing organ.

Operators shall provide relevant information when handling the filing procedures. Article 9 Operators engaged in archery, boxing, martial arts, judo, taekwondo, shooting, swimming, weightlifting, wrestling, water sports, ice and snow sports, air movement, rock climbing, motorcycle, rafting, diving, roller skating, skateboarding, qigong, bungee jumping, go-karting, darts, gymnastics and other high-risk sports directly related to personal health and life safety shall be subject to regular supervision by the sports administrative department according to law. Article 10 Where an operator changes its business project or place, it shall go through the filing formalities with the sports administrative department in accordance with the provisions of Article 8. Eleventh operators should establish and improve the internal management system, strengthen the management of employees, and shall not employ people who have not obtained professional and technical qualification certificates to engage in sports skills training, guidance, judgment, safety rescue and other work. Twelfth sports professional and technical personnel qualification certificate shall not be forged, altered, leased, lent or sold. Thirteenth operators engaged in sports business projects must be clearly marked in accordance with the provisions on price management, indicating the charging items and standards. Fourteenth operators should do a good job in the maintenance of sports venues and facilities to ensure safety, hygiene and normal use.

For sports business projects that may endanger the personal safety of consumers, operators should explain their safety requirements and the use of facilities, set up eye-catching warning signs, and take effective measures to prevent the occurrence of hazards.

The number of people accommodated in the business premises shall not exceed the approved number. Fifteenth operators should implement the accident handling and death reporting system.

When an accident occurs, the operator shall carry out emergency rescue. In the event of a fatal accident, the operator shall report to the local county (district) sports administrative department and public security organ within 24 hours, and do a good job in handling the accident. Sixteenth operators should ensure the good order of sports venues and stop uncivilized and unhealthy behavior. Gambling, feudal superstition, pornography or other illegal activities by using sports business activities are prohibited. Seventeenth operators should give guidance and protection to minors, the elderly and the disabled who participate in sports activities. Eighteenth consumers should take good care of sports venues and sports facilities, abide by public order and obey the management of staff. Nineteenth sports administrative departments should provide sports technical consultation and business guidance services for operators according to the needs of sports business activities.
