After investigation, Kun Studio found that a company in Fujian Province used Kun's portrait and name to promote its famous brand weight-loss products in its shop without consent and permission, which easily made many visitors and customers mistakenly think that Kun was the brand spokesperson of the defendant, or there was some cooperative relationship between them, which had obvious commercial service characteristics.
Kun Studio believes that the defendant, knowing that he has not obtained the plaintiff's authorization, has committed personal acts that infringe intellectual property rights, such as "alongside a well-known IP" and "hitchhiking", which violates business ethics and constitutes a confusing act of false advertising and unauthorized use of influential names of others, and should bear the relevant legal basis for infringement of portrait rights and infringement of intellectual property rights.
Kun Studio filed a lawsuit in Mawei Court, demanding that the defendant immediately stop infringing the plaintiff's portrait right, publish an apology statement, eliminate the adverse effects, and compensate the plaintiff for property losses of 300,000 yuan.
