If the victim is injured by a car, the victim can claim compensation through mediation under the auspices of the traffic police department of the public security organ. If the dispute in traffic accident compensation cannot be settled through mediation by the traffic administrative department of the public security organ, the traffic administrative department of the public security organ shall inform the parties that they can bring a civil lawsuit to the people's court. According to the provisions of Article 74 of the Road Traffic Safety Law, the parties may request the traffic administrative department of the public security organ for mediation, or bring a civil lawsuit directly to the people's court. After mediation by the traffic administrative department of the public security organ, if the parties fail to reach an agreement or fail to perform the mediation after it takes effect, the parties may bring a civil lawsuit to the people's court.
