What is the principle of tort liability?

Fault liability is the general imputation principle of tort liability, which is applicable to general tort except special tort stipulated by laws and regulations.
2. The principle of presumption of fault liability refers to the presumption that the actor is at fault and should bear tort liability based on the special provisions of the law, unless the actor can prove that he is not at fault.
3. No-fault liability principle: Also known as strict liability principle, it refers to the special provisions based on the law. If the victim can prove that the damage is caused by the behavior or object of the actor, the actor shall bear civil liability, regardless of whether there is subjective fault or not, unless the actor can prove that there is a legitimate defense. At present, the circumstances that the law stipulates to bear no-fault liability mainly include: the ward causes damage to others, and the guardian bears no-fault liability; The employing unit shall bear no-fault liability for the acts of staff members that infringe upon others; Labor relations are formed between individuals, and the party providing labor services causes damage to others because of labor services, and the party receiving labor services bears tort liability; When a product defect causes personal injury, the producer shall bear no-fault liability; If highly dangerous operations cause personal injury, the infringer shall bear no-fault liability; If environmental pollution causes damage to people, the pollutant discharge unit shall bear no-fault liability; If the animals raised cause damage to people, the breeder shall bear the liability without fault.
4. The principle of fair liability: It means that the injurer and the victim are not at fault for the damage caused, and according to the concept of fairness, on the basis of considering the actual situation of the parties' property status and ability to pay, the losses are shared by both parties.
To sum up, copying other people's content, in addition to indicating that it is not allowed to reprint the content, also needs the permission of the right holder and indicating the source, otherwise it constitutes infringement. If it has certain commercial purposes, such as propaganda, it also constitutes infringement without consent.

Internet users and network service providers who use the Internet to infringe upon the civil rights and interests of others shall bear the tort liability. Where there are other provisions in the law, those provisions shall prevail.
Article 1 195
(1) If a network user uses a network service to commit an infringement, the obligee has the right to notify the network service provider to take necessary measures such as deleting, blocking and disconnecting the link. The notice shall include the preliminary evidence of infringement and the true identity information of the obligee.
(two) after receiving the notice, the network service provider shall forward the notice to the relevant network users in time, and take necessary measures according to the preliminary evidence of infringement and the type of service; If necessary measures are not taken in time, the expanded damage shall be jointly and severally liable with the network users.
(3) If the obligee causes damage to the network user or network service provider due to the wrong notice, it shall bear the tort liability. Where there are other provisions in the law, those provisions shall prevail.
