As a very prominent social problem, domestic violence endangers family stability, social security and the physical and mental health of women and children. Combating domestic violence is the responsibility of the state, society and every family. The state prohibits any form of domestic violence. Next, through two practical cases in Guyuan, I briefly understand the harmfulness of domestic violence and how to deal with it. Before the lawsuit, the two parties dissolved the marriage relationship through litigation.

The first paragraph of Article 64 of the Civil Procedure Law of People's Republic of China (PRC) stipulates: "The parties shall provide evidence for their own claims." If the parties fail to provide evidence to prove their claims, they shall bear the risk of losing the case. In domestic violence cases, the victim should fix and collect evidence in a timely and comprehensive manner.

For example, tools such as sticks used by the perpetrators, alarm records and interrogation records made by public security organs, outpatient medical records issued by medical institutions, forensic live identification, witness testimony of informed children, repentance books and letters of guarantee of the perpetrators, etc. Article 100 of the Civil Procedure Law of People's Republic of China (PRC) gives the parties the right to apply for litigation preservation because of the damage caused by the other party's behavior.

According to this article and related laws, victims of domestic violence cases can apply to the court for a ruling prohibiting the respondent from beating and threatening the personal safety of the applicant and its relatives and friends, and prohibiting the respondent from activities within 200 meters of the applicant's residence, school, work unit or other places frequented by the applicant to ensure their personal safety.

If the victim needs to dissolve the marriage relationship, he may, in accordance with the relevant provisions of the Marriage Law of the People's Republic of China, request the infringer to compensate for mental damage; If the victim wants to protect his rights and interests, he can apply to file an infringement dispute and demand personal injury compensation from the infringer according to the General Principles of the Civil Law, the Tort Liability Law of People's Republic of China (PRC) and other laws.

If a violent act constitutes a crime, it can also be prosecuted for intentional injury and abuse.
