Liu Fan, deputy director of the State Administration for Industry and Commerce, said that the Advertising Law (Revised Draft) has greatly revised the existing advertising law, from 6 chapters and 49 articles in the existing advertising law to 8 chapters and 9 1 articles. Among the adjustment clauses, adding the standard clauses about celebrity endorsement advertisements is one of the highlights.
Liu Fan said that the revised draft proposed that on the basis of the "three subjects" of advertisers, advertising agents and publishers, "other participants in advertising", including stars and celebrities, who participated in advertising endorsement, certification and recommendation, should also be included in the scope of regulation as the subjects of advertising activities, and the joint and several liability subjects should be extended to individuals, so as to strengthen the constraints on stars and celebrities to endorse advertisements.
"Other participants in advertising" shall bear corresponding administrative and civil responsibilities, and if the case constitutes a crime, criminal responsibility shall be investigated according to law. If this revised draft is passed, advertising spokespersons will be supervised as the fourth subject and bear joint and several liability for the advertisements they endorse.
