The term "taxi" as mentioned in these Measures refers to a small passenger car with less than 5 seats that provides passenger service according to passengers' requirements and is charged according to mileage and time. Article 3 The development of taxi industry should be compatible with the economic and social development of this Municipality, coordinated with the development of urban construction and other public transport industries, and the total amount should be controlled according to market demand.
Taxi industry development planning, new capacity planning and taxi public service facilities construction planning, by the municipal traffic administrative department in conjunction with relevant departments, submitted to the Municipal People's government for approval before implementation.
The three counties under the jurisdiction of the city can put forward the development plan of taxi industry within their jurisdiction according to the local economic development and market demand, and after being audited by the municipal traffic administrative department, it will be reported to the Municipal People's government for approval. Article 4 The taxi industry shall follow the principles of unified management, legal operation, fair competition, safe operation and excellent service.
Encourage taxi operators to implement intensive and large-scale operations. Article 5 The traffic administrative department of the people's government of a city or county is the competent authority of the taxi industry, and its subordinate taxi management agencies are specifically responsible for the daily management, supervision and inspection of the taxi industry.
Public security, industry and commerce, price, quality and technical supervision, finance, taxation, labor and social security, environmental protection, planning, construction, urban management administrative law enforcement and other relevant departments shall, according to their respective responsibilities, do a good job in taxi management. Article 6 The traffic administrative department and the taxi management organization shall carry out activities such as quality service and the creation of civilized industry in the taxi industry, and commend and reward taxi operators and drivers who have made remarkable achievements in safe operation, civilized driving, quality service, etc. Chapter II Business License Article 7 Taxi operators who have obtained the right to operate before the implementation of these Measures shall be determined on the basis of clarifying the property rights and standardizing the ownership relationship. The specific plan shall be formulated by the municipal traffic administrative department and implemented with the consent of the Municipal People's Government.
After the implementation of these measures, the newly put taxis will be determined by open and fair methods such as bidding, and enterprise management will be implemented.
The operator shall sign a "contract for the use of taxi management right" with the traffic administrative department, obtain the management right, and go through the relevant formalities according to the provisions of these measures before starting operation. Article 8 The right to operate shall be calculated on a bicycle basis, and a vehicle operation license shall be issued to taxis that have obtained the right to operate on a bicycle basis, with one license for each vehicle.
If it is not put into operation within 3 months after obtaining the right to operate, it shall be deemed as an automatic waiver. Article 9 The term of the right to operate a taxi is 8 years.
If a taxi company purchases a taxi and operates it as an enterprise, or if the taxi is updated into a safe, environmentally friendly and comfortable vehicle in time, the term of the right to operate may be appropriately extended. The specific measures shall be formulated by the municipal traffic administrative department and implemented with the consent of the Municipal People's government. Tenth new taxi after the implementation of these measures, the right to operate shall not be transferred in any form. Before the implementation of these measures, the transfer of the existing taxi management right shall be handled in accordance with the provisions of the municipal traffic administrative department.
During the period of validity of the right to operate a taxi, the operator can go through the formalities of scrapping and updating the taxi according to the regulations, and the remaining period of the right to operate a taxi will be transferred to a new car. Article 11 Where the right to operate a taxi is transferred, the transferor and the transferee shall register with the taxi management agency, receive and sign the transfer contract in a unified format. Twelfth the transferee shall sign a contract with the traffic administrative department for the use of the remaining years of the right to operate, and go through the formalities in the relevant departments to obtain a new vehicle operating license. Thirteenth taxi franchise expires, the operator should be re-determined through fair competition; Under the same conditions, operators who have passed the examination of taxi management agencies during the operation period have the priority to obtain the right to operate.
If the state or province has new regulations on the handling after the expiration of the management right, it shall be handled according to its regulations.
The specific measures for the assessment of operators shall be formulated by the municipal traffic administrative department and implemented after being approved by the Municipal People's government. Fourteenth taxi in any of the following circumstances, it should stop operating, return the relevant operating documents, remove the meter, dome light, clear the taxi special signs, and go through the formalities at the relevant departments; Failing to go through the relevant formalities within the specified time, the transportation, industry and commerce, taxation, public security and other departments shall handle it in accordance with the relevant provisions:
(1) Failing to continue to obtain the right to operate upon the expiration of the term of the right to operate;
(2) The operator terminates its operation;
(three) serious illegal business behavior occurred during the operation period, and the business license was revoked. Fifteenth taxi companies should meet the following conditions:
(1) There shall be no less than 600 taxis operating and accepting entrusted management services (among them, there shall be no less than 100 taxis purchased by enterprises and operated as enterprises);
(2) Having office space and fixed parking space suitable for the business scale;
(3) Having a good bank credit standing, financial status and corresponding ability to bear responsibilities;
(four) there are drivers who are suitable for business operations and meet the prescribed conditions;
(5) Having technical, financial and management personnel suitable for its business and scale;
(6) Other conditions stipulated by laws and regulations.
Taxi companies that have already operated, if all taxis are purchased by enterprises and operated as enterprises, are not subject to the restriction in Item (1) of the preceding paragraph.
