Regulations on the Protection of Erhai and Haixi in Dali Bai Autonomous Prefecture, Yunnan Province
Article 1 In order to strengthen the protection of Erhai Lake and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Regional Ethnic Autonomy and relevant laws and regulations, combined with the actual situation of Dali Bai Autonomous Prefecture (hereinafter referred to as the Autonomous Prefecture). Article 2 The term "Erhai Haixi" as mentioned in these Regulations refers to the dam west of Erhai Lake and east of Cangshan Mountain within the jurisdiction of Dali. Its protection scope starts from the boundary pillar on the west bank of Erhai Lake in the east, and reaches below 2200m on the east slope of Cangshan Mountain in the west, 30m on the south bank of Yangnan River in the south, and reaches the west line of Luoshikou River in the north.

The object of protection is the rural scenery of Haixi, with emphasis on basic farmland, architectural features of villages and towns, eighteen streams of Cangshan Mountain and corridors of traffic arteries. Article 3 Units and individuals operating within the protection scope of Haixi shall abide by these Regulations. Article 4 The protection of Haixi adheres to the principles of giving priority to protection, scientific planning, highlighting characteristics and rational utilization. Article 5 The people's governments of autonomous prefectures and Dali City shall incorporate the protection of Haixi into the national economic and social development plan, establish an ecological compensation mechanism, earnestly safeguard the legitimate rights and interests of the masses, and include the protection funds in the fiscal budget at the corresponding level. Article 6 Dali Municipal People's Government shall be responsible for the protection of Haixi, formulate protection plans, straighten out the management system and establish a coordination mechanism.

Dali Municipal People's Government planning, housing and urban and rural construction, land and resources, water, environmental protection, agriculture, development and reform, finance, public security, urban management, transportation, forestry, culture, ethnic religion, tourism and other relevant departments shall, according to their respective functions and duties, do a good job in the protection of the west coast. Article 7 The Town People's Government within the scope of protection of Haixi shall be specifically responsible for the protection of Haixi within its administrative area. The main responsibilities are:

(a) to publicize and implement the relevant laws, regulations and these regulations;

(two) the implementation of Haixi protection planning;

(three) to formulate specific measures for the protection of the Haixi;

(four) to do a good job in the daily management of Haixi protection;

(five) to exercise the administrative law enforcement power conferred by these regulations.

Villagers' committees (communities) and villagers' groups within the scope of protection of Haixi shall cooperate with the Town People's Government to do a good job in the protection of Haixi within their respective jurisdictions. Article 8 The protection of Haixi shall, in accordance with the planning requirements, delimit basic farmland protection areas, prohibited construction areas and restricted construction areas, strictly regulate the management of village construction, and strengthen the protection and management of eighteen streams and traffic corridors in Cangshan.

In restricted construction areas, strictly control project access. In addition to social public welfare construction projects, tourist reception facilities such as characteristic inns and five-star hotels, as well as tourism services such as leisure health and leisure vacation can be arranged appropriately. Article 9 Dali Municipal People's Government shall delimit a permanent basic farmland protection area of not less than 6,543,800 mu within the protection scope of Haixi, formulate a protection plan, delimit the protection scope, set up signs and make an announcement to the public.

The barren hills, slopes, wasteland and unused land within the protection scope of Haixi should be included in the protection plan and rationally utilized. Tenth in the permanent basic farmland protection areas prohibit the following acts:

(1) Building houses, kilns and graves;

(2) Digging ponds, taking soil, sand mining, quarrying and mining;

(three) the use of highly toxic, high residue pesticides, phosphorus-containing cleaning products and non-degradable plastic products and other harmful substances;

(four) stacking waste and dumping garbage;

(5) Idle and barren cultivated land (land). Eleventh Dali Municipal People's Government shall establish a dynamic monitoring and management system for land use change, cultivated land protection and village construction in Haixi Prefecture, monitor cultivated land change and housing construction in Haixi Prefecture, and deal with illegal acts in a timely manner. Article 12 The Town People's Government within the protection scope of Dali City and Haixi shall, in accordance with the Regulations on the Management of Village Planning and Construction of Dali Bai Autonomous Prefecture in Yunnan Province and these Regulations, formulate village construction plans, strengthen the management of residential land, and strictly implement land use standards.

Residential land shall be one household, one place, and the old land shall be vacated and newly approved. Scientifically implement the transformation of old villages, increase the intensity of overall planning and integration, encourage villagers to give priority to the use of idle homesteads in villages, and guide the orderly development of village construction according to the plan. Thirteenth buildings with more than three floors or a total height of more than 12 meters shall not be built within the protection scope of Haixi, and buildings with local national traditional styles shall not be built; If construction is really necessary, a hearing shall be held and reported to the people's government of the Autonomous Prefecture for approval. Article 14 The construction of villages within the protection scope of the Haixi should highlight the architectural style dominated by Bai folk houses, and the construction of infrastructure such as roads, water supply and drainage systems, greening and lighting in villages should be carried out in strict accordance with the plan.

Farmers outside the village planning area within the protection scope of Haixi should gradually move into the planning area. Article 15 The Dali Municipal People's Government shall make a special plan for the protection and management of the eighteen rivers in Cangshan, and use 30m on both sides of the eighteen rivers as roads and ecological landscape land. According to the needs of flood control and disaster reduction, pollution interception and pollution control, water purification, embankment roads, ecological landscape, tourism and leisure, comprehensive management will be carried out to build characteristic ecological corridors. Sixteenth Cangshan eighteen streams within 30 meters on both sides, prohibit the following acts:

(a) new buildings and structures outside the public infrastructure;

(2) Digging sand, taking soil and quarrying;

(3) stacking wastes and dumping garbage;

(four) unauthorized felling of trees and destruction of flowers and plants;

(five) unauthorized interception and diversion of water.
