This can't be registered as a self-employed shop name.
Even if you happen to register successfully, you may be asked to change.
1, Article 27 of the Regulations on the Administration of Enterprise Name Registration clearly stipulates:
Anyone who uses the registered enterprise name of another person without authorization or commits other acts that infringe upon the exclusive right to use the enterprise name of another person may request the registration authority where the infringer is located to handle it. The registration authority has the right to order the infringer to stop the infringement, compensate the infringed for the losses caused by the infringement, confiscate the illegal income and impose a fine of not less than 5,000 yuan but not more than 50,000 yuan.
Anyone who infringes upon the exclusive right to use another person's enterprise name may also directly bring a suit in a people's court.
2. Yangshengtang Co., Ltd. also requires the industrial and commercial department to revoke your self-employed name according to Article 53 of the Regulations for the Implementation of the Trademark Law:
Article 53 If the trademark owner thinks that others may deceive the public or cause misunderstanding to the public by registering his well-known trademark as the enterprise name, he may apply to the enterprise name registration authority for cancellation of the enterprise name registration. The competent authority of enterprise name registration shall handle it in accordance with the Provisions on the Administration of Enterprise Name Registration.
3. Article 5 of the Regulations on the Administration of Enterprise Name Registration also stipulates that the registration authority has the right to correct the registered inappropriate enterprise name, and the higher registration authority has the right to correct the inappropriate enterprise name registered by the lower registration authority.
Any unit or individual may request the registration authority to correct the registered inappropriate enterprise name.
