Measures of Hubei Province for the Administration of Outdoor Advertising
Article 1 In order to strengthen the management of outdoor advertising, protect the legitimate rights and interests of outdoor advertising operators, advertisers and consumers, and promote the healthy development of the advertising industry, these Measures are formulated in accordance with the relevant provisions of the Regulations on Advertising Management of the State Council (hereinafter referred to as the Regulations) and combined with the actual situation of our province. Article 2 All units and individuals who set up, post and draw outdoor advertisements in buildings, billboards, windows, light boxes, neon lights, electronic display screens, vehicles and other media within the province, as well as outdoor advertising operators, must abide by these measures. Third Provincial Administration for Industry and Commerce is responsible for the management of outdoor advertising in the province; The local, city, state and county administrations for industry and commerce are responsible for the management of outdoor advertisements within their respective administrative areas.

Urban construction, transportation, public security, land management and other departments shall, according to their respective responsibilities, assist the administrative department for industry and commerce to do a good job in outdoor advertising management. Article 4 The people's governments of cities, prefectures and counties shall, according to the overall urban development plan, organize the departments of industry and commerce, urban construction, transportation, public security and land management to formulate specific plans for outdoor advertising in their respective administrative areas. The specific planning shall be supervised and implemented by the administrative department for industry and commerce. Article 5 Units and individuals that set up outdoor advertising facilities must obtain the consent of the relevant competent departments in advance, and submit their business licenses and approval opinions of the relevant competent departments to the administrative department for industry and commerce in accordance with the regulations. Only after the examination and registration by the administrative department for industry and commerce can construction be carried out on lots or buildings that meet the specific planning requirements for outdoor advertising. Sixth outdoor advertising facilities need to occupy the site or building, the construction unit or individual shall pay the site fee or building occupation fee to the users or operators of the site or building. The charging standards for site fees and building occupancy fees shall be formulated by the provincial administration for industry and commerce in consultation with the departments of price, finance and urban construction, and shall be implemented after being submitted to the provincial people's government for approval. Seventh outdoor advertising facilities are owned by investors, and no unit or individual may occupy, dismantle or damage them at will. Due to the national construction must be occupied or removed, should be given appropriate economic compensation.

The provisions of the preceding paragraph shall not apply to the removal of illegal outdoor advertising facilities or the removal of illegally posted advertisements. Eighth units and individuals engaged in outdoor advertising business, must go through the formalities of examination and approval and registration in accordance with the provisions of Article 6 of the Regulations, and obtain the Business License of Enterprise as a Legal Person. Ninth outdoor advertising content must be true, healthy, clear and easy to understand, and shall not deceive users and consumers in any form. Tenth outdoor advertising has one of the following contents, it is forbidden to set up and post:

(a) in violation of the laws and regulations of China;

(2) Damaging the national dignity of our country;

(3) Having the national flag, national emblem and national anthem of China;

(four) reactionary, obscene, superstitious and absurd content;

(5) practicing fraud;

(six) belittle the service level of similar products or the same industry;

(seven) writing and writing are not standardized; Eleventh advertisers to apply for setting up, posting and drawing outdoor advertisements, must be in accordance with the provisions of Article 11 of the Regulations, submit relevant documents to the advertising operators. If the certification documents are incomplete, untrue or the advertising content violates the regulations, the advertising agent shall not publish them. Twelfth whoever violates the "Regulations" and the provisions of these measures, it is forbidden to post outdoor advertisements. Posting outdoor advertisements in urban areas must be examined and approved by the administrative department for industry and commerce, and posted on the public advertisement column. Public * * * advertising columns are uniformly set by the county and municipal administrative departments for industry and commerce. The administrative department for industry and commerce shall fully consider the reasonable requirements of the poster when determining the posting location. Thirteenth outdoor advertisements that have not been approved or set at designated places shall be ordered by the administrative department for industry and commerce to be removed by the poster; If the poster cannot be found, the administrative department for industry and commerce shall organize forces to remove it. Fourteenth in violation of the provisions of posting outdoor advertisements, causing serious consequences, the administrative department for Industry and Commerce shall be responsible for the investigation. If the investigation involves the responsible person outside the administrative area, the relevant administrative departments for industry and commerce shall provide assistance. Fifteenth any unit or individual has the right to stop posting outdoor advertisements to keep buildings, trees, poles and other facilities clean and tidy. Posters who do not listen to dissuasion can report to the administrative department for industry and commerce. Sixteenth enterprises, institutions, individual industrial and commercial households to use their own venues to promote their temporary business advertising, should be approved by the local administrative department for Industry and commerce, unified use of mobile billboards. The specifications and styles of mobile billboards shall conform to the provisions of the administrative department for industry and commerce. Seventeenth mobile billboards shall not affect the passage of pedestrians and vehicles. Article 18 The administrative department for industry and commerce shall supervise and inspect the location, content and expression of all kinds of outdoor advertisements, and correct those that violate or do not conform to the regulations. Nineteenth party and government departments, people's organizations, judicial organs and other relevant units to post notices, slogans and other promotional materials, are exempt from registration, but must agree with the industrial and commercial, urban construction and other departments on the appropriate posting location. New publicity windows (cabinets and columns) in public places should be approved by the departments of industry and commerce, urban construction and so on in advance.
