Regulations of Chengde Municipality on the Protection of Water Source Protection Functional Zones
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the provisions of relevant laws and regulations and the actual situation of this Municipality in order to strengthen and standardize the water source protection work within their respective administrative areas, promote the construction of water source functional areas and realize the coordinated development of Beijing, Tianjin and Hebei. Article 2 These Regulations shall apply to the planning, protection, management and supervision of water source protection functional zones within their respective administrative areas.

The term "water source protection" as mentioned in these Regulations refers to activities such as vegetation restoration, soil and water conservation, pollution prevention and control for the purpose of conserving water resources, regulating hydrological conditions, enhancing the water conservation capacity of ecosystems and improving the quality of water environment. Article 3 The protection of water conservation functional areas shall follow the principles of overall planning, giving priority to protection, adjusting measures to local conditions and comprehensive management, and adhere to the mechanism of combining government leadership with social participation, combining overall optimization with key management, and combining ecological protection with people's livelihood security. Article 4 The municipal and county people's governments shall organize the preparation of the protection plan for water source protection areas according to law, and coordinate with the national economic and social development plan, the overall land use plan, the overall urban and rural planning and the environmental protection plan.

The protection planning of water source protection functional areas shall be reported to the Standing Committee of the people's congress at the same level and the people's government at the next higher level for the record. Fifth city and county people's governments are responsible for organizing and coordinating the protection of water source protection functional areas, and the relevant government departments are responsible for the protection of water source protection functional areas according to their respective responsibilities.

Township (town) people's governments and sub-district offices shall, under the leadership of the people's governments at higher levels, organize the protection of water source protection functional areas. Sixth people's governments at the city and county levels shall include the funds needed for the protection of water source protection functional areas in the annual budget. Seventh people's governments at all levels should strengthen the publicity and education of water conservation laws, regulations and related knowledge, and guide the masses to actively participate in water conservation and protection.

Newspapers, radio, television, internet and other media should increase publicity and strengthen public opinion supervision on water resources conservation and protection. Article 8 People's governments at all levels shall reward units and individuals that have made remarkable achievements in saving and protecting water resources. Chapter II Conservation Protection Article 9 Important ecological function areas and sensitive and fragile ecological environment areas that affect water conservation within their respective administrative areas shall be marked with red lines of ecological protection and given special protection. All kinds of development and construction activities that do not meet the functional orientation of water source protection are strictly prohibited. Article 10 People's governments at all levels shall adhere to the principles of suitable forest, suitable land and suitable trees, plant trees, protect forests and prevent disasters, increase the protection of forest vegetation and expand the forest coverage area.

Closed measures should be taken to protect the barren hills and wasteland suitable for forest, restore vegetation and improve the water conservation capacity of forest land.

Organize the masses to carry out afforestation activities and enhance the awareness of ecological environmental protection. Eleventh city and county people's governments shall delimit and protect basic grasslands and strictly observe the ecological red line of grasslands. Adhere to returning farmland to grassland, returning grazing to grassland, and implement grassland grazing prohibition, grazing suspension and rotational grazing system.

Natural grasslands and artificial grasslands with special ecological functions and suitable for animal husbandry production should be protected by fencing and other measures. Twelfth in the grassland designated as a tourist area according to law, in addition to the permitted tourism projects and activities, the following acts are prohibited:

(1) Building or expanding tourist facilities and projects without approval;

(two) beyond the scope and route of tourism regulations, crushing, trampling and other acts that destroy grassland ecology;

(3) Camping and picnicking;

(four) other acts of destroying grassland ecology. Thirteenth people's governments at the city and county level shall conduct unified planning and management of unused land, and implement enclosure and vegetation maintenance.

The competent department of natural resources of the people's government at the city or county level is responsible for the protection and management of unused land. Article 14 It is forbidden to plant crops on steep slopes of more than 25 degrees, steep slopes of more than 20 degrees around large and medium-sized reservoirs and desertification areas. Those that have been cultivated should return farmland to forests and grasslands in accordance with relevant state regulations.

Where crops are planted on sloping farmland below 25 degrees, the township (town) people's government shall organize the masses to carry out slope remediation, water storage and soil conservation tillage, terraced fields or returning farmland in a planned way. Fifteenth city and county people's governments shall establish an index system for total water intake control, formulate water allocation schemes and specific control measures for reservoirs and major rivers, and strictly implement the system of water resources management and total water consumption control.

It is forbidden to take groundwater in areas where the exploitation of groundwater is prohibited; In the restricted exploitation area of groundwater, it is forbidden to add new construction projects using groundwater; Within the coverage of municipal water supply network, unauthorized self-prepared wells will be closed.

Scientifically plan and develop geothermal water and mineral water resources in a planned way, and strictly control the total exploitation. Sixteenth engaged in underground exploration, mining, construction projects and underground space development and utilization of engineering drainage, measures should be taken to make full use of, and shall not be discharged at will. Seventeenth city and county people's governments should formulate and improve policies and measures to promote water conservation, popularize water-saving technologies, processes, equipment and products, improve the reuse rate of water, and encourage the development and utilization of reclaimed water. Eighteenth city and county people's governments should take effective measures to ensure that the environmental quality of surface water at the intersection of rivers is not lower than the standards stipulated by the state and province.
