New provisions of the adoption law in 2023
I. Application

1. Adopters, adoptees and adopters who comply with the provisions of the Civil Law and handling opinions shall personally apply to the county (city) city adoption registration authority for factual adoption registration.

2, the adoption of non social welfare institutions (including public security, family planning departments entrusted citizens to raise) to raise the abandoned baby, children can not find their biological parents, to the abandoned baby, children found in the county (city) urban adoption registration authority for registration.

If an abandoned baby or child whose biological parents cannot be found is entrusted by the adoption civil affairs department, it shall be registered with the adoption registration authority in the county (city) where the abandoned baby or child is located (where the social welfare institution is located).

Children whose adoptive parents have special difficulties and are unable to support them, or children who have been adopted by their peers within three generations, shall register with the adoption registration authority as stipulated in the Measures for Adoption Registration.

3. Documents and supporting materials that the adopter shall submit to the adoption registration authority when applying:

(1) Adoption application. The contents include the purpose of adoption, no abuse, no abandonment, no upbringing, the guarantee of educating the adoptee's healthy growth, the background of the adoptee and the formation of de facto adoption;

(2) the adopter's resident identity card, household registration book and marriage certificate (the divorcee provides a divorce certificate or a court judgment or mediation book);

(3) unit certificate. Proof of the adopter's age, marital status, children, economic conditions, physical health, moral quality, and the ability to raise and educate the adoptee issued by the villagers' committee or residents' committee where the adopter is located or where the household registration is located, and proof that the adopter and the adoptee are recognized by relatives, friends and the masses as adoptive parents and adopted children living together for a long time;

(4) physical health examination certificate. A medical certificate issued by a hospital at or above the county (city) level designated by the adoption registration authority that the adopter does not suffer from diseases that are medically considered unsuitable for adopting children;

(5)? No Child Certificate or Birth Certificate. The certificate of childlessness issued by the family planning administrative department of the county (city) where the adopter's habitual residence or permanent residence is located does not violate family planning laws and regulations; Or the adopter has children, is entrusted by the civil affairs department to arrange support or family planning, and is entrusted by the public security department to support abandoned babies and children. Or if the adopter has children and does not meet the "childless" conditions stipulated in the adoption law, and the adoption of abandoned babies or children raised by non-social welfare institutions does form a de facto adoption relationship, the family planning department shall handle the certificate according to family planning laws and regulations;

(6) receiving reports from abandoned children. If the person (organization or individual) who picks up abandoned babies and children reports to the public security organ in the place where they are found, the public security organ in the place where they are found shall issue a report certificate for picking up abandoned babies and children; If the abandoned baby or child finder (organization or individual) fails to report the case to the public security organ, if the party concerned can't submit the report certificate issued by the public security organ, he can submit the certificate issued by the village (neighborhood) committee where his unit and permanent residence are located, and can't find the certificate of the abandoned baby or child's biological parents or notarized certificate of the abandoned baby or child's origin;

(7) the certificate issued by the civil affairs, family planning and public security departments that the abandoned baby or child is entrusted or arranged by citizens (submitted by the abandoned baby or child adopter entrusted or arranged by the civil affairs, family planning and public security departments);

(8) photos. Two two-inch photos of the adopter and the adoptee, and one-inch bareheaded photo of the adopter 1 photo.

The certification materials in the above (1) (3) (4) and (5) are valid for 6 months from the date of issuance.

4. Documents and supporting materials submitted by adopters (social welfare institutions, units where abandoned children work, residents' committees and villagers' committees) to the adoption registration authority:

(2) Adoption agreements signed by social welfare institutions, adoption units, residents' committees and villagers' committees and adopters;

(3) Agree to adopt opinions.

Other people who put out children for adoption shall submit certificates and supporting materials in accordance with the provisions of the Measures for the Registration of Children Adopted by Citizens of China.

Second, review.

L, the county (city) urban adoption registration authority shall, on the basis of collecting the relevant certification materials submitted by the adopter, carefully examine the relevant certification materials submitted by the adopter in accordance with the relevant provisions of the General Principles of the Civil Law and the Measures for the Registration of Children Adopted by Citizens of China. First, verify whether the certification materials are true, complete and effective; Secondly, verify the authenticity of the information provided by the adoption parties, and conduct investigations when necessary to prevent perjury.

2. The adoption registrar conducts a comprehensive trial on the situation of the adopter and the adoptee, which meets the adoption conditions stipulated in the Civil Code and this handling opinion.

After being approved by the county (city) Civil Affairs Bureau, an application for adoption registration and an adoption agreement shall be issued to the adopter.

Iii. Adopters and adoptive units

The adopter who has signed the adoption agreement shall go through the adoption registration at the local welfare institution, adoption agency, residents' committee and villagers' committee with the application for adoption registration and the adoption agreement.

The personnel department of the adoption agency shall fill in the corresponding contents according to the requirements of the columns of "adopter's situation" and "adoptee's situation" in the application for adoption registration; The person-in-charge of the unit and the village (neighborhood) committee (i.e. the legal representative of the unit and the director of the village (neighborhood) committee) briefly explains the source of the adoptee and the fact that the adopter and the adoptee adopted in the column of "Opinions on placing the adopter out for adoption or opinions on signature of the person-in-charge of the children's welfare home", puts forward opinions on whether to approve the adoption of the adopter, and affix the official seal of the unit by the personnel (office) department of the unit;

Fourth, go through the adoption registration procedures.

Social welfare institutions, units, residents' committees and villagers' committees that propose adoption shall submit to the adopter a complete application for adoption registration, a copy of the ID card of the person in charge of the unit and an adoption agreement (2 copies). The adopter and the adoptee shall go through the adoption registration formalities at the adoption registration authority.

The adoption registration authority shall register in accordance with the legal procedures of the Civil Code and issue a certificate of adoption registration. The adoption relationship shall be established from the date of registration.
