Regulations of Shenzhen Special Economic Zone on Traditional Chinese Medicine
Chapter I General Provisions Article 1 In order to guarantee and promote the development of Chinese medicine, standardize the management of Chinese medicine industry, and protect and promote human health, these Regulations are formulated in accordance with the basic principles of relevant state laws and administrative regulations and in combination with the reality of Shenzhen Special Economic Zone (hereinafter referred to as the Special Zone). Article 2 Units and individuals engaged in traditional Chinese medicine activities in the Special Zone shall abide by these Regulations. Article 3 The development of traditional Chinese medicine shall follow the principle of combining inheritance with innovation and the coordinated development of traditional Chinese medicine. Article 4 The municipal and district governments shall adhere to the principle of paying equal attention to both Chinese and Western medicine, protect, guide, support and promote the development of Chinese medicine, and incorporate the cause of Chinese medicine into the national economic and social development plan of their respective jurisdictions. Article 5 The municipal and district health administrative departments are the competent departments of traditional Chinese medicine within their respective administrative areas, and perform the following duties according to law:

(a) to implement the laws and regulations of traditional Chinese medicine, draft and organize the development plan of traditional Chinese medicine;

(2) Examination and approval, licensing and supervision of the establishment of medical institutions of traditional Chinese medicine;

(three) the management of Chinese medicine continuing education, teacher education, health education and foreign exchanges;

(four) the handling of disputes over medical accidents in traditional Chinese medicine;

(five) other duties as prescribed by laws and regulations. Article 6 The relevant administrative departments of the municipal and district governments shall, according to their respective duties, guarantee and promote the development of Chinese medicine. Article 7 The municipal public health administrative department shall organize the establishment of an expert committee on traditional Chinese medicine to perform the following duties:

(1) Organizing major scientific research projects and providing suggestions for the development of traditional Chinese medicine;

(two) to sort out and study Chinese medicine literature and folk Chinese medicine diagnosis and treatment methods and technologies, and promote the development of Chinese medicine theory and technology;

(three) to provide professional advice for the relevant departments to formulate Chinese medicine management policies.

The Committee of Experts on Traditional Chinese Medicine is composed of famous Chinese medicine practitioners, famous Chinese pharmacists, experts recommended by trade associations, and Chinese medicine administrators of health administrative departments. The specific measures shall be formulated separately by the municipal public health administrative department. Article 8 The Chinese Medicine Industry Association is a self-regulatory organization attended by Chinese medicine medical institutions, Chinese medicine enterprises and Chinese medicine professional and technical personnel, and performs the following duties:

(1) Standardizing trade behaviors and safeguarding the legitimate rights and interests of members;

(two) to organize academic and business exchanges of traditional Chinese medicine, popularize the knowledge of traditional Chinese medicine, popularize the technology of traditional Chinese medicine, and train practitioners in the traditional Chinese medicine industry;

(three) to carry out the evaluation of key specialties and characteristic specialties of traditional Chinese medicine and integrated traditional Chinese and western medicine;

(four) to mediate internal disputes in the industry;

(five) other duties stipulated by laws, regulations and articles of association. Ninth to strengthen the propaganda, popularization and application of traditional Chinese medicine culture and popular science knowledge.

Every year, 65438+1October 22nd is the Chinese Medicine Publicity Day. Chapter II Safeguarding and Promoting Article 10 The municipal government shall set up a joint conference on the development of traditional Chinese medicine to perform the following duties:

(a) to study and formulate policies to promote the development of traditional Chinese medicine;

(two) coordinate and solve major problems in the development of traditional Chinese medicine;

(three) to supervise and inspect the implementation of relevant policies and measures.

The joint conference on the development of traditional Chinese medicine is convened regularly by the leaders of the municipal government in charge of health work, organized by the municipal public health administrative department, and attended by administrative departments such as development and reform, science, industry and trade, land planning, finance, education, public security, human resources and social security, cultural and sports tourism, market supervision, drug supervision and urban management. Eleventh city, district government and its relevant administrative departments shall solicit the opinions of the Chinese medicine expert committee when formulating policies involving Chinese medicine. Article 12 The municipal and district governments shall support the development of traditional Chinese medicine, gradually increase the financial investment in the cause of traditional Chinese medicine, and focus on supporting the special services of traditional Chinese medicine, the infrastructure construction of public traditional Chinese medicine hospitals, the construction of key disciplines and key specialties, and the training of talents in traditional Chinese medicine.

The municipal and district governments may set up special funds to promote the development of Chinese medicine for primary medical care, teaching, scientific research and popularization of Chinese medicine. Article 13 The municipal and district governments shall establish a subsidy and compensation mechanism for municipal and district public medical institutions of traditional Chinese medicine, and formulate subsidy and compensation measures conducive to promoting medical services with Chinese medicine characteristics. Article 14 The municipal administrative department of human resources and social security shall support the development of traditional Chinese medicine when formulating the medical insurance drug list and diagnosis and treatment items.

The municipal price department shall reflect the service cost and technical service value of traditional Chinese medicine when determining the charging standard for diagnosis and treatment. The charging items and standards shall be formulated by the municipal price administrative department in conjunction with the municipal health administrative department in accordance with the relevant provisions of the state and Guangdong Province on price management. Fifteenth municipal and district governments should incorporate Chinese medicine services into public health services and support the active use of Chinese medicine methods and technologies in disease prevention and control.

Encourage Chinese medical institutions to give full play to the advantages of Chinese medicine in health care and sub-health diagnosis and treatment, and carry out preventive health care services. Sixteenth the relevant administrative departments shall treat Chinese medical institutions equally when determining the designated medical institutions for social medical insurance, industrial injury insurance and public health emergencies. Seventeenth relevant administrative departments of the municipal and district governments shall improve the training and evaluation system of Chinese medicine talents and formulate policies conducive to the training and evaluation of Chinese medicine talents.
