The term "home-based aged care service" as mentioned in these Regulations refers to the aged care service provided for the elderly at home, which consists of basic government services, professional services of enterprises, institutions and social organizations, services of grassroots mass autonomous organizations and volunteer public welfare mutual assistance services. Article 3 The people's governments of cities and counties (cities, districts) shall strengthen their leadership over the aged care service, establish a fund guarantee mechanism suitable for economic and social development, formulate corresponding industrial policies and measures, promote the integrated development of home-based care and institutional care, and actively cultivate the aged care service industry.
The civil affairs department is in charge of home care service, organizes and promotes the construction of home care service system, and is responsible for the guidance, supervision and management of home care service. Health and medical security and other government departments, people's organizations and social organizations shall, in accordance with their respective responsibilities or articles of association, do a good job in home care services. Article 4 Township people's governments and sub-district offices shall be responsible for home-based care services within their respective jurisdictions and perform the following duties:
(a) the implementation of policies and measures such as the government's purchase of social services for the aged at home and financial subsidies;
(two) the construction, operation, maintenance and management of home care service facilities;
(three) to guide the village (neighborhood) committees and social organizations to participate in home care services;
(four) to assist the guidance center for the elderly to do a good job in the needs assessment, service quality assessment and inspection of home-based care services;
(five) other duties that should be performed according to law. Article 5 Village (neighborhood) committees shall assist the township people's governments and neighborhood offices to do a good job in home-based care services, collect basic information of the elderly within their jurisdiction, investigate the demand for home-based care services, inform the elderly of the situation of home-based care services, visit the elderly in difficulty regularly, mediate pension disputes, and organize public welfare activities of home-based care services and cultural and sports activities beneficial to the physical and mental health of the elderly. Article 6 The whole society should carry out extensive publicity and education on respecting, loving, respecting and helping the elderly, and establish a good social atmosphere. Encourage citizens, legal persons and other organizations to support home-based aged care services by means of investment, donation, donation and voluntary service. Chapter II Facilities Construction Article 7 The civil affairs department, together with the natural resources and planning department, shall, when preparing the special plan for the aged care service facilities, make overall arrangements for the aged care service facilities at home according to the principles of urban-rural integration, proximity, relative concentration and combination of medical care and nursing care, taking the number of permanent elderly people in the jurisdiction, service demand and service radius as the main basis.
The special planning of old-age service facilities should be connected with the special planning of health and healthy development, and implemented in the detailed planning of land and space. Article 8 Natural resources and planning departments shall incorporate the requirements of supporting the construction of home-based aged care service houses into the planning conditions before the land transfer of newly-built residential quarters, and seek the opinions of civil affairs, housing and urban-rural construction departments, township people's governments and sub-district offices when reviewing the specific configuration requirements of home-based aged care service houses in the design scheme of construction projects.
The housing for home-based aged care services in newly-built residential quarters shall conform to the supporting construction standards for home-based aged care services stipulated by the state and the province, and be set at the lowest floor on the ground with independent entrances and exits. Article 9 Newly-built residential quarters shall build nursing homes according to the standard that the indoor construction area is not less than two thousandths of the total construction area of residential quarters above ground and the single set area is not less than 30 square meters, and shall be planned, constructed, accepted and delivered synchronously with the residential quarters.
Built residential quarters should be equipped with homes for the aged with a standard of not less than 20 square meters per 100 households; Can not meet the standards, the county (city, district) people's government should be in place through new construction, renovation, expansion, purchase, replacement, leasing and other means.
On the basis of considering the convenience and service radius of the aged care service, the residential aged care service houses can be centrally allocated in adjacent communities according to the standard that the interior construction area is not less than two thousandths of the total construction area of the above-ground houses and the single place is not less than 300 square meters.
Township people's governments and sub-district offices shall, in combination with the actual needs of rural areas, allocate housing for home-based care services, and each administrative village shall at least centrally allocate 1 set. Article 10 The construction unit shall, within three months after the completion and acceptance of the newly-built residential quarters, hand over all the houses for home-based aged care services and their construction materials to the township people's governments and sub-district offices free of charge in accordance with the stipulations of the land use right transfer contract. Township people's governments and sub-district offices shall sign a transfer agreement after on-site inspection and submit the transfer information to the civil affairs department in a timely manner.
Home care services should be registered in time according to law; Township people's governments and sub-district offices shall strengthen their management and shall not be idle.
No unit or individual is allowed to demolish houses used for home care services or change their nature and use without authorization. Due to the needs of urban and rural construction, if the demolition or change of use is approved by the relevant departments according to law, the township people's government and the sub-district office shall construct the replacement nearby in accordance with the requirements of not less than the original construction area.
