BEIJING, Beijing165438+1October 7th News: The the State Council Press Office and the Ministry of Information Industry jointly issued the Interim Provisions on the Administration of Internet Website Business.
The full text of the Ordinance is as follows:
Article 1 These Provisions are formulated in order to promote the development of Internet news dissemination in China, standardize the news release business of Internet websites, and safeguard the authenticity, accuracy and legality of Internet news.
Article 2 These Provisions shall apply to Internet websites that publish news in People's Republic of China (PRC).
The term "publishing news" as mentioned in these Provisions refers to publishing and reprinting news through the Internet.
Article 3 Internet websites engaged in news publishing business must abide by the Constitution and laws and regulations.
The state protects the legitimate rights and interests of Internet websites engaged in news publishing business.
Article 4 The the State Council Press Office shall be responsible for managing the news publishing business of national Internet sites.
The information offices of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the administration of news release services of Internet websites within their respective administrative areas in accordance with these Provisions.
Article 5 Internet websites (hereinafter referred to as news websites) established by central news organizations, news organizations of central state organs, news organizations of provinces, autonomous regions and municipalities directly under the Central Government and news organizations directly under the city where the people's governments of provinces and autonomous regions are located according to law may engage in news publishing business after approval. Other news organizations do not set up separate news websites, but they can set up news pages on news websites set up by central news organizations or news organizations of provinces, autonomous regions and municipalities directly under the Central Government to engage in news publishing business upon approval.
Article 6 A news unit that establishes a news website (page) to engage in news publishing business shall report to the Information Office of the State Council or the Information Office of the people's government of a province, autonomous region or municipality directly under the Central Government for approval in accordance with the following provisions:
(a) the central news unit to establish a news website to engage in news publishing business, reported to the the State Council Municipal Information Office for approval.
(two) the news agencies of various departments of the central state organs set up news websites to engage in news publishing business, which shall be audited by the competent department and reported to the the State Council Press Office for approval.
(3) The establishment of news websites by news organizations directly under the provinces, autonomous regions, municipalities directly under the Central Government and cities where the people's governments of provinces and autonomous regions are located to engage in news publishing business shall be reviewed by the information offices of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and reported to the the State Council Information Office for approval.
(4) News organizations below provinces, autonomous regions and municipalities directly under the Central Government set up news pages on the news websites of central news organizations or news organizations directly under provinces, autonomous regions and municipalities directly under the Central Government to engage in news publishing business, and reported them to the information offices of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government for examination and approval, and to the the State Council Information Office for the record.
Article 7 Comprehensive Internet websites established by non-news organizations that meet the conditions listed in Article 9 of these Provisions (hereinafter referred to as comprehensive non-news organizations' websites) may engage in the business of publishing news published by central news organizations, news organizations of various departments of central state organs and news organizations directly under provinces, autonomous regions and municipalities directly under the Central Government upon approval, but they may not publish news written by themselves or news from other sources. Other internet websites established by non-news organizations according to law shall not engage in news publishing business.
Article 8 The websites of comprehensive non-news organizations engaged in news publishing business in accordance with Article 7 of these Provisions shall be audited by the information offices of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government where the organizers are located, and submitted to the the State Council Information Office for approval.
Article 9 The websites of comprehensive non-news organizations engaged in news publishing business shall meet the following conditions:
(1) Having the purpose and rules and regulations for engaging in the news publishing business in accordance with laws and regulations;
(two) the necessary news editing institutions, funds, equipment and places;
(3) Having full-time news editors with relevant news work experience and professional and technical qualifications above the intermediate level, and having a corresponding number of full-time news editors with professional and technical qualifications above the intermediate level;
(4) Having news information sources that meet the requirements of Article 11 of these Provisions.
Article 10 An Internet website applying for news publishing business shall fill in and submit the Application Form for Internet Website Engaged in News Publishing Business uniformly issued by the State Council Press Office.
Article 11 The websites of comprehensive non-news organizations engaged in publishing news released by central news organizations, news organizations of central state organs and news organizations directly under provinces, autonomous regions and municipalities directly under the Central Government shall sign an agreement with the above-mentioned news organizations and send a copy of the agreement to the information offices of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government for the record.
Article 12 News published by central news organizations, news organizations of various departments of central state organs and news organizations directly under provinces, autonomous regions and municipalities directly under the Central Government shall be published on the websites of comprehensive non-news organizations, with the news sources and dates indicated.
Article 13 News released by Internet sites shall not contain the following contents:
(a) in violation of the basic principles set by the Constitution;
(two) endangering national security, revealing state secrets, inciting subversion of state power and undermining national unity;
(3) damaging the honor and interests of the state;
(4) Inciting national hatred and discrimination and undermining national unity;
(5) sabotaging the state's religious policy and propagating cults and feudal superstitions;
(six) spreading rumors, fabricating and spreading false news, disrupting social order and undermining social stability;
(7) spreading obscenity, pornography, gambling, violence, terror or abetting crimes;
(8) Insulting or slandering others and infringing upon their legitimate rights and interests;
(9) Other contents prohibited by laws and regulations.
Article 14 Internet websites that link overseas news websites and publish news released by overseas news media and Internet websites must be reported to the the State Council Press Office for approval.
Fifteenth in violation of these provisions, any of the following circumstances, given a warning by the the State Council Municipal Information Office or the information office of the people's governments of provinces, autonomous regions and municipalities directly under the central government, ordered to make corrections within a time limit; Those who have obtained the qualification to engage in news publishing business, if the circumstances are serious, shall be disqualified from engaging in news publishing business:
(a) publishing news without obtaining the qualification of news publishing business;
(two) the website of a comprehensive non-news unit publishes news that is collected and written by itself, or news that does not conform to the sources specified in Article 7 of these Provisions, or does not indicate the sources of news;
(3) The website of a comprehensive non-news unit has not signed an agreement with the central news unit, the news unit of the central state organ and the news unit directly under the province, autonomous region or municipality directly under the Central Government to publish its news without authorization, or the signed agreement has not fulfilled the filing procedures;
(4) Linking to overseas news websites and publishing news published by overseas news media and Internet websites without approval.
Article 16 The news published on the Internet website contains one of the contents listed in Article 13 of these Provisions, and if it constitutes a crime, criminal responsibility shall be investigated according to law; If it does not constitute a crime, the public security organ or the state security organ shall give administrative punishment in accordance with the provisions of relevant laws and administrative regulations.
Article 17 If the news published on the Internet website contains one of the contents listed in Article 13 of these Provisions or one of the circumstances listed in Article 15 of these Provisions, the competent information industry department of the State Council or the telecommunications regulatory agencies of provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with the provisions of relevant laws and administrative regulations, order the website to be closed. And revoke its telecom business license.
Eighteenth Internet sites that have been engaged in news publishing business before the implementation of these Provisions shall, within 60 days from the date of implementation of these Provisions, go through the corresponding procedures in accordance with these Provisions.
Article 19 These Provisions shall come into force as of the date of promulgation.
