The products sold on the live broadcast platform must be new, unless it is explicitly told that they are second-hand. There is no doubt about it. Generally speaking, defective products are products with certain defects, but because of these defects, they cannot sell at a good price. Generally, it does not affect the use, so there is still a market for selling at a low price.
According to Article 26 of People's Republic of China (PRC) Product Quality Law, producers should be responsible for the quality of their products. The product quality shall meet the following requirements:
(1) There is no unreasonable danger endangering the personal and property safety, and there are national and industrial standards for protecting human health and personal and property safety, which shall be in conformity with them;
(2) Having the service performance that the product should have, except that the service performance of the product is defective;
(3) Conforming to the product standards indicated on the product or its packaging, and conforming to the quality conditions indicated in the product descriptions and physical samples.
Defective products can be sold, but they must be marked in the form of "processed products" and "defective products" and tell consumers which aspects are defective. If defective products are sold as qualified products, it is an act of deceiving consumers and should bear corresponding legal responsibilities. If the product defect affects the normal use of consumers, the seller shall be responsible for repair, replacement, return or compensation for breach of contract.
