A large number of real estate projects compete with lakes, and the 25 km lakeside zone around Caohai is occupied by real estate and other projects. Changyaoshan area on the east bank of Dianchi Lake is eroded by real estate development projects, and some projects directly occupy Dianchi Lake reserve and occupy Dianchi Lake ecological space.

On the morning of May 6, the Central Ecological Environmental Protection Inspector Group pointed out the real estate development around Dianchi Lake in a new batch of typical cases notified by inspectors, and pointed out that the local party committee and government in Kunming "only counted the immediate account, not the long-term account, and did not correctly handle the relationship between development and protection, and did not protect Dianchi Lake like protecting the eyes". Kunming has made slow progress in compiling the Dianchi Lake protection plan according to the requirements of the Regulations on the Protection of Dianchi Lake in Yunnan Province, resulting in a long-term lack of regulations to follow, and the phenomenon of "surrounding the lake" and "hanging line development" in Dianchi Lake has intensified.

"Caohai is completely surrounded by real estate"

Since 2008, Kunming has implemented the projects of "returning farmland to ponds and people" and "returning lakes to forests and wetlands". The original intention of "four retreats and three returns" is to make more ecological space for Dianchi Lake. However, since 20 15, 42 plots (covering an area of 2,463 mu) have been developed and constructed in Caohai area, occupying the lakeside zone of 25 kilometers around Caohai, and a large number of real estate projects compete with lakes for land, which can be described as "an inch of land and an inch of gold".

The relevant person in charge of Xishan District said that in the "four retreats and three returns" project, more than 2,000 villagers, about 5,000 people, were relocated in Caohai District 5, and the new development project will increase the population of Caohai District 5 by tens of thousands.

"In the past, the land that was finally moved out was built." Inspectors pointed out at the scene that the "line-sticking development" in Caohailian area seriously occupied the ecological space, and the clean water could not get in, but the pollution load was increasing.

Changyaoshan became a "cement mountain", and real estate development encroached on Dianchi Lake Reserve.

According to the inspector's discovery, from 2065438 to June 2005, Kunming Nuoshida Enterprise (Group) Co., Ltd. (referred to as Nuoshida Group for short) has started to build Dianchi International Health and Pension Resort in Changyaoshan area. The project covers an area of 3,426 mu, accounting for 92% of the total area of Changyao Mountain. It is planned to build 8 13 villas and 294 multi-storey and medium-high-rise buildings with a construction area of 2.252 million square meters. Among them, 390 villas and 25 multi-storey and medium-high-rise buildings are planned to be built in Dianchi Lake area. At present, all the planned projects have been implemented, and the ecological function of Changyao Mountain has basically lost.

Nuoshida Group illegally develops and builds real estate projects in the restricted construction area of Dianchi Secondary Protection Zone.

In fact, from July 2065438 to July 2006, the first round of central eco-environmental protection inspectors pointed out that the related projects built by Nuoshida Group occupied the first-class protected area of Dianchi Lake. However, Jinning District of Kunming and Nuoshida Group not only failed to learn the lesson, but intensified. They built asphalt roads in the first-class protection zone of Dianchi Lake, and illegally developed and built real estate projects in the restricted construction zone of the second-class protection zone of Dianchi Lake. By July 20 18, when the first round of central eco-environmental protection inspectors "looked back", Nuoshida Group had built villa 167 in the secondary protection zone.

The Regulations on the Protection of Dianchi Lake in Yunnan Province stipulates that it is forbidden to build, rebuild or expand buildings and structures in the first-class protection zone of Dianchi Lake; The restricted construction area of the secondary protection zone can only develop and construct eco-tourism and cultural projects, and other real estate projects are prohibited.

From July 2065438 to July 2008, the first round of central eco-environmental protection inspectors "looked back" and pointed out that the Regulations on the Protection of Dianchi Lake in Yunnan Province did not clearly stipulate the eco-tourism and cultural construction projects allowed to be built in the second-class protected areas, which led to some tourism real estate projects "scratching the edge". On October 20 18 165438 10, the Standing Committee of Yunnan Provincial People's Congress revised the Regulations on the Protection of Dianchi Lake in Yunnan Province, stipulating that eco-tourism and cultural projects such as healthy old-age care, fitness and leisure can be built in the restricted construction area of Dianchi Lake secondary protection zone. Under the guise of a healthy old-age care industry, Nuoshida Group continued to build 437 villas in the second-class protection and limited construction area of Dianchi Lake, covering an area of 1.242 mu with a construction area of 400,000 square meters.

The whole Changyao Mountain was developed and eroded, and the ecological space of Dianchi Lake Basin was severely squeezed.

According to the survey, the column of "the nature of rights" in the real estate ownership certificate of these villas is "market-oriented commercial housing", and the filing price of a single set of online sign is between 210.8 million and 29.92 million, which is not a declared healthy pension project, but actually a real estate development in the name of a healthy pension industry.

Dianchi Lake protection has no "rules" to follow for a long time.

In addition to the real estate projects located in the second-class protection zone of Dianchi Lake, from 20 17 to 2020, Nuoshida Group has successively built 209 villas and 294 multi-storey and medium-high-rise real estate projects in the third-class protection zone of Changyaoshan, covering an area of 189 1 mu and a construction area of17440000.

According to the relevant person in charge of Kunming Natural Resources and Planning Bureau, it is planned to comprehensively develop the 25-kilometer coastal area of Caohai Lake in Dianchi Lake. Since the development and construction in 20 15, only two projects have not yet started, and 36 kilometers of 138 km coastal area including Changyaoshan has been developed.

"Development around the lake" occupies the ecological space of Dianchi Lake and affects the water environment and water ecology of Dianchi Lake. Liu Jiachen, mayor of Kunming, said frankly, "The pollution load in Dianchi Lake Basin is still increasing, and the pattern of development around the lake has not been fundamentally changed."

Talking about the reasons for the above problems, Liu Jiachen believes that "the ideological understanding of a few cadres is still not in place, the enthusiasm for grasping the protection and governance of Dianchi Lake is not high, and the initiative to implement the requirements of ecological priority and green development is not enough."

The inspector group pointed out that the political position of the local party committee and government in Kunming is low, the attitude towards the protection and governance of Dianchi Lake is not firm, the action is discounted, the standards are not high, and the requirements are not strict. They are just small accounts, not big accounts, but immediate accounts, not long-term accounts. They have not handled the relationship between development and protection well, and have not protected Dianchi Lake as well as protecting their eyes. Kunming has made slow progress in compiling the Dianchi Lake protection plan according to the requirements of the Regulations on the Protection of Dianchi Lake in Yunnan Province, resulting in a long-term lack of regulations to follow, and the phenomenon of "surrounding the lake" and "hanging line development" in Dianchi Lake has intensified.

The inspector also pointed out that the relevant functional departments of Yunnan Province did not perform their duties in place and failed to point out and stop the illegal development and construction of Changyaoshan in Dianchi Lake in time.
