The term "off-campus custody institution" as mentioned in these Measures refers to an institution organized by citizens, legal persons or other organizations and entrusted by student guardians to provide after-school custody services such as dining, lunch break and after-school custody for students outside the school. Article 3 The management of off-campus trust institutions shall follow the basic principles of legal establishment, standardized management and ensuring safety. Article 4 The municipal government shall set up a joint meeting on the management of student trusteeship service, which shall be composed of the municipal education administrative department in conjunction with the municipal departments of development and reform, finance, industry and informatization, market supervision and management, planning and natural resources, health, public security, civil affairs, urban management comprehensive law enforcement, housing construction, construction and municipal engineering. Coordinate the management of student trusteeship service in this city, and study and solve major problems in the management of student trusteeship service.
Each district (new district) should establish a corresponding communication and coordination mechanism for the management of student custody service, and coordinate the management of student custody service in the compulsory education stage in this district. Article 5 The municipal education administrative department shall be responsible for the overall coordination of student trusteeship services.
Market supervision departments shall be responsible for commercial registration, food safety and supervision and management within the scope of responsibilities of for-profit off-campus trust institutions according to law.
The civil affairs department shall be responsible for the registration of private non-enterprise units of non-profit off-campus trust institutions and the supervision and management within the scope of their duties.
The health department shall be responsible for the health supervision and management, daily inspection and epidemic prevention and control of off-campus trust institutions according to law.
The fire department shall be responsible for the verification of the fire safety conditions of the off-campus trust institutions according to law, implement daily supervision and management, and guide all sectors of society to carry out fire safety inspections on the off-campus trust institutions of students.
The police station shall be responsible for the supervision and management of public security in and around the off-campus trust institutions within its jurisdiction according to law, and provide guidance and training for the personnel of off-campus trust institutions in terms of safety technical prevention and public security management.
Sub-district offices (including offices under the jurisdiction of the new district) are responsible for the daily inspections, comprehensive law enforcement and coordination of off-campus trust institutions within their jurisdiction.
The relevant functional departments of the city and district shall, in accordance with their respective responsibilities, do a good job in the management of off-campus custody institutions according to law. Article 6 Community neighborhood committees are encouraged to use community resources to set up or cooperate with others to set up off-campus custody institutions, or provide off-campus custody services in other forms to meet community needs.
The community workstation shall incorporate the off-campus custodian into the community safety management, and assist the public security, fire protection, food and drug supervision and other departments to conduct safety supervision on the off-campus custodian. Article 7 The off-campus training institutions established according to law and qualified to provide off-campus custody services are encouraged to change their business scope at the registration authority in time.
If an off-campus custodian institution conducts education and training activities, it shall be implemented in accordance with the relevant provisions of off-campus training institutions. Article 8 Citizens, legal persons or other organizations (hereinafter referred to as sponsors) who set up off-campus custody institutions shall go through industrial and commercial registration according to law. If an off-campus trust institution is established for non-profit, it shall go through the registration of private non-enterprise units according to law.
If the off-campus custodian institution changes the registered content, it shall go through the corresponding changes at the original registration authority according to law, and if the business premises change, it shall also inform the health, food safety, fire protection and other regulatory authorities in a timely manner. Article 9 An off-campus custody institution that has obtained a commercial registration certificate or a private non-enterprise unit registration certificate according to law shall meet the following conditions before engaging in off-campus custody services:
(1) Having service places and facilities that meet the requirements of laws, regulations, rules and these Measures on fire control, construction, sanitation, food business and food safety;
(two) there are staff commensurate with the scale of start-up, and the main person in charge has the ability to bear civil liability independently;
(3) Other conditions stipulated by laws, regulations and rules. Article 10 The places where off-campus custody institutions provide custody services shall conform to the safety of building structures and keep a legal safe distance from dangerous chemicals. The construction area is more than 80 square meters, and the per capita construction area of hosting students is more than 4 square meters. The places where off-campus custody institutions provide custody services shall not be in the same building as the places where dangerous chemicals are produced, managed, stored and used, and it is forbidden to provide custody services in basements, storage buildings, polluted areas, dangerous areas and other places.
Market supervision departments, housing construction departments and public security organs may, jointly with relevant administrative departments, formulate guidelines on food safety conditions, fire fighting conditions and safety technical precautions for off-campus custodians in accordance with laws, regulations and rules on food safety, fire fighting and safety precautions, combined with the actual situation of off-campus custodians in this Municipality. Article 11 An off-campus custody institution shall be staffed according to the number of custody students. If there are less than 25 students, it shall be equipped with more than 2 staff members. For every 20 additional students, there should be a corresponding increase of 1 staff.
The staff of the off-campus trust institution shall have no criminal record, good health and no mental illness, infectious diseases or other diseases that may affect the health and safety of students.
If the off-campus trust institution provides catering services, its staff engaged in catering services shall obtain health certificates in accordance with the law before taking up their posts, and conduct health checks every year.
