On February 2 1 7 this year, the State General Administration of Sport 17 issued the Management Measures for Business License of High-risk Sports. Based on the National Fitness Regulations, the application conditions and approval procedures for operating high-risk sports events are refined, the responsibilities of sports authorities at all levels to strengthen the management of high-risk sports events and protect the legitimate rights and interests of participants in high-risk sports events are clarified, and high-risk sports events are standardized. In order to implement the requirements of laws and regulations on the management of high-risk sports, and actively promote the healthy development of national fitness and sports industry, the management of high-risk sports is hereby notified as follows:

Unified understanding, clear management object and scope.

(1) The scope of the first batch of high-risk sports. The State Sports General Administration, Ministry of Human Resources and Social Security, State Administration for Industry and Commerce, State Administration of Quality Supervision, Inspection and Quarantine and state administration of work safety jointly issued AnnouncementNo. 1 of 2007. 16 may 13, swimming, alpine skiing, freestyle skiing, snowboarding, diving and rock climbing were defined as the first batch of high-risk sports. According to the classification of competitive sports, the first batch of high-risk sports are six events. "Swimming" refers to swimming activities in swimming pools, swimming pools and other artificial places, excluding swimming in open waters.

(2) Main business of high-risk sports. The business entities of high-risk sports projects refer to all kinds of entities engaged in the management of high-risk sports projects listed in the announcement, including both for-profit enterprises and individual industrial and commercial households, as well as institutions, social organizations and private non-enterprise units with business activities. As long as they are market participants engaged in high-risk sports activities, whether for profit or not, they should apply to the sports authorities for permission according to law.

Two, based on reality, clear high-risk sports project management approval procedures.

The General Administration of Quality Supervision, Inspection and Quarantine and the National Standardization Administration of China issued the Operating Conditions and Technical Requirements for Gymnasiums and Sports Fields, which is the national standard for facilities, equipment, personnel, hygiene, environment and safety of stadiums and gymnasiums open to the public. According to the National Fitness Regulations, the Measures for the Administration of Business License of High-risk Sports Events and the Operating Conditions and Technical Requirements of Gymnasiums and Sports Fields, the State Sports General Administration has detailed the conditions and materials that sports facilities should have in the specific examination and approval conditions and application materials for operating high-risk sports events. Many sports facilities and equipment come with certificates when they leave the factory. According to national regulations, cable cars, gas cylinders and other special equipment must be inspected by special equipment inspection and testing institutions before they can be used. Therefore, the State Sports General Administration stipulates that the applicant shall inspect the sports facilities item by item according to the form that the sports facilities meet the relevant national standards, submit relevant certificates of conformity and make a commitment. In addition, the applicant can also entrust an inspection agency or certification agency to inspect the sports facilities and bear the relevant expenses.

(four) the professional qualification certificates of social sports instructors and rescuers. The National Fitness Regulations stipulates that those who engage in high-risk sports should have a specified number of social sports instructors and ambulancemen who have obtained national vocational qualification certificates. The "national vocational qualification certificate" as mentioned in the regulations refers to the vocational qualification certificate uniformly printed by Ministry of Human Resources and Social Security. Holding qualification certificates issued by other sports organizations, sports authorities and overseas institutions. , should be carried out in accordance with the requirements of the "Labor Law" and "Vocational Education Law" vocational skills appraisal, after obtaining the vocational qualification certificate, can engage in related work in high-risk sports venues. Self-regulatory organizations of social sports instructors and rescuers established according to law may, according to the needs of industry management, put forward requirements for their members, standardize their behaviors, and continuously improve their professional ability and level.

At present, the professional standards of social sports instructors such as diving and rock climbing have not yet been introduced. Before the standards have not been promulgated and the professional skill appraisal of social sports instructors for diving and rock climbing has not been carried out, the sports authorities at all levels must explain to the market participants and parties applying for diving and rock climbing, and contact the applicant for arrangement after the relevant work preparation is completed. At the same time, the vocational skill appraisal guidance center of the State Sports General Administration will also step up relevant preparations.

(5) Strengthen the field verification. On-the-spot verification is the necessary procedure for the sports authorities to implement the business license of high-risk sports. According to the classified management measures or requirements formulated by the sports bureaus of all provinces, autonomous regions and municipalities directly under the Central Government, the competent sports department that receives the application for operating high-risk sports projects shall assign more than two staff members to conduct on-the-spot verification. The competent sports department may entrust an inspection agency or certification agency to conduct on-the-spot verification, and the staff of this department will go together, and the entrusted expenses shall be borne by the competent sports department. On-the-spot verification shall verify whether the materials submitted by the applicant are true or not, and shall be carried out item by item according to the form that the sports facilities meet the relevant national standards. The competent sports department may, by itself or by entrusting inspection agencies and certification bodies, test the technical indicators with strong technology.

Third, find out the base and do a good job in the management of high-risk sports.

According to the provisions of the Measures for the Administration of Permits for Operating High-risk Sports Events, if the management of high-risk sports events listed in the catalogue has been carried out before the publication of the catalogue, the operators shall apply for permission before 20 13 1 1. Sports departments at all levels should first find out the base number of high-risk sports venues that have been operated within their administrative areas, and take the initiative to contact local industrial and commercial administrations and other relevant departments to obtain relevant information; Second, it is necessary to publicize and explain the business premises and their operators and managers, so that they can understand the relevant laws, regulations and systems and take the initiative to accept the supervision of the sports authorities; Third, actively help the operators of high-risk sports events to prepare for the application according to the licensing conditions, and help them rectify the business premises with large gaps in conditions.

(seven) to create conditions for law enforcement personnel and social sports instructors to obtain corresponding qualifications. Sports departments at all levels should take the initiative to participate in the training organized by the legal department of the local government according to the actual situation, speed up the training of law enforcement personnel, and make a good reserve of law enforcement personnel. After the promulgation and implementation of "Professional Qualification Standard for Social Sports Instructors of Diving and Rock Climbing", professional skill appraisal began immediately. Sports authorities at all levels should actively organize relevant personnel to participate in vocational skill appraisal and obtain corresponding vocational qualification certificates. The professional skills appraisal of social sports instructors and lifeguards such as swimming and skiing should also be strengthened.

Four, strengthen leadership, and earnestly implement the management of high-risk sports.

(eight) put the management of high-risk sports in an important position. The management of high-risk sports is not only related to the national fitness, but also related to the sports industry and sports market. There are also a large number of administrative law enforcement actions such as administrative licensing and administrative punishment, which have certain complexity. As the main body responsible for the management of high-risk sports events, sports authorities at all levels should take this work as an important task to safeguard and improve people's livelihood and accelerate the transformation of economic development mode, and put it on the work plan and agenda. The implementation of administrative licensing and administrative law enforcement are relatively independent work, and the sports authorities at all levels should clarify the responsible departments and implement the internal staff of their own units. Conditional can also strive to set up special institutions and personnel to take charge of this work. The implementation of this administrative license requires on-the-spot verification, which may increase administrative expenses such as purchasing professional equipment and hiring professional technical institutions. Sports authorities at all levels should ensure that the management funds for high-risk sports projects are put in place in accordance with the provisions of the Administrative Licensing Law that the funds required for the implementation of administrative licensing by administrative organs are included in the budget of administrative organs and guaranteed by the finance at the corresponding level.

(nine) seriously organize the study, publicity and implementation of relevant laws and regulations. "Management Measures for Business License of High-risk Sports Events" and "Announcement on the Catalogue of the First Batch of High-risk Sports Events" have been issued one after another. The State Sports General Administration will regard the study and publicity of laws, regulations and norms related to the management of high-risk sports as an important part of popularizing the law in the national sports system in the future, and organize and guide the sports authorities at all levels to learn through various forms. Sports authorities at all levels should link the study, publicity and implementation of laws and regulations with specific work, so that comrades in the sports system can understand the essence of managing high-risk sports, and specific staff can accurately grasp the working procedures and requirements and administer according to law. It should be widely publicized to the society through news media such as television, radio, newspapers and the Internet. Expanding the operation of high-risk sports requires the social cognition and influence of the permission and supervision of the sports authorities, which attracts the attention of the whole society and lets consumers know their legitimate rights and interests. In particular, targeted publicity should be given to the operators of high-risk sports events to ensure the safety of the people.

(ten) pay close attention to the construction of supporting systems. The National Fitness Regulations issued by the State General Administration of Sport, the Measures for the Administration of Permits for Operating High-risk Sports Events, the Announcement of the First Batch of High-risk Sports Events and other notices related to the management of high-risk sports events are the basic documents for the management of high-risk sports events. To do this work well, local sports authorities need to study and formulate relevant supporting documents. According to the spirit of the reform of administrative examination and approval system in the State Council, the State Sports General Administration delegated the license for operating high-risk sports to the provincial sports authorities, who should, in light of local conditions, promptly formulate the grading methods for licenses at the provincial, prefectural, district and county levels. The State Sports General Administration has uniformly stipulated the business license style, and the provincial sports authorities shall print and number it according to the format requirements, and clarify the relevant issues concerning the use of licenses by sports authorities at all levels in this province. At present, some places have formulated local laws and regulations on sports business activities to regulate high-risk sports within their administrative areas, and there are some procedural requirements. Combined with the National Fitness Regulations, according to the promulgation of the Measures for the Administration of Operating High-risk Sports Licenses and the Catalogue of the First Batch of High-risk Sports, the relevant provincial sports authorities should contact the legal department of the local government as soon as possible, make timely adjustments, and safeguard the unity of the national legal system.

(eleven) to strengthen cooperation with relevant departments. Sports authorities should continue to actively cooperate with local industrial and commercial departments to provide services and help for operators of high-risk sports projects to obtain licenses and qualified operations. Sports authorities can give full play to the role of relevant sports associations and professional and technical institutions to conduct on-the-spot verification of high-risk sports. The daily supervision of the operation of high-risk sports events can be implemented by the sports authorities alone according to law, and can also actively cooperate with the relevant departments of industry and commerce, health, public security and so on. And conduct supervision and inspection together.

(twelve) standardize the management of high-risk sports. The management of high-risk sports includes administrative licensing, daily supervision and administrative punishment. The Administrative Licensing Law and the Administrative Punishment Law have clear requirements on the behavior of administrative organs, and the Regulations on National Fitness and the Measures for the Administration of Licensing for Operating High-risk Sports Projects have also made specific provisions accordingly. This is not only the right and responsibility of the sports authorities, but also the obligation to protect the legitimate rights and interests of citizens, legal persons and other organizations, and at the same time bear the consequences of administrative reconsideration and administrative litigation caused by improper administrative actions. If the administrative organ refuses to grant permission to those who meet the statutory conditions, grants permission to those who do not meet the statutory conditions, and fails to perform or fail to perform supervisory duties to the licensee after permission, the responsible person in charge and other directly responsible personnel must bear corresponding legal responsibilities. Sports authorities at all levels must attach great importance to it, standardize the management of high-risk sports in strict accordance with the requirements of the law, and ensure the effective and accurate work.

(thirteen) to strengthen the management and supervision of sports business activities. Sports authorities at all levels, while doing a good job in the management of high-risk sports events, should continue to manage and supervise sports business activities other than high-risk sports events in accordance with the provisions of Article 44 of the Sports Law of the People's Republic of China, earnestly perform their duties entrusted by law and maintain the order of the sports market.
