The term "social life noise pollution" as mentioned in these Regulations refers to the phenomenon that the social life noise generated exceeds the national social life noise emission standard and interferes with the normal life, work and study of others. Article 3 These Regulations shall apply to the prevention and control of social life noise pollution and its supervision and management in urban planning areas of cities and counties (districts). Article 4 The prevention, supervision and management of noise pollution in urban social life shall follow the principles of people-oriented, prevention-oriented, comprehensive management and public participation. Article 5 The people's governments of cities and counties (districts) shall incorporate the prevention and control of noise pollution in urban social life into environmental protection planning, delimit and publish the applicable areas of noise quality standards in urban planning areas of cities and counties (districts) according to the national standards for acoustic environment quality, and adopt economic and technical policies and measures conducive to acoustic environment protection for management. Article 6 The municipal administrative department of ecological environment and its dispatched offices shall exercise unified supervision and management over the prevention and control of noise pollution in urban social life within their respective administrative areas, and urge, guide and coordinate other departments exercising their duties of noise management in social life according to law to carry out supervision and management of noise pollution prevention and control in urban social life.
City and county (District) urban management law enforcement departments shall, according to their duties, do a good job in the comprehensive administrative law enforcement work of noise pollution prevention and control in urban social life according to law.
City, county (District) public security, natural resources, housing and urban and rural construction, culture and tourism, market supervision and management, education and other relevant administrative departments, in accordance with their respective responsibilities, do a good job in the prevention, supervision and management of noise pollution in urban social life. Seventh community residents' committees and villagers' committees shall assist the local people's governments and relevant departments to supervise and manage the noise pollution of social life that affects the community and mediate the neighborhood disputes caused by the noise of social life. Property service enterprises should discourage the noise pollution of social life in the management area; If dissuasion is ineffective, it shall promptly report to the public security organ or the urban management law enforcement department. Eighth to encourage and support units, social organizations, other organizations and individuals to carry out various forms of social life noise pollution prevention and control of scientific knowledge publicity activities, improve public awareness of social life noise pollution prevention and control. Ninth in the noise sensitive buildings concentrated area, shall not engage in metal cutting, stone and wood processing and other business activities that are prone to noise pollution.
No commercial cultural and entertainment venues such as song and dance halls shall be built in areas where noise-sensitive buildings are concentrated or in noise-sensitive structures. Article 10 The boundary noise of newly-built commercial cultural and entertainment places must meet the environmental noise emission standards stipulated by the state; Do not meet the national environmental noise emission standards, the cultural administrative department shall not issue a cultural business license, and the market supervision and management department shall not issue a business license. Article 11 Operators of shopping malls, supermarkets, catering services, processing and maintenance, bazaars and other commercial places and cultural and entertainment places such as dance halls shall strengthen the management and control of noise generated in business activities, so that the boundary noise value does not exceed the emission standards prescribed by the state.
Where noise-producing equipment and facilities such as air conditioners, cooling towers, exhaust fans, generators and pumps are installed and used in business places and business cultural and entertainment places, effective noise pollution prevention facilities shall be set up in accordance with regulations to prevent environmental noise pollution. Twelfth in commercial activities, loudspeakers, high-power audio equipment or other high-noise methods are not allowed to attract customers and promote goods. Thirteenth in the city streets, squares, parks and other public places to organize entertainment, fitness, cultural performances, gatherings and other activities, the use of excessive volume audio equipment that may interfere with the surrounding living environment, must comply with the provisions of the local public security organs.
In areas where noise-sensitive buildings are concentrated and public areas such as nearby streets, squares and parks, it is forbidden to use musical instruments, amplification equipment, whipping gyroscopes, whipping and other noisy ways for entertainment and fitness from 12 to 14 and from 22: 00 to 7: 00 the next day, as well as during the senior high school entrance examination and college entrance examination, which will affect the normal life of surrounding residents.
It is forbidden for any unit or individual to use tweeters in areas where noise-sensitive buildings are concentrated. Fourteenth fireworks shall not violate the relevant provisions of the people's governments at or above the county level. Fifteenth kindergartens, schools and other units to use radio and audio equipment, should arrange the time reasonably, and take measures such as reducing the volume, so as not to cause noise pollution to neighboring parties. Article 16 In residential buildings that have been completed and delivered for use, activities such as decoration and furniture processing shall be carried out, and no noise pollution operation shall be carried out from 12 to 14 and 19 to 7: 00 the next day, during the senior high school entrance examination and college entrance examination. Those who engage in the above operations at other times shall take effective measures to avoid or reduce noise pollution to the surrounding residents.
