The sports business activities mentioned in these Regulations refer to business activities with sports as the content for the purpose of making profits.
The sports mentioned in the preceding paragraph shall be put forward by the sports administrative department of the provincial people's government according to the provisions of the state and the actual situation of the province, and shall be announced after being approved by the provincial people's government. Article 3 The sports administrative department of the people's government at or above the county level or the institution authorized by the people's government (hereinafter referred to as the sports administrative institution of the people's government at or above the county level) shall be responsible for the management of sports business activities within their respective administrative areas.
The departments of industry and commerce, public security, price, taxation and health of the people's governments at or above the county level shall, according to their respective responsibilities, do a good job in the management of sports business activities. Article 4 Citizens, legal persons and other organizations engage in sports business activities according to law, and their legitimate rights and interests are protected by law.
Encourage and support sports operators to participate in the implementation of the national fitness plan and train outstanding athletes. Article 5 To engage in sports business activities, the following conditions shall be met:
(1) Having a place suitable for its sports activities;
(two) there are necessary funds and sports facilities and equipment that meet the standards;
(3) Having sports professional and technical personnel who have received special training and obtained qualification certificates;
(4) Having corresponding safety conditions;
(5) Other conditions stipulated by laws and regulations. Sixth mountaineering activities, health qigong activities and the establishment of places, martial arts schools, children's sports schools, should go through the examination and approval procedures in accordance with state regulations.
To hold sports competitions and sports performances, the organizer shall, in conjunction with the local public security organs, implement security measures. Seventh sports operators should operate according to the bright light, clearly mark the price according to the charging items and standards approved by the price management department, and shall not collect fees at random. Eighth sports operators should establish and improve the rules and regulations to ensure the safety of sports business activities, equipped with safety and fire control facilities, eliminate hidden dangers of accidents and maintain normal business order.
It is forbidden to bring guns and ammunition, controlled knives and inflammable and explosive dangerous goods into sports business activities. Article 9 When organizing business activities of sports competitions and performances, the time, place, events and teams participating in the competitions and performances shall be announced, and tickets shall be sold according to the amount approved by the relevant departments. Article 10 Advertisements for sports competitions, sports performances and business activities shall go through the examination and approval procedures in accordance with the relevant state regulations on advertising management. Eleventh sports business activities must be healthy and beneficial to the construction of socialist spiritual civilization. It is forbidden to use sports business activities to engage in gambling, endanger people's physical and mental health and other activities that endanger social security. Twelfth people entering the sports business premises should obey the management, observe public order, and take good care of sports facilities; Damage to sports facilities shall be compensated according to law. Thirteenth sports training and sports agent management, in accordance with the relevant provisions of the state and the provincial people's government. Article 14 People's governments at or above the county level or sports management institutions shall commend and reward sports operators who have made outstanding achievements in implementing the national fitness plan and cultivating outstanding athletes, and who have made meritorious deeds in exposing and exposing illegal acts in sports business activities. Fifteenth in violation of the provisions of this Ordinance, the use of sports facilities and equipment that do not meet the requirements of the state to engage in sports business activities shall be ordered by the sports management institution of the people's government at or above the county level to make corrections; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law. Sixteenth engaged in sports business activities, one of the following acts, the people's governments at or above the county level sports management agencies shall be ordered to make corrections:
(a) employing personnel who have not obtained the qualification certificate to engage in sports professional and technical work;
(two) selling tickets for sports competitions and sports performances in excess of the approved amount. Seventeenth in violation of the relevant state laws and regulations on industry and commerce, public security, prices, taxation, health and so on. , handled by the relevant departments according to law; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law.
Engaged in sports business activities, causing damage to others, the operator shall be liable for compensation according to law. Eighteenth if a party refuses to accept a specific administrative act made by an administrative organ, it may apply for administrative reconsideration or bring an administrative lawsuit according to law. If a party refuses to accept the decision on administrative punishment and fails to apply for reconsideration, bring a lawsuit or perform the punishment decision within the time limit, the organ that made the punishment decision may apply to the people's court for compulsory execution. Article 19 Any functionary of a state organ who neglects his duty, abuses his power or engages in malpractices for personal gain in sports management shall be given administrative sanctions by his unit or the competent department at a higher level; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 20 These Regulations shall come into force on March 1 2005.
